Chapter 1 General
Article 1 In order to fully implement the rural revitalization strategy, promote the comprehensive upgrading of agriculture, the comprehensive progress of rural areas, and the comprehensive development of farmers, accelerate the modernization of agriculture and rural areas, and comprehensively build a modern socialist country, this Law is formulated. Article 2: Comprehensively implement the rural revitalization strategy, carry out activities such as promoting rural industrial revitalization, talent revitalization, cultural revitalization, ecological revitalization, organizational revitalization, and promoting urban-rural integrated development, etc., and this Law shall apply.
The village referred to in this law refers to a regional complex with natural, social, economic characteristics and multiple functions such as production, life, ecology, and culture outside the built-up area of the city, including townships and villages. Article 3: Promoting rural revitalization should coordinate the promotion of rural economic construction, political construction, cultural construction, social construction, ecological civilization construction and party building in accordance with the general requirements of prosperous industries, livable ecology, civilized rural customs, effective governance, and prosperous life, and give full play to the unique functions of rural areas in ensuring the supply of agricultural products and food security, protecting the ecological environment, and inheriting and developing the excellent traditional culture of the Chinese nation.
Article 4: To fully implement the rural revitalization strategy, we should adhere to the leadership of the Communist Party of China, implement the innovative, coordinated, green, open and shared new development concepts of , follow the path of rural revitalization with Chinese characteristics, promote common prosperity, and follow the following principles:
(I) Adhere to the priority development of agriculture and rural areas, give priority to the allocation of cadres, give priority to meet the allocation of factors, give priority to the guarantee of capital investment, and give priority to public services;

Article 5 The state consolidates and improves the two-layer management system based on family contract management and combines unified and decentralized , and develops and strengthens the rural collective ownership economy.
Article 6 The state establishes and improves the system, mechanism and policy system for urban-rural integrated development, promotes the orderly flow, equal exchange of urban and rural factors, and balanced allocation of public resources, adheres to the use of industry to supplement agriculture and lead the countryside with cities, and promotes the formation of a new type of industrial, agricultural, urban and rural relations that promotes mutual promotion, urban and rural complementarity, coordinated development, and common prosperity.
Article 7 The state adheres to the guidance of the core socialist values, vigorously promotes the national spirit and the spirit of the times, strengthens the protection of excellent traditional rural culture and the construction of a public cultural service system, and prospers and develops rural culture.

Article 10 The agricultural and rural authorities of the State Council are responsible for the overall coordination, macro-guidance and supervision and inspection of the promotion of rural revitalization in the country; other relevant departments of the State Council are responsible for the relevant rural revitalization promotion work within their respective responsibilities.

Chapter 2 Industrial Development

People's governments at all levels should adhere to the principle of taking farmers as the main body and relying on rural advantages and characteristics resources to support and promote the integrated development of the first, second and third industries in rural areas, promote the establishment of the modern agricultural industrial system, , production system and operation system, promote the construction of digital villages, cultivate new industries, new business forms, new models and new agricultural operators, and promote the organic connection between small farmers and modern agricultural development.
Article 13 The state takes measures to optimize the layout of agricultural productivity, promote agricultural structural adjustment, develop advantageous and characteristic industries, ensure the effective supply and quality safety of grain and important agricultural products, promote variety cultivation, quality improvement, brand building and standardized production, promote agricultural opening up to the outside world, and improve agricultural quality, efficiency and competitiveness.

Developing rural industries should comply with the requirements of land space planning, industrial policies, and environmental protection.
Article 20 People's governments at all levels shall improve support policies, strengthen guidance and services, support farmers and people returning to their hometowns to start businesses and innovate in rural areas, and promote rural industrial development and farmers' employment.
Article 21 People's governments at all levels shall establish and improve mechanisms that are conducive to the stable growth of farmers' income, encourage and support farmers to broaden channels for increasing income, and promote farmers to increase their income.
The state has taken measures to support the development of rural collective economic organizations, provide production and living services to the members of the collective and protect members' right to obtain income distribution from collective business income.
The state supports farmers' professional cooperatives, family farms, agricultural enterprises, e-commerce enterprises, agricultural professional social service organizations, etc. to establish close interest linkage mechanisms with farmers in various ways, so that farmers can share the value-added benefits of the entire industrial chain.

People's governments at all levels shall take measures to cultivate agricultural science and technology talents, business management talents, legal service talents, and social work talents, strengthen the construction of rural cultural talent teams, and cultivate rural cultural backbone forces.
Article 26 People's governments at all levels shall take measures to strengthen vocational education and continuing education, organize and carry out agricultural skills training, return home to start a business and employment training, and cultivate high-quality farmers, practical rural talents, and leaders in innovation and entrepreneurship who are cultured, wise, good at management, and are good at managing.
Article 27 People's governments at or above the county level and their education administrative departments shall guide and support colleges and vocational schools to set up agricultural-related majors, increase the efforts to cultivate rural professional talents, and encourage graduates of colleges and vocational schools to find employment and start businesses in rural areas.
Article 28 The state encourages urban talents to move to rural areas and establishes and improves a cooperation and exchange mechanism for talent training between urban and rural areas, regions, and schools and regions.
People's governments at or above the county level shall establish an incentive mechanism to encourage all kinds of talents to participate in rural construction, build a volunteer service platform for social work and rural construction, and support and guide all kinds of talents to serve rural revitalization through various means.

