In order to better ensure the prevention and control of the new coronavirus pneumonia epidemic, with the approval of the provincial government, the following notice on labor and social security matters are hereby issued:
1. Provide job stability support for relevant enterprises that have started production continuously during the Spring Festival
All localities provide one-time employment stabilization rewards and subsidies for production enterprises that meet the conditions during the Spring Festival to provide urgently needed materials for the prevention and control of the epidemic, and commercial distribution enterprises that guarantee people's livelihood. The tilt is given to those who work overtime during the statutory holidays. Among them: the upper limit of overtime production during the statutory Spring Festival holiday can be calculated based on the number of on-duty workers and days, and three times the average daily wage of local employees; the upper limit of overtime production on other rest days can be calculated based on the number of on-duty workers and days, and two times the average daily wage of local employees. The local government has determined the subsidy method and can continue to be implemented in accordance with the local method.
The above-mentioned enterprises are determined by the relevant local economic departments, and the specific reward and subsidy policies and funds are determined by the local human resources and social security departments in conjunction with the financial departments. The required funds are paid from local employment subsidy funds and other related funds.
2. For medical staff and related staff who are infected with novel coronavirus pneumonia due to performing their work duties, they should be deemed to be identified and other guarantees for work injuries
In the prevention and control and treatment of novel coronavirus pneumonia, medical staff and related staff who are infected and diagnosed with novel coronavirus pneumonia due to performing their work duties or die of new coronavirus pneumonia due to infection and diagnosed with novel coronavirus pneumonia, they should be deemed to be an industrial injury and enjoy work injury insurance benefits in accordance with the law.
Social insurance administrative departments at all levels should "recognize quickly and handle quickly" when receiving relevant cases of work-related injury recognition, and establish an efficient and convenient green channel. Social insurance agencies should pay work-related injury medical expenses in a timely manner in accordance with the law.
The relevant expenses incurred by the above-mentioned medical and related staff who have participated in the work-related injury insurance shall be paid by the work-related injury insurance fund and the unit in accordance with the relevant provisions of the work-related injury insurance; if the employer has not participated in the work-related injury insurance, the employer shall pay according to the statutory standards. The expenses incurred by the financial subsidy shall be subsidized by the finance at the same level.
3. Temporary work subsidies will be given to medical personnel and epidemic prevention workers who participate in prevention and control work
For people who are directly in contact with cases to be investigated or confirmed cases, diagnosis, treatment, nursing, hospital infection control, case specimen collection and pathogen testing, etc.; Other medical personnel and epidemic prevention workers who participate in epidemic prevention and control will be given temporary work subsidies. subsidy conditions and standards are implemented in accordance with the relevant regulations of the Ministry of Human Resources and Social Security and the Ministry of Finance and the "Notice of the Fujian Provincial Department of Finance and the Fujian Provincial Health Commission on Implementing Funding Guarantee Policies for Prevention and Control of Coronavirus Pneumonia" (MincaiShe [2020] No. 4). The subsidy funds can be distributed to individuals by medical and health institutions participating in epidemic prevention and control, and the provincial finance will settle them accordingly after the epidemic is over.
4. The labor relations and relevant employees' wages in epidemic prevention and control work should be properly handled
For employees of enterprises who are infected with the new coronavirus during their isolation treatment or medical observation period, as well as other emergency measures, the enterprise shall be deemed to provide normal labor and pay corresponding work remuneration, and shall not terminate the labor contract with employees in accordance with Articles 40 and 41 of the Labor Contract Law. During isolation treatment, medical observation, and other emergency measures are not included in the medical period. During this period, if the labor contract expires, it shall be postponed to the end of the medical observation period, the quarantine period, or the end of the emergency measures taken by the government.
For employees who have not returned to Fujian in time due to the epidemic, after reaching consensus with the employees, enterprises may give priority to arranging paid annual leave for employees. The wages of employees during paid annual leave shall be implemented in accordance with relevant regulations.
During the epidemic, an enterprise arranges workers to work on rest days in accordance with the law, but cannot arrange compensatory leave, the worker's wages shall be paid at 200% of the employee's own daily or hourly wage standard stipulated in the labor contract; if an enterprise arranges workers to work on statutory holidays in accordance with the law, the worker's wages shall be paid at 300% of the employee's own daily or hourly wage standard stipulated in the labor contract.
