Selection work methods for the selection of Shandong Provincial Judges and Prosecutors Selection Committee

Chapter 1 General Provisions
Article 1 Article 1 In order to standardize the selection of judges and prosecutors, this Measures are formulated in accordance with the "Opinions on Strengthening the Regularization, Professionalization and Professional Construction of Judges and Prosecutors" (Division No. 44 of the Department [2017]), the "Notice on Strictly Implementing the Selection Standards and Procuratories of Judges and Prosecutors" (Central Political Commissar [2017] No. 9) and the "Constitution of the Shandong Provincial Judges and Prosecutors Selection Committee".
Article 2 This Measures applies to the selection of candidates for judges and prosecutors (hereinafter referred to as candidates) recommended by the provincial court and the provincial procuratorate.
Selecting judges and prosecutors from lawyers, legal experts and other legal professionals, as well as other work that requires selection by the selection committee shall be implemented in accordance with these measures.
Article 3 The Provincial Judges and Prosecutors Selection Committee shall conduct differential selection of candidates in accordance with the provisions of these Measures. By convening a plenary meeting of the selection committee, the members will vote secretly, and candidates will be selected for judges and prosecutors.
Article 4 The selection work hours are generally organized once every year in May and October. According to the requirements of the Provincial Leading Group for Promoting the Reform of Judicial Responsibility System, the number of selections in that year can be increased or decreased. Article 5 of

(I) Uphold and strengthen the leadership of the Party;
(II) Uphold the unity of standards and procedures;
(III) Uphold professionalism and authority;
(IV) Uphold fairness, justice, competition, and selection of the best.
Chapter 2 Application
Article 6 According to the selection time schedule, the Provincial Judge Selection Office and the Provincial Prosecutor Selection Office (hereinafter referred to as the Office) shall submit the following application materials to the Secretariat of the Selection Committee (hereinafter referred to as the Secretariat) in a comprehensive manner of candidate examination, assessment, inspection, etc.:
(I) List of candidates who meet the basic conditions for the appointment of judges and prosecutors in a ratio of 1:1.2. The list is sorted by comprehensive evaluation rankings of examination and assessment.
(II) Relevant materials and review opinions for candidates. Including resume, examination results, performance assessment of case handling (work) in the past three years (if you have worked in the court or procuratorate for less than three years and meet the conditions for candidates for judges and procuratorates, you can provide the annual assessment of the original unit) case handling (work) performance assessment status, etc.;
(III) Review opinions from the Political and Legal Committee of the Party Committee at the same level, together with the organization, discipline inspection and other departments on candidates' political literacy, integrity and self-discipline, professional ethics, etc.
(IV) Other materials required by the selection committee. Article 7 of
Application materials are submitted in both written and electronic versions. The written materials and electronic materials related contents should be consistent:
(I) Written materials are compiled and bound as required, and the number of materials is determined according to the actual selection work;
(II) Electronic materials are collected through the judge and prosecutor selection system, and the data compression package is exported as required and submitted in the form of a CD (or USB).
Chapter 3 Review
Article 8 The Secretariat is responsible for reviewing the materials submitted by the office, and introduces electronic materials for candidates that meet the selection requirements into the selection system, and provides them with written materials to the members of the selection committee and other interview judges.
Article 9 If the application materials are found to be in the following circumstances after review, the Secretariat shall make corresponding treatment:
(I) If the content of the materials does not meet the selection requirements, the office shall be informed to make an explanation within the prescribed time limit. If the time limit is not specified or stated that it is not recognized, the relevant candidates will not submit the selection this time.
(II) If the written materials and electronic materials are inconsistent, the relevant candidates will not submit the selection this time. If there is false content in the application materials of
(III), the relevant candidates will be disqualified from the interview selection qualification and will not be submitted for selection within two years (24 months).
Article 10 After review, the Secretariat recommends to the Chairman of the Selection Committee to convene a plenary meeting of the Selection Committee in a timely manner to carry out the selection.
Chapter 4 Interview
Article 11 The interview process (procedure) should be set up in the selection. The selection committee shall formulate interview organization methods and conduct selection interviews for candidates.
Article 12 The judges shall be members of the selection committee, members of the provincial judges and prosecutors’ punishment committee, legal experts and lawyers.
Article 13 According to the number of candidates submitted by the office, the interview can be conducted in groups. The interview judges will be grouped and the group leader will be confirmed.
Article 14 The interview judges independently analyze and judge from a professional perspective based on the interview situation of the candidate and assign scores.

