In order to help Internet companies build a solid digital security barrier, the Xuhui District Procuratorate recently took the lead in holding the "Promoting Data Governance and Escorting Enterprise Development" activity, and released the "White Paper on Procuratorial and Governance of Enterprises" and jointly released the "Data Security" Procuratorial Governance of Enterprises" with the Xuhui Public Security Bureau, the Xuhui District Federation of Industry and Commerce, and the Shanghai Information Network Security Management Association and other units.
It is understood that from 2017 to 2021, the Xuhui District Procuratorate cracked down on computer cyber crimes, approved the arrest of 968 people, filed 544 public prosecutions infringement of economic crimes of corporate legitimate rights and interests, approved the arrest of 230 people, filed 166 public prosecutions in 281 people, and recovered various economic losses of more than 170 million yuan.
" White Paper " shows that in recent years, Internet companies have faced a variety of threats and risks in the field of data security. On the one hand, Internet companies are frequently subject to various external data attacks and network infringement, while others use various service platforms provided by Internet companies to commit crimes; on the other hand, internal employees of enterprises use their positions to infringe on corporate data security often occur.
To this end, the Xuhui District Procuratorate has established a working pattern of "first fight, prevention, and governance as the basis". On the one hand, it has formed a core professional case handling team of cyber crime , implemented an early intervention work mechanism for data crimes involving enterprises, strengthened the review of criminal clues involved in cases through big data, carried out targeted case filing supervision of relevant criminal case clues, and focused on carrying out case filing supervision of crimes involving enterprises and platforms; on the other hand, it has actively smoothed the mechanism for the transfer of cyber attack clues, and for the frequent external attacks and extortion of online game enterprises, it has established a green channel for case clue transfer in conjunction with the network security department, the Anti-Net Black and Gray Industry Alliance, and signed the "Implementation Measures for the Recovery of Stolen and Loss in Economic and Financial Crime Cases" with the public security department, and tried its best to ensure the normal operation of enterprises in economic and cybercrimes and recover the losses suffered by enterprises due to crimes.
At the same time, the Xuhui District Procuratorate also issued a number of standardized guidelines such as "Legal Guidelines for Compliance of Personal Information Protection Enterprises" and "Guidelines for Protection of Trade Secrets" to actively promote the implementation of enterprise data compliance. In conjunction with Xuhui Public Security Bureau, Xuhui District Federation of Industry and Commerce, Shanghai Information Network Security Management Association and other units, the "Guidelines for Data Standardization of Online Game Enterprises".
It is reported that the "Guidelines" include three aspects: data security internal control mechanism, data processing specification mechanism, and criminal risk warning. It is suitable for standardizing the data processing activities involved in the entire life cycle such as the research and development, distribution, and operation of products and services engaged in by online game companies. It aims to provide reference and reference for online game companies to standardize data processing activities.
