A few days ago, the full text of the "Doctor Law (Draft)" was announced and opinions are being solicited. According to the draft, if you want to become a traditional Chinese medicine practitioner in the future, you can obtain qualifications through 4 channels.
After obtaining an academic qualification, apply for a Chinese medicine practitioner
0Draft stipulates that if one of the following conditions is met, you can take the qualification examination for practicing physicians: (1) Have a bachelor's degree or above in a medical major in a higher education in a higher education in a medical institution for one year, and have a clinical internship in a medical institution for one year under the guidance of a practicing physician; (2) After obtaining a medical assistant physician practice certificate, you have a medical degree in a higher education in a medical institution for two years. Article 10 of
stipulates that those who have a medical degree from a higher education institution and have a clinical internship for one year under the guidance of a practicing physician, may take the qualification examination for practicing assistant physicians.
In other words, if you want to become a traditional Chinese medicine doctor, you can apply for the relevant majors of traditional Chinese medicine in higher education institutions (Traditional medicine major, Traditional Chinese Medicine Bone Trauma Major, Acupuncture and Massage Major, and Integrated Traditional Chinese and Western Medicine). After successfully graduation, you can take the relevant medical qualification examination with your academic certificate and other academic qualifications to obtain the qualification to engage in traditional Chinese medicine diagnosis and treatment.
The above provisions for the registration requirements for participating in the qualification examination for practicing physicians are different from the previous provisions in the "Practicing Physician Law". The draft stated the registration requirements for "clinical internship in medical and health institutions for one year or two years". The "Practicing Physician Law" is "working for two years or one year in medical, prevention and health institutions for two years". One is "internship" and the other is "work". As the name suggests, internship means not working yet. The intention is to allow doctors engaged in diagnosis and treatment activities to independently engage in diagnosis and treatment activities after a certain period of time, thereby improving the safety and quality of diagnosis and treatment, including engaging in traditional Chinese medicine diagnosis and treatment activities.
Apply for a Chinese medicine practitioner through the master's expertise
0 Draft Article 11, paragraph 1 stipulates that if you have studied traditional Chinese medicine for three years or have many years of clinical practice, you can pass the assessment and recommend it by the traditional Chinese medicine professional organization or medical and health institution determined by the health and health department of the people's government at or above the county level and above, you can take the qualification examination for practicing physicians or practicing assistant physician qualification examination.
This article is basically the same as the previous provisions of the Practical Physician Law. In other words, to become a traditional Chinese medicine doctor, you can obtain a practicing physician qualification or an practicing assistant physician qualification through education or obtaining a certificate of expertise, etc., and take the relevant certificate to obtain a practicing physician qualification examination or a practicing assistant physician in with relevant certificates.
From a legal perspective, this kind of physician qualification obtained by passing the National Practicing Physician Qualification Examination is universal across the country.
Obtain qualifications in accordance with the relevant provisions of the Traditional Chinese Medicine Law
0 Draft Article 11, paragraph 2 stipulates that those who learn Chinese medicine by learning about traditional Chinese medicine through the form of teacher or have many years of practice and have expertise in medical skills can obtain the relevant medical qualifications in accordance with the provisions of the " of the Traditional Chinese Medicine Law of the People's Republic of China".
This is a method to obtain Chinese medicine physician qualifications determined based on the laws of development of traditional Chinese medicine. This assessment mainly passes the assessment of provincial traditional Chinese medicine authorities. Those who pass the assessment can obtain the qualification of a traditional Chinese medicine physician and obtain the qualification to engage in traditional Chinese medicine diagnosis and treatment services stipulated by law.
This qualification is different from the above-mentioned Chinese medicine category obtained by learning traditional Chinese medicine for three years or having expertise in clinical practice after many years of clinical practice and taking the National Medical Qualification Examination:
First, the scope of practice is different. Those who have passed the national practicing physician qualification examination or who have specialized Chinese medicine can engage in a certain proportion of Western medicine diagnosis and treatment obligations, and the current proportion is about 15%. Those who have qualified through the provincial traditional Chinese medicine management department or who have specialized Chinese medicine can only engage in pure Chinese medicine diagnosis and treatment business in the assessment project and have no right to engage in Western medicine diagnosis and treatment.
The second is that the practice permissions are different.Those who have passed the national practicing physician qualification examination or have specialized specialties in traditional Chinese medicine have their own professional authority, which means they can practice in any medical and health institutions in China; those who have qualified through the provincial traditional Chinese medicine management department or have specialties in traditional Chinese medicine are those with limited academic qualifications and their practice location is only valid in the province.
Enterprise 56 of the draft
Handle 0 provides that there are two obvious differences in the provisions of rural medical and health institutions. The first rural doctor who meets the relevant provisions of this Law may obtain the qualification of a practicing physician or the qualification of a practicing assistant physician in accordance with the law; rural doctors who do not have the qualification of a practicing physician or the qualification of a practicing assistant physician as stipulated in this Law shall formulate management measures separately by the State Council.
This is the main basis for the legislation of the " Rural Doctor Practice Management Regulations ", and the purpose is to standardize the management of practitioners in village-level medical and health institutions. There is no doubt that rural doctors who do not have the above three types of qualifications for traditional Chinese medicine physicians can also pass the relevant qualification assessment or certification of rural doctors to obtain corresponding professional qualifications.
The four types of Chinese medicine activities have slightly different qualifications
From the perspective of carrying out traditional Chinese medicine diagnosis and treatment business, traditional Chinese medicine practitioners who have obtained qualifications through the above four methods have the right to provide patients with traditional Chinese medicine diagnosis and treatment business. However, from the perspective of the scope of employment and social recognition, the four qualifications are slightly different.
Traditional Chinese medicine practitioners who have passed the medical major of higher education are qualified and are not limited, and their practice locations are all nationwide, and they can take relevant professional title examinations or promotions, etc.; Traditional Chinese medicine practitioners who have passed the national practicing physician qualification examination are qualified as those with limited academic qualifications and are not limited, and their practice locations are all nationwide, but they are subject to certain restrictions in terms of professional title examinations or promotions; Traditional Chinese medicine practitioners who have passed the provincial traditional Chinese medicine department are qualified as those with limited academic qualifications and are only valid in the province, and may be restricted in terms of professional title examinations and other aspects; Traditional Chinese medicine practitioners who have passed the rural doctor qualification assessment are qualified as those with limited academic qualifications and their practice locations can only practice medicine within the administrative village of their location, and are subject to many restrictions in terms of professional title examinations and other aspects.