Article 15 After the interview, the interview group will conduct collective evaluation based on the candidate examination and assessment status to form group recommendations and suggestions.
Article 16 The selection committee may invite the responsible persons of the relevant courts and procuratorates to explain the candidate's situation and listen to their opinions and suggestions depending on the circumstances.
Chapter 5 Deliberation
Article 17 The plenary meeting of the selection committee conducts collective deliberation. Based on the candidate examination, assessment, inspection and interview, the members of the selection committee independently judge the candidates for voting and referring to judges and prosecutors.
Article 18 Voting is divided into agree or disagree votes. The number of votes agreed to each selection committee member shall be equal to or less than the number of posts determined in the current selection. If the number of posts exceeds the number of posts, the vote by the committee is invalid.
Article 19 The selection system automatically counts the voting results, announces and generates records of the selection results on the spot.
The number of recommended candidates should be equal to or less than the number of recommended candidates determined in the current selection, and will be generated from high to low according to the number of votes received by the consent votes. Each recommended candidate shall receive a vote of equal to or more than two-thirds of the members of the Selection Committee.

Chapter 6 Public announcement
Article 21 The list of selected judges and prosecutors will be announced on Shandong Chang'an Network and the provincial courts and provincial procuratorial office portal websites. The public announcement period is 5 working days.
Article 22 During the public announcement period, the Secretariat shall verify the relevant situation and report to the Chairman of the Selection Committee for research and handling.
The selection office shall be responsible for verifying the relevant situation when opposing the candidates for judges and prosecutors, and submitting the handling suggestions within 10 working days and submitting them to the Director of the Selection Committee for review.
Chapter 7 Report and Feedback
Article 23 After the public announcement period expires, the selection committee submits a report on the selection work and a list of candidates recommended by judges and prosecutors to the Provincial Party Committee Political and Legal Affairs Committee.
Article 24 After the Provincial Party Committee Political and Legal Affairs Committee reviews and agrees, the selection committee will provide feedback to the provincial court and the provincial procuratorate within 5 working days.
Chapter 8 Appendix
Article 25 The selection committee is responsible for interpreting this regulation.
Article 26 This Measures have been submitted to the Shandong Provincial Leading Group for Promotion of Judicial Responsibility System Reform for review and will be implemented from the date of publication.
Selection Interview Organizing Measures for the Selection of Shandong Provincial Judges and Prosecutors Selection Committee (Trial)

Chapter 1 General Prospects
Article 1 This Measures are formulated according to the "Selection Work Measures for the Selection of Shandong Provincial Judges and Prosecutors Selection Committee".
Article 2 This Measures applies to the selection interview organized by the Shandong Provincial Judges and Prosecutors Selection Committee.
Article 3 The interview candidates include:
(I) candidates for the first-time judge and prosecutors submitted by the Provincial Court’s Judge Selection Office and the Provincial Procuratorate’s Procuratorate’s Office (hereinafter referred to as the Office);
(II) candidates among lawyers, legal experts and other legal professionals nominated by the Provincial Court and the Provincial Procuratorate to participate in the public selection of judges and prosecutors;
(III) other candidates who need to be interviewed by the Selection Committee.
Directors of courts at all levels and procuratorates of procuratorates participate in the selection and will not conduct interviews.
Article 4 The interview work adheres to the law and regulations, is fair and just and is close to the actual situation of trial and procuratorial work.
Article 5 The Secretariat of the Selection Committee (hereinafter referred to as the Secretariat) is responsible for coordinating relevant parties to ensure that the selection interview is carried out on time and smoothly. The office handles relevant affairs under the organization of the Secretariat.
Chapter 2 Test Questions Schedule and Use
Article 6 The Selection Committee leads the design, review, management and use of test questions.
Article 7 The test questions are divided into short answers (description) and case analysis questions.
Article 8 By answering the test questions, the candidate's judicial business ability, logical thinking ability, language expression ability, etc. are tested.
Article 9 In accordance with the principle of "having both unified requirements and different treatments, each with its focus", the office organized the drafting of test questions. The office can organize the system's business experts (experts) to prepare the test questions, or entrust a third-party to prepare the test questions. Article 10 Before the interview, the Secretariat is responsible for printing the interview question paper.

