There were 16 suspects in the case of counterfeiting registered trademarks, 2 production lines, 2 warehouse storage dens, and 2 sales dens were destroyed, and more than 300 boxes of counterfeit MLB baseball caps and finished clothing products were seized, with a total amount of more than 20 million yuan involved.
It is reported that in May 2021, police from the Forest (Food, Drug, and Environmental Investigation) Branch of the Zhuhai Municipal Public Security Bureau discovered during work that a live broadcast room on Douyin was selling counterfeit MLB brand baseball caps and finished clothing products, and was suspected of selling counterfeit registered trademark products. After learning of this situation, the Bureau immediately investigated the case of selling counterfeit registered trademark goods and found that Lin Moumou (male, 37 years old, Fujian native, already in criminal detention) and others registered Xiamen Moumou Technology Co., Ltd. and other companies, and organized Personnel mass-produce counterfeit MLB trademark apparel in China, and then sell large quantities of counterfeit MLB apparel with the registered trademark online and offline, making illegal profits from it. The middleman Zhang Moumou (male, 50 years old, from Fujian, already in prison) wholesaled counterfeit MLB trademark clothing from Lin Moumou's company and sold it to Gao Moumou, earning a profit from the price difference. Gao registered XX Zhuhai Culture Media Co., Ltd., and then sold counterfeit MLB trademark series clothing to external parties through live broadcast on the Douyin platform to earn illegal profits. After investigation, the bureau gradually found out the main members, organizational structure, counterfeiting dens and activity patterns of the gang, and achieved a full-chain crackdown on the case.
According to the provisions of Article 213 of the "Criminal Law", [the crime of counterfeiting registered trademarks] shall be punished with a fixed-term imprisonment of not more than three years and a fine, or a fine alone. If the circumstances are particularly serious, the person shall be sentenced to a fixed-term imprisonment of not less than three years but not more than ten years and a fine. According to the provisions of Article 214 of the Criminal Law, [the crime of selling goods with counterfeit registered trademarks] shall be punished with a fixed-term imprisonment of not more than three years and a fine or a fine alone. If the circumstances are particularly serious, the sentence shall be not less than three years but not less than ten years. The following shall be punishable by fixed-term imprisonment and a fine.
