In order to strengthen the management of physician practice, standardize the practice behavior of physicians, improve the quality of physicians, ensure the quality of medical care and medical safety, our department organized the formulation of the "Regulations on the Management of Regular Assessment of Doctors" in accordance with the "Practicing Physicians Law of the People's Republic of China" and relevant provisions. Regular Assessment Management Measures for Physicians
Chapter 1 General Provisions
Article 1 In order to strengthen the practice management of physicians, improve the quality of physicians, and ensure the quality of medical care and medical safety, these Measures are formulated in accordance with the "Practicing Physicians Law of the People's Republic of China" and relevant provisions.
Article 2 The regular physician assessment referred to in these Measures refers to the assessment of the physician's professional level, work performance and professional ethics of a doctor in accordance with the physician's professional standards.
Article 3: Physicians who have obtained physician qualifications in accordance with the law and who have registered in medical, preventive and health care institutions through shall apply to their regular assessments.
Article 4 Regular assessments should adhere to the principles of objective, scientific, fair, just and openness.
Article 5 The regular assessment of doctors is divided into practicing physician assessment and practicing assistant physician assessment . The assessment categories are divided into clinical, traditional Chinese medicine (including traditional Chinese medicine, ethnic medicine, and integration of traditional Chinese and Western medicine), oral and public health .
Doctors regularly assess every two years as a cycle .
Article 6 The Ministry of Health is in charge of the regular assessment and management of physicians across the country.
The health administrative department of local people's governments at or above the county level is in charge of the regular assessment and management of registered doctors.
Chapter 2 Assessment Institutions
Article 7 The health administrative department of local people's governments at or above the county level may entrust medical, prevention, and health care institutions or medical and health industry and academic organizations (hereinafter collectively referred to as assessment institutions) that meet one of the following conditions to undertake regular physician assessment work:
(I) Medical institutions with more than 100 beds;
(II) Preventive and health care institutions with more than 50 physicians;
(I) Medical and health industry and academic organizations with a sound organization.
The health administrative departments of local people's governments at or above the county level shall publish the list of entrusted assessment institutions and submit them to the Ministry of Health for filing step by step.
Article 8 The assessment agency is responsible for the organization, implementation and assessment of regular physician assessments, and reports the assessment work situation and physician assessment results to the health administrative department entrusted to the assessment tasks.
Article 9 The assessment agency shall establish a special assessment committee, be responsible for formulating a physician assessment work system, inspecting and guiding the doctor's regular assessment work, and ensuring that the assessment work is carried out in a standardized manner. The assessment committee shall be composed of medical professional and technical personnel with intermediate or above professional and technical positions and relevant medical and health management personnel.
Article 10 The health administrative department shall supervise the regular assessment work of the physicians of the entrusted assessment institutions, and may conduct random inspections and verifications of the assessment results of the assessment institutions.
Chapter 3 Assessment Methods and Management
Article 11 Regular Physician Assessment includes Business Level Assessment , Work Results and Professional Ethics Assessment .
business level assessment is the responsibility of the assessment agency; work performance and professional ethics assessment is the responsibility of the medical, prevention and health care institutions where the doctor is located, and the assessment agency reviews it.
Article 12 The assessment institution shall notify the doctors who need to undergo regular assessment 60 days before the regular assessment date.
Assessment Institutions may entrust medical, prevention and health care institutions to notify the physicians of the institution.
Article 13 Medical, prevention and health care institutions at all levels and types shall evaluate the work performance and professional ethics of physicians registered in the institution as required, sign assessment opinions on the "Doctor Regular Assessment Form", and apply the assessment opinions to the assessment institutions 30 days before the business level assessment date.
Medical, prevention and health care institutions shall evaluate the work performance and professional ethics of the physicians in this institution with the annual assessment of the physician.
Medical, prevention and health care institutions shall establish and improve the medical ethics assessment system in accordance with regulations as the basis for evaluating professional ethics of physicians in this institution.
