Announcement on the management of road traffic safety
To further maintain the city's road traffic order, ensure the personal and property safety of the general public, and improve road traffic Efficiency, creating a safe, civilized and harmonious traffic environment, the Traffic Administration of Xi'an Municipal Public Security Bureau, in accordance with the laws, regulations and normative documents such as " Road Traffic Safety Law of the People's Republic of China", " Xi'an Road Traffic Safety Regulations ", and "Xi'an City Investigation and Punishment of Illegal Passengers in the Illegal Carrying of Motorcycles and Non-Motor Vehicles", the following notices are as follows:
1. It is prohibited to drive motorcycles without obtaining a motor vehicle driver's license, the motor vehicle driver's license is revoked or the motor vehicle driver's license is temporarily detained.
2. Motorcycle drivers and passengers are prohibited from wearing helmets on the road; electric bicycles, electric tricycle drivers and passengers are encouraged to wear safety helmets.
3. It is prohibited to park illegally or temporarily park electric bicycles, electric tricycles and motorcycles.
4. Electric bicycles, electric tricycles, and motorcycles are prohibited from driving in accordance with the prescribed lanes, and illegally occupying bus lanes and emergency lanes.
5. Electric bicycles, electric tricycles and motorcycles are prohibited from changing lanes illegally, forcibly changing lanes, and illegally continuously changing lanes.
6. Electric bicycles, electric tricycles and motorcycles are prohibited from running red lights or driving in the opposite direction, illegally carrying people, and overloading people. Minors are not allowed to carry people when driving bicycles or electric bicycles. Adults can carry one child not exceeding 12 years of age when driving bicycles or electric bicycles. Children under 6 years old should ride in a fixed seat. The back seat of a motorcycle is not allowed to be used in minors under the age of 12, and the motorcycle is not allowed to carry people.
7. Electric bicycles, electric tricycles, and motorcycles are prohibited from deliberately covering or destructing license plates, driving on the road without license plates, and using expired temporary license plates, fake license plates, or fake license plates.
8. Electric bicycles and motorized wheelchairs for the disabled with maximum speed, empty car quality, and dimensions that meet the relevant national standards can only be driven on the road after being registered and obtained by the traffic management department of the public security organs at or above the county level.
9. Electric tricycles, regular tricycles, two-wheeled motorcycles, disabled motor wheelchairs, and electric bicycles are prohibited from engaging in illegal operations.
10. The following motor vehicle models that are not included in the license catalog of the national motor vehicle product competent department are prohibited from driving on the road:
(I) Electric vehicles exceeding the national electric bicycle standards;
(II) Motor wheelchair vehicles exceeding the national standard for motor wheelchairs for disabled people;
(III) Electric tricycles.
If the vehicle specified in the preceding paragraph illegally drives on the road, it shall be dealt with in accordance with the management regulations of the motor vehicle.
11. If a motorcycle driver is in any of the circumstances in Article 1 of this Notice, he may be fined not less than RMB 200 and not more than RMB 2,000, and detained not less than 15 days; if a motorcycle driver is in any of the circumstances in Article 2 to Article 7 of this Notice, he may be fined not less than RMB 20 and not more than RMB 200; if there are otherwise provided by my country's "HTM4 Road Traffic Safety Law " and its supporting regulations, he shall be punished in accordance with the provisions.
12. If an electric bicycle or electric tricycle driver is in any of the circumstances in Articles 2 to 7 of this notice, he may be punished with criticism, education, warning, or a fine of not less than RMB 50 and not more than RMB 50; if an electric bicycle or electric tricycle driver refuses to accept the fine, he may be detained. If an electric vehicle driver violates Article 8 of this Notice, he or she may impose a fine of 50 yuan.
13. If an electric tricycle, regular tricycle, two-wheeled motorcycle, disabled motor wheelchair, and electric bicycle engaged in illegal operations, the traffic management department of the public security organ shall order the passengers to stop carrying passengers, seize the vehicle in accordance with the law, and impose a fine of not less than RMB 500 and not more than RMB 2,000; if one of the following circumstances occurs, a fine of not less than RMB 2,000 and not more than RMB 5,000:
(I) Illegal passengers are carried more than three times;
(II) Illegal passengers are carried around bus stations, train stations, subway stations, subway stations, wholesale markets, shopping malls, hospitals, schools, exhibition halls, tourist attractions and other places with high traffic during rush hours;
(IV) Illegal passengers are carried around bus stations, train stations, subway stations, subway stations, wholesale markets, shopping malls, hospitals, schools, exhibition halls, tourist attractions and other places with high traffic;
(IV) Illegal passengers are carried by non-disabled persons driving a disabled motor wheelchair illegally;
(IV) Illegal passengers are carried by non-disabled persons in illegally;
14. If the offender is in one of the circumstances in Article 10 of this Notice and the offender has not obtained a motor vehicle driver's license, he may impose an administrative penalty of administrative detention of for less than 15 days in accordance with the "Road Traffic Safety Law" of my country.
Electronic bicycles, electric tricycles, motorcycle drivers and other traffic participants should consciously abide by road traffic safety laws and regulations and obey the command of the people's police. For those who obstruct the people's police from performing their official duties, the public security organs will strictly investigate and punish them in accordance with the law and hold them accountable for corresponding legal responsibilities. Relevant investigation and punishment information will be included in the personal credit reporting system in accordance with the law.
Traffic safety cannot be ignored, and traffic violations must be eliminated. We remind the majority of electric bicycles, electric tricycles, motorcycle drivers and passengers to drive in accordance with the law and travel safely for their own safety and their families' happiness.
