Recently, in Xiangtan City, Hunan Province, 70-year-old Li drove a two-wheeled electric bicycle on his wife Shen (67 years old) along Jianshe North Road in Yuhu District from Wenxingmen Road to the North Second Ring Road. When he turned left and ran a red light and was speeding, he collided with a motor vehicle driven by Fang, causing damage to both vehicles. Li and Shen fell to the ground and were injured.
Zhang Zhi, the captain of the second squadron of the Yuhu Traffic Police Brigade who was on duty nearby, received the call and quickly led the police to drive to the scene. After arriving at the scene, the electric car was hit by a small car. The driver of the electric car had suspected fractures on his leg, the passengers were unconscious and bleeding from his mouth and nose.
Zhang Zhi contacted the police and ambulance personnel to handle the accident, and organized police forces to maintain the order on the scene to avoid secondary accidents caused by onlookers.
When the accident occurred, the driver Li was not in danger of his life because he wore a safety helmet. Unfortunately, his wife Shen did not wear a safety helmet and her head was not effectively protected. She later died after failed rescue efforts by the hospital.
·Responsibility determination and related regulations
Li was driving a non-motor vehicle on the road at speed, failing to pass according to traffic lights and carrying people in violation of the non-motor vehicle manned regulations, which was the main cause of the accident. Fang drove a motor vehicle on the road, lack of dynamic observation of vehicles on the road, and failed to ensure safe driving, which was the secondary cause of the accident.
Li's behavior violated Article 38 of the " Road Traffic Safety Law of the People's Republic of China": "Vehicles and pedestrians should pass according to traffic signals. When there is an on-site command of traffic police, they should pass according to the command of the traffic police. On roads without traffic signals, they should pass under the principle of ensuring safety and smoothness." Article 33, item 7 of the " Hunan Province Implementation Measures ": "Driving non-motor vehicles shall comply with the following provisions: (7) The maximum speed shall not exceed 15 kilometers per hour;" and Article 33, item 8 of the "Hunan Province Implementation Measures": "Driving non-motor vehicles shall comply with the following provisions: (8) Bicycles and electric bicycles can be used for a minor under the age of 12, and using a safety seat when riding a minor under the age of six;"
Fang's behavior violated Article 22, paragraph 1 of the Road Traffic Safety Law of the People's Republic of China: "Motor vehicle drivers shall abide by the provisions of road traffic safety laws and regulations, and drive safely and civilly in accordance with operating standards."
According to Article 91 of the " Regulations on the Implementation of the Road Traffic Safety Law of the People's Republic of China", in this road traffic accident, Li assumed the main responsibility and Fang assumed the secondary responsibility.
