Illegal Facts and Evidence: From April to September 2021, the unit divided the Xianfeng County Beautiful Rural Characteristic Cultural and Tourism Complex project into road construction, wooden house foundation construction, plank roads, water supply and drainage, power supply, special transformation projects and wooden house floor heating and other sub-items to avoid bidding. The above facts are proved by Hubei Province's fixed asset investment project filing certificate, competitive negotiation announcement, bidding notice, contract, project agreement and other relevant evidence.
2 The above facts violate Article 3 of the " Bidding Law of the People's Republic of China" "In , the following engineering construction projects include the survey, design, construction, supervision of projects and the procurement of important equipment and materials related to engineering construction, bidding must be carried out:...... (II) Projects invested in or financing by state-owned funds in ,..." and Article 4 "No unit or individual shall make a project that must be bidded according to law or evade bidding in any other way." According to Article 49 of the "Bidding Law of the People's Republic of China", "If a project that must be bidded in violation of the provisions of this Law and does not bid, the project that must be bidded in any way or evade bidding in any other way shall be ordered to correct the problem within a time limit and may be fined not less than 5% and not more than 10% of the project contract amount;...", it is decided to impose an administrative penalty of 966,666 yuan for the project contract amount of 16,111,100 yuan.
