Musk and Twitter may go to court sooner than many people expect. According to reports, after Twitter sued Musk in Delaware on Tuesday for violating the acquisition agreement, Justice Kathaleen McCormick of the state court has scheduled a hearing on the case for July 19 at 11 a.m. ET. During the 90-minute hearing, Twitter will present its arguments to advance the trial in September.
Prior to this, Musk and Twitter had quite a disagreement over the actual number of fake accounts on the platform. In the end, the former directly announced its intention to stop purchasing the latter last week. In the complaint, Twitter accused Musk of unilaterally withdrawing from the agreement after proposing and signing a contract that was beneficial to the seller, disrupting the company's operations and damaging shareholder value in the process. At the same time, they also emphasized that Musk has been using his own rhetoric to discredit and belittle Twitter without fully analyzing Twitter data.
So far, Musk has not filed a counterclaim against Twitter. If the court ends up siding with Twitter, then Musk may only have to continue the acquisition or pay a high breakup fee.