If an enterprise has difficulties in production and operation due to the impact of the epidemic, it can stabilize its jobs by consulting with employees by adjusting salary, rotating jobs, shortening working hours, etc., and try not to lay off employees or lay off fewer employees. If an enterprise suspends work and production within one wage payment cycle, the enterprise shall pay employees' wages according to the standards stipulated in the labor contract. If more than one wage payment cycle is exceeded, if the employee provides normal labor, the wages paid to the employee by the enterprise shall not be lower than the local minimum wage standard. If employees do not provide normal labor, the enterprise shall pay living expenses, and the living expenses standards shall be implemented in accordance with the relevant regulations of our province.
If the parties are unable to apply for labor and personnel dispute arbitration within the statutory period due to the impact of the epidemic, the arbitration limitation period shall be suspended. The arbitration limitation period will continue to be calculated from the date on which the reason for the suspension of the limitation period is eliminated. If the parties or agents affected by the epidemic are unable to attend the trial at the arbitration institution, they may apply to the arbitration institution for postponement of the trial. If a labor and personnel dispute arbitration institution is difficult for arbitration institution to hear a case within the statutory time limit due to the impact of the epidemic, the trial period may be postponed accordingly.
Local human resources and social security departments should strengthen labor guidance and services for enterprises affected by the epidemic, increase labor and social security supervision and law enforcement, and effectively protect the legitimate rights and interests of employees.
5. Do a good job in relevant data statistics
Human Resources and Social Security departments at all levels should establish a ledger for the implementation of the above policies, and register in time with the finance, health and relevant economic departments, and summarize and report in a timely manner in accordance with the requirements of the Provincial Department of Human Resources and Social Security.

Article 3, temporary work subsidy clauses for medical personnel and epidemic prevention workers participating in prevention and control work
This clause is formulated in accordance with the "Notice on Establishing Temporary Work Subsidy for Infectious Disease Epidemic Prevention and Control Personnel" (Ministry of Human Resources and Social Security [2016] No. 4).

Among them: the first-class subsidy standard for (300 yuan per person per day) application scope is: direct contact with cases to be investigated or confirmed cases; diagnosis, treatment, nursing, hospital infection control, case specimen collection and pathogen testing, etc.; harmless treatment of infected animals and cadavers and corrupt animals in the same group, related animals and infectious animals. Other staff members are subject to the first and second-level subsidy standards (200 yuan per person per day).
The third is the method of issuance. The issuance time limit is defined as the response period between the start of emergency response to public health emergencies and the end of response. according to the relevant contents of the Labor Contract Law, the Regulations on Paid Annual Leave of Employees and the Interim Provisions on Wage Payment. It mainly includes four aspects of policies:
Article 12 of the "Interim Provisions on Wage Payment" stipulates that "If an employer arranges workers to work on rest days in accordance with the law, but cannot arrange compensatory leave, the employee's wages shall be paid at 200% of the employee's own daily or hourly wage standard stipulated in the labor contract; if an employer arranges workers to work on statutory holidays in accordance with the law, the employee's wages shall be paid at 300% of the employee's own daily or hourly wage standard stipulated in the labor contract."
According to the "Notice of the General Office of the State Council on Extending the 2020 Spring Festival Holiday", this Spring Festival holiday was extended from January 30 (the sixth day of the first lunar month) to February 2 (the ninth day of the first lunar month). According to the "National New Year Festival and Anniversary Holiday Measures", only the first, second and third day of the first lunar month during the Spring Festival holiday are legal holidays. To this end, during this Spring Festival, if an enterprise arranges workers to work on the first, second and third day of the first lunar month, it shall pay workers' wages at no less than 300% of the workers' own daily or hourly wage standards stipulated in the labor contract. If the labor work is arranged during the remaining Spring Festival holiday and compensatory leave cannot be arranged, the wages of the worker shall be paid at no less than 200% of the worker's own daily or hourly wage standard stipulated in the labor contract.