Article 14 The assessment agency shall first review the submitted assessment opinions, and then conduct a professional level assessment on the physicians participating in the regular assessment in accordance with the provisions of these Measures, and sign opinions on the "Doctor Regular Assessment Form". Business level assessment can be carried out in one or more of the following forms:
(I) Personal report;
(II) Assessment or examination of relevant laws, regulations, and professional knowledge and technical operation assessment or examination;
(III) Inspection of medical documents written by him;
(IV) Patient evaluation and peer review;
(V) Other forms stipulated by provincial health administrative departments.
Article 15 The assessment opinions and business level assessment results of the assessment institution for the comprehensive medical, prevention and health care institutions shall make assessment conclusions for the physician, sign the opinions on the "Doctor Regular Assessment Form", and submit the physician's assessment results to the health administrative department entrusted to the assessment for filing within 30 days after the regular assessment work, and at the same time, the assessed physician and his institution shall be notified in writing.
Article 16 If a doctor believes that the assessment personnel of the assessment institution have a interests in it and may affect the objective and fairness of the assessment, he or she may apply to the assessment institution for recusation before the assessment. If the reasons are justified, the assessment agency shall agree. If the assessment personnel of the
assessment agency have a interest in the doctors undergoing the assessment, they should take the initiative to avoid it.
Article 17 The health administrative department shall provide the assessment agency with administrative penalties during the assessment cycle of the physician participating in the assessment.
Article 18 During the assessment period, doctors who intend to change their practice location or who have one of the circumstances listed in Article 37 of the Practical Physicians Law but have not been revoked shall conduct an assessment in advance.
doctors who need to undergo an assessment in advance shall report to the assessment institution where their practice registration is.
Chapter 4 Practice Records and Assessment Procedures
Article 19 The state implements the doctor behavior record system . Physician behavior records are divided into good behavior records and bad behavior records.
Good behavior record should include rewards, commendations, completion of government directive tasks, and technical achievements obtained by physicians during their practice; bad behavior record should include administrative penalties and punishments for violating medical and health management regulations and diagnosis and treatment norms, as well as medical accidents.
Physician behavior record is one of the basis for physician assessment.
Article 20 The regular assessment procedures of doctors are divided into general program and simple program . The general procedure is an assessment conducted in accordance with the provisions of Chapter 3 of these Measures. The simple procedure will write a performance report for me, sign opinions from the institution where I am practicing registration, and apply to the assessment institution for review.
Article 21: A brief procedure for regular assessment and implementation of doctors who meet the following conditions:
(I) Have more than 5 years of practice experience and have good behavior records during the assessment cycle;
(II) Have more than 12 years of practice experience and have no bad behavior records during the assessment cycle;
(III) Other circumstances stipulated by the health administrative department at or above the provincial level.
Other doctors are regularly assessed according to general procedures.
Chapter 5 Assessment Results
Article 22 Assessment Results are divided into qualified and unqualified. If any of the work performance, professional ethics and professional level cannot pass the assessment or evaluation, it is unqualified.
Article 23: Doctors who pass standardized training for resident physicians or pass the professional and technical position examination as required during the assessment period can be regarded as passing the professional level assessment, and only work results and professional ethics are assessed during the assessment.
Article 24 If the examined doctor has objections to the assessment results, he or she may submit a review application to the assessment institution within 30 days from the date of receipt of the assessment results. The assessment agency shall review the physician's assessment results within 30 days from the date of receiving the review application and notify the physician himself of the review opinion in writing.
Article 25 The health administrative department shall record the assessment results in the "Professional Record" column of the "Doctor Practice Certificate" and enter the doctor's practice registration information database.
Article 26 For physicians who fail the assessment, the health administrative department may order them to suspend their practice activities for 3 to 6 months and receive training and continue medical education; if the suspension of practice activities expires, the assessment institution will conduct the assessment again. Those who pass the assessment are allowed to continue practicing, but the doctor shall not be evaluated or promoted during this assessment period; those who fail the assessment shall be cancelled by the health administrative department and the doctor's practice certificate shall be revoked.
