Wang and his wife run a wholesale stall in Xinnong, Xiaoshan District, Hangzhou City, which mainly sells frozen foods such as chicken and duck products, hot pot meatballs, etc. In the past two years, seeing that the stall next door has made great profits in selling cattle leaves, Wang was also moved and started selling cattle leaves.
In March 2021, the public security organs found Wang based on clues reported by the masses. During the interrogation, Wang explained that since the cattle loaves are not easy to clean and preserve, when he was searching for treatment methods online, someone mentioned that using chemical preparations such as formaldehyde, alkali , hydrogen peroxide , etc., it can have the effect of whitening and weight gain, anti-corrosion and freshness. Driven by interests, Wang chose to do the same. In less than half a year, Wang used the above methods to process and sell more than 1,000 kilograms of cattle loaves with toxic substances such as formaldehyde, with a sales amount of more than 20,000 yuan.
In September 2021, the Xiaoshan District Procuratorate filed a public prosecution against Wang for suspected production and sale of toxic and harmful food. On March 24 this year, after trial, the court adopted the Xiaoshan District Procuratorate's allegation of facts, crimes and related sentencing opinions, and made the above judgment in accordance with the law. Wang said in court that he would not appeal.
"According to Wang's confession, the 'poisonous cattle bailey' involved in the case was not only sold through his personal wholesale stalls, but most of the other has been delivered to some well-known fast food restaurants in the jurisdiction." The prosecutor in charge found in the case that in addition to criminal crimes, Wang also infringed on the personal health and safety of unspecified consumers and harmed the public interests of society.
After completing the pre-trial announcement procedure and filing a lawsuit by an unqualified entity after the expiration of the period, the Xiaoshan District Procuratorate, as the prosecutor of the public interest litigation, filed a criminal civil public interest lawsuit with the Xiaoshan District Court in November 2021, requesting the court to order Wang to pay a total of more than 200,000 yuan in compensation of 10 times the price of the toxic and harmful food sold, and publicly apologize on the provincial or above media or platforms.
After that, Wang publicly apologized on the Justice Website and paid more than 200,000 yuan in compensation. On January 27, the Xiaoshan District Procuratorate and the defendant reached a mediation agreement under the auspices of the court.
