The military service law is usually formulated in accordance with the constitution and constitutional laws, and is promulgated by the highest authority of the state or the head of state. The purpose is to ensure the replenishment of the army and strengthen the construction of the country's armed forces.
The military service law is the country's basic military law. Its formulation and implementation are of great significance for establishing and improving the country's military service system, ensuring that citizens perform their military service obligations in accordance with the law, and strengthening the construction of the army and the national defense reserve force.
During the Revolutionary War, in order to ensure the source of the people's army, the revolutionary base areas and liberated area governments led by the Communist Party of China have formulated and issued laws and decrees related to the content of military service, and the political conditions, age, etc. There are clear regulations on the preferential treatment of soldiers, such as the First National Congress of the Chinese Soviet Workers, Peasants and Soldiers in November 1931, and the "Regulations on Preferential Treatment of the Chinese Workers, Peasants and Red Army" issued in the name of the Soviet Central Government; January 13, 1942 On Japan, the Jin-Chahar-Hebei Border Region Government promulgated the Interim Law on the Implementation of the Voluntary Military Service System. According to the "Decision on Amending the Military Service Law of the People's Republic of China" at the 23rd meeting of the Standing Committee of the Eleventh National People's Congress on October 29, 2011, the third amendment was made.
On August 20, 2021, the 30th meeting of the Standing Committee of the 13th National People's Congress deliberated and passed the newly revised Military Service Law of the People's Republic of China, and President Xi Jinping signed the ninth Chairman's Decree No. 15 is promulgated and will come into force on October 1, 2021.
