China News Service, Beijing, July 4 (Reporter Zhao Jianhua) The Ministry of Finance of China , the Ministry of Commerce, the Ministry of Culture and Tourism, the General Administration of Customs, and the State Administration of Taxation have recently triggered the "Interim Administration of Port Outbound Duty-free Shops" Measures" (hereinafter referred to as the "Measures"), standardizes the management of outbound duty-free shops at ports.

The "Measures" announced on the official website of the Ministry of Finance on the 4th introduced that port exit duty-free shops refer to shops established at airports, ports, stations and land exit ports that are open to the outside world to sell duty-free goods to outbound passengers. Duty-free goods refer to imported goods that are exempt from tariffs and import-link taxes, and domestic goods that are subject to tax refund (exemption) ( value-added tax , consumption tax) and are sold in port-exit duty-free shops. Duty-free goods are sold to passengers who have completed the exit procedures and are about to board a plane, board a ship, take a bus to go abroad, and are on outbound transportation.

The "Measures" stipulate that the state implements franchise operations for port outbound duty-free shops. The state shall make overall arrangements for the layout and construction of outbound duty-free shops at ports. The layout and location of port outbound duty-free shops should be based on the flow of inbound and outbound passengers and combined with regional layout factors to meet the requirements of saving resources, protecting the environment, orderly competition, avoiding waste, and facilitating supervision.

According to the "Measures", the business scope of duty-free goods is strictly limited to the types and varieties approved by the customs. Unless otherwise stipulated by the State Council, for enterprises that have been approved by the State Council to operate duty-free goods and have continuously operated ports or city entry and exit duty-free shops in the past five years, the geographical and category restrictions on operating duty-free shops will be relaxed and the enterprises will be allowed to operate duty-free shops. Equal bidding for the right to operate outbound duty-free shops at ports. Reasonably standardize the rental ratio and commission level of port outbound duty-free shops to avoid the one-sided pursuit of "the highest bidder gets it".

The "Measures" confirm that the business entity of a newly established port outbound duty-free shop or whose operating contract has expired shall not exceed 10 years after bidding or approval. During the operation period, the operating entity shall not change the operating area determined when the port outbound duty-free shop wins the bid without authorization. After the agreement expires, it shall not be automatically renewed, and the operating entity shall be re-determined in accordance with the relevant provisions of the Measures. (End)