Article 27 If a doctor has any of the following circumstances during the assessment cycle, the assessment institution shall be deemed to be a failure in the assessment:
(I) If he bears full or primary responsibility in the medical accident that occurs;
(II) If performs professional activities in medical, prevention and health care institutions outside the registered place without the approval of the institution or the health administrative department;
(III) performs professional activities across the practice categories;
(IV) Participate in the physician qualification examination on behalf of others;
(V) Request for the property of patients and their relatives and friends or obtain other improper benefits in medical and health service activities;
(VI) Request or accept kickbacks, commissions or seek other improper benefits from production and sales enterprises, drugs, reagents, etc.;
(VII) By introducing patients to other units for examination, treatment or purchase Rebates or commissions are collected for drugs, medical devices, etc.;
(eight) Issuing false medical certificates and participating in false medical advertising and drug and medical device promotions;
(9) Failure to perform hospital infection control tasks in accordance with regulations, fail to effectively implement disinfection or harmless disposal, causing disease transmission and epidemic;
(10) Deliberately leaking relevant letters related to personal privacy of infectious patients, pathogen carriers, suspected infectious patients, and close contacts
(11) Doctors in disease prevention and control institutions fail to perform their duties of monitoring, reporting, investigation and handling infectious diseases in accordance with the law, causing serious consequences;
(12) During the assessment cycle, more than one medical ethics assessment result is poor in medical ethics;
(13) Do not participate in the assessment without a legitimate reason, or disrupt the assessment order;
(14) Those who violate the relevant provisions of the Practical Physician Law and are subject to administrative penalties.
Chapter 6 Supervision and Management
Article 28 If medical, prevention and health care institutions fail to assess work performance, professional ethics or commit fraud on physicians registered in the institution in accordance with these Measures, and fail to cooperate with the doctors' regular assessment of the doctors, the health administrative department shall order the correction. If the order still fails to correct the correction, the institution, its main responsible persons and relevant responsible persons shall be criticized.
Article 29 If the assessment institution is in any of the following circumstances, the health administrative department shall order it to correct the situation; if the circumstances are serious, the qualification of the assessment institution with more than two assessment cycles shall be cancelled.
(I) Failure to perform the assessment duties or fail to perform the duties in accordance with the regulations;
(II) Fraudulent or favoritism in the assessment work;
(III) It is obviously unfair during the assessment process;
(IV) Assessment personnel request or accept property from the assessed doctor and their institution;
(V) Refusing to accept supervision or random verification by the health administrative department;
(V) Other circumstances stipulated by the health administrative department at or above the provincial level.
Article 30: The staff of the assessment agency violates relevant regulations, engages in fraud, neglects their duties, abuses power, and commits favoritism and fraud, and shall be dealt with in accordance with Article 42 of the Practicing Physicians Law.
Article 31 If a doctor obtains the assessment results by bribery or deception, his assessment results shall be cancelled and determined that the assessment period is unqualified.
Chapter 7 Appendix
Article 32 The assessment of traditional Chinese medicine, ethnic medicine, and traditional Chinese and Western medicine medical institutions shall be organized and implemented by the health or traditional Chinese medicine administrative department that approved the practice of the medical institution to entrust a meeting with the conditions in accordance with these Measures.
Article 33 The business level referred to in these Measures includes the ability of physicians to master laws, regulations, departmental regulations related to medical and health management, and to apply the basic theories, basic knowledge and basic skills of this major to solve practical problems, as well as the ability to learn and master new theories, new knowledge, new technologies and new methods.
The work achievements referred to in these Measures include the quantity, quality and government directive work of the doctor during the practice of practicing, complying with relevant regulations and requirements, and completing work at a certain stage.
The professional ethics mentioned in these Measures include the doctor's insistence on saving lives and helping the wounded in his practice, the patient-centered approach, as well as medical ethics, medical style, doctor-patient relationship, unity and cooperation, and practice in accordance with the law.
Article 34 The assessment of doctors engaged in maternal and infant health care should also include the assessment content stipulated in the "Maternal and Infant Health Care Law of the People's Republic of China" and its implementation measures.
Article 35 The health administrative departments of provinces, autonomous regions and municipalities directly under the Central Government may formulate implementation rules in accordance with these Measures.
Article 36 The Ministry of Health is responsible for interpreting these Measures.
Article 37 This Measures shall come into effect on May 1, 2007.