Article 11 The Secretariat is responsible for organizing random selection of questions used on-site from the interview question paper group.

Article 12 The interview question paper is packaged and distributed according to unified specifications.
Chapter 3 Examination room establishment and management
Article 13 The Secretariat, together with the office, is responsible for selecting the interview location and arranging the interview room.
Article 14 The interview examination room generally has an interview room, a waiting room, a lounge, an interview guarantee office, etc. All regions shall implement closed management.
Article 15 During the interview, no one shall use electronic, communication, computing, storage and other equipment in all areas of the interview examination room without the consent of the Secretariat.
After the interview candidate enters the examination room, the relevant personal electronic equipment shall be kept by the designated staff and returned when leaving the examination room.
Article 16 The interview room must be equipped with video recording equipment to record the interview process throughout the whole process.
Chapter 4 Judges and Groups
Article 17 Interview judges are generally members of the selection committee, or members of the Punishment Committee or relevant legal experts and lawyers may be invited to serve as members of the Punishment Committee.
Article 18 During an interview, the selection committee generally forms several interview groups. Each interview group is composed of no less than 5 odd judges. When other personnel are serving as judges, the members of the selection committee should maintain a majority in each group. The composition of the
interview group was determined by the Secretariat on the day of the interview. Each group has one group leader, and the group leader draws lots from the judges of the selection committees of each group.

Article 19 According to the needs of the interview work, relevant staff are equipped with scoring, timing, supervision and verification, guidance, technical support, security support and other relevant staff, and the Secretariat coordinates with relevant units to select.
Article 20 Staff participating in the interview shall receive necessary training and be familiar with the interview work requirements and procedures.
Chapter 6 Candidate Grouping and Management
Article 21 Before each interview, the Secretariat draws lots of interview candidates to determine the interview room arrangement and interview sequence number.

Article 22 Candidates shall abide by the relevant interview regulations, respect the judges, and obey the management of staff. Those who violate the regulations, disrespect the judges, and disobey management will be disqualified from the interview.
Chapter 7 Application of procedures and results
Article 23 An announcement shall be issued for an interview. The form and related content of the announcement shall be determined by the Secretariat's Office of the Business Selection and shall be released by the Office.
Article 24 Before the interview, the Secretariat will introduce the reviewed candidate application materials into the judge and prosecutor selection system, and notify the office of the list of candidates entering the interview and the interview schedule.
Article 25 The director’s meeting of the selection committee determines the interview time limit for each candidate based on the number of interview candidates. The interview time limit for each candidate is not less than 15 minutes.
Article 26 The interview is hosted by the group leader, and the judges make their own judgment based on the key points of the test questions and the candidate's performance, and give them scores.

Article 29 The interview group shall comprehensively judge the candidate's professional qualities based on the candidate's examination, assessment and interview situation, study and discuss and form recommendation opinions, and submit them to the plenary meeting of the selection committee for deliberation.
Article 30: The candidates proposed by the plenary meeting of the selection committee shall be voted independently by each selection committee.

Chapter 8 Security and Confidentiality
Article 31 The Secretariat is responsible for formulating work rules and interview work disciplines for question setting personnel, judges, interviewers and staff. Those who violate the code and work discipline shall be disqualified from the corresponding qualifications and informed of their unit.
Article 32 The materials formed during the interview organization (including electronic data and audio-visual materials, etc.) shall be archived and kept by the Secretariat, and the retention period shall be implemented in accordance with the national archive management regulations.
Article 33: The administrative guarantees, security guarantees, etc. for interview selection shall be responsible by the relevant units (departments).
Chapter 9 Discipline and Supervision
Article 34 If the members of the selection committee and other interview judges have the circumstances of avoidance stipulated in Article 20 of the "Shandong Provincial Judges and Prosecutors Selection Committee" stipulated in Article 20 of the "Regulations on the Constitution of the Shandong Provincial Judges and Prosecutors Selection Committee", they shall be avoided.
Article 35: Establish an interview supervisor who is a judge or a prosecutor to supervise the grouping, lottery draw, group interview and other links.

Article 36 The selection committee is responsible for interpreting this Measures.
Article 37 This Measures were submitted to the Shandong Provincial Leading Group for Promotion of Judicial Responsibility System Reform for review and will be trialed from the date of publication.
