A case of gang-like organization
0 Since the second half of 2015, the defendant Xu Moumou has been involved in the casinos and chess and card rooms of Jiangyin Ligang and Huangtu, making friends with various gambling personnel, developing gambling-related connections. In order to further strengthen the organizational power and ensure illegal interests, the defendant Xu Moumou recruited his subordinates by providing food, accommodation, and paying wages. Gradually, the defendants Xu Moumou are the organizers and leaders, the defendants Miao Moumou, Cheng Mou, Yang Moumou, and Liu Moumou are the backbone members, and the defendants Liu Moumou, Geng Mou, Zhong Moumou, Qu Moumou, Luo Moumou, Ru Moumou, Hu Moumou, Guo Moumou, Luo Moumou, Zhang Moumou and other ordinary members.
This organization is relatively stable, with a large number of people, a large scale, and clear internal work. The defendant Xu Moumou made decisions, command, coordinate and manage the development, operation and activities of the organization, and was the organizer and leader of the organization. The organization is strictly managed. In order to strengthen the management and control of organization members, the defendant Xu Moumou has formulated that all organization members must listen to the defendant Xu Moumou and are not allowed to cause trouble outside without permission. Once the organization member is arrested, he must take the blame personally and not involve him or other organization members. If the organization member violates the regulations, he will be educated and scolded by the defendant Xu Moumou at the least, and will be directly fired at the worst.
The organization obtains economic benefits through illegal means such as opening casinos, releasing money, setting up gambling games and fraud. On the one hand, the defendant Xu Moumou used the illegally obtained benefits to pay daily expenses, such as providing food, accommodation, entertainment, and paying wages to the members of the organization to win over the members of the organization. On the other hand, the illegally obtained benefits continue to be used to open casinos and releasing money to obtain more benefits, and thus continuously strengthen the organization and maintain the survival and development of the organization.
In order to ensure economic benefits, the defendant Xu Moumou and others successively purchased steel pipes, hunting rifles, machetes, walkie-talkies, cars and other tools for crimes, and adopted violence and threats. They organized illegal and criminal activities such as opening casinos, fraud, fighting, provoking trouble, and illegal detention. They were arrogant and caused great psychological fear to the victims and the relevant people, seriously endangering the personal and property safety of the people, and seriously undermining the order of economic and social life. Fearing from the tyranny of the organization, the victims and the masses did not dare to report the case to the public security organs. Some victims heard that the defendant Xu and others were arrested, so they dared to return to their hometown to reunite with their families.
After trial, Jiangyin Court held that: The defendant Xu Moumou organized and led a gang-like organization. The organization organized illegal and criminal activities through violence and threats, seriously disrupting the order of social life; the defendant Xu Moumou opened a casino with others for the purpose of making profits, and the circumstances were serious; for the purpose of illegal possession, he used fictitious facts and concealed the truth to defraud others of money, and the amount was particularly huge; he violated the regulations on gun management and illegally bought and sold a gun-powder-powered firearm; in order to show off his strength, he gathered others to fight with weapons many times; beat, chase, intercept, insult, and intimidate others at will, and the circumstances were serious; in order to claim debts, he illegally deprived others of their personal freedom, and had the circumstances of being beaten, and his behavior indeed constituted the crime of organizing and leading a gang-like organization, opening a casino, fraud, illegal buying and selling guns, gathering a crowd to fight, provoke trouble, and illegal detention.As the primary member of the organization and leadership of a criminal group for criminal activities, if the defendant Xu is the main culprit, he shall be punished according to all the crimes committed by the group; he plays a major role in the joint crime of fraud (individual) and is the main culprit, he shall be punished according to all the crimes he participated in; for the other defendants, the above judgment shall be made in accordance with the provisions of the Criminal Law based on the facts of the crime, the nature, circumstances of the crime and the degree of harm to society in which he participated.
The other 13 defendants were sentenced to 10 years in prison to 1 year and 5 months in prison, and fined between 160,000 yuan and 16,000 yuan.