Chapter 4 Cultural prosperity
Article 29 People's governments at all levels shall organize and carry out civilized practice activities in the new era, strengthen the construction of spiritual civilization in rural areas, and continuously improve the level of rural social civilization.
Article 30 People's governments at all levels shall take measures to enrich the cultural and sports life of farmers, advocate a scientific and healthy production and lifestyle, give full play to the positive role of village rules and regulations, popularize scientific knowledge, promote the transformation of customs and customs, break the old customs and habits such as large-scale conduct and extravagance and waste, advocate filial piety and love for the elderly, thrift, honesty and trustworthy, promote equality between men and women, create civilized villages and towns, and civilized families, cultivate civilized rural customs, good family style, simple folk customs, and build civilized villages.

People's governments at all levels shall support the literary and artistic creation of agricultural and rural farmers' themes, and encourage the production of excellent literary and artistic works that reflect farmers' production and life and rural revitalization practices.
Article 32 People's governments at all levels shall take measures to protect agricultural cultural heritage and intangible cultural heritage, explore the profound connotation of excellent agricultural culture, promote red culture, and inherit and develop excellent traditional culture.
Local people's governments at or above the county level shall strengthen the protection of historical and cultural towns and villages, traditional villages and rural styles, and villages with ethnic minority characteristics, carry out protection monitoring and evaluation, and take measures to prevent and reduce fires, floods, earthquakes and other disasters.
Article 33 Local people's governments at or above the county level shall adhere to planning guidance and typical demonstration, build agricultural cultural display areas with distinctive characteristics and outstanding advantages in a planned manner, develop rural cultural and sports industries, promote the revitalization of traditional craftsmanship in rural areas, actively promote the construction of smart radio and television rural areas, and activate and prosper the rural cultural market.
Chapter 5 Ecological protection
Article 34 The state improves the protection system and ecological protection compensation mechanism for important ecosystems, implements protection and restoration projects for important ecosystems, strengthens rural ecological protection and environmental governance, greens and beautifies the rural environment, and builds beautiful villages.
Article 35 The state encourages and supports agricultural producers to adopt advanced planting and breeding technologies such as water conservation, fertilizer conservation, medicine conservation, and energy conservation, promote the integration of planting and breeding, comprehensive development of agricultural resources, and give priority to the development of ecological circular agriculture.
People's governments at all levels shall take measures to strengthen the prevention and control of agricultural non-point source pollution, promote the reduction of agricultural inputs, clean production, waste resource utilization, and ecologicalization of industrial models, and guide the whole society to form a moderately economical, green, low-carbon, civilized and healthy production, life and consumption methods. Article 36 People's governments at all levels shall implement comprehensive land remediation and ecological restoration, strengthen the protection and restoration of forests, grasslands, wetlands, etc., carry out comprehensive control of desertification, stone desertification, and soil erosion, and improve the rural ecological environment.

Article 38 The state establishes and improves the quality and safety management system of rural housing construction and related technical standards system, and establishes a safe housing security mechanism for rural low-income groups. When building rural housing, disaster-prone areas should be avoided and meet basic safety requirements such as earthquake resistance and flood control.
Local people's governments at or above the county level should strengthen rural housing construction management and services, strengthen planning and control of newly built rural housing, and strictly prohibit illegal occupation of arable land to build houses; encourage rural housing design to reflect regional, ethnic and local characteristics, encourage rural housing construction to adopt new construction technologies and green building materials, and guide farmers to build livable housing with modern functions, safe structure, cost-economic, green and environmentally friendly, and coordinated with the rural environment.
Article 39 The state strictly manages agricultural inputs and adopts ban and restrictive measures for highly toxic, highly toxic and high residue pesticides and veterinary drugs. Agricultural product producers and operators shall not use pesticides, veterinary drugs or other toxic and harmful substances prohibited by the state, and shall not use pesticides, veterinary drugs, fertilizers, feed additives and other agricultural inputs that exceed the dosage and scope in violation of agricultural product quality and safety standards and relevant national regulations.

Local people's governments at all levels and their relevant departments shall take measures to promote the recycling and treatment of packaging waste for agricultural inputs such as waste agricultural films and pesticides, promote the resource utilization of crop straw and livestock and poultry manure, and strictly control the breeding of bait cages in rivers, lakes and reservoirs and nearshore waters.
Chapter 6 Organization and construction
Article 41 Establish and improve a modern rural social governance system with party committee leadership, government responsibility, democratic consultation, social coordination, public participation, legal guarantee, and science and technology support, and a rural social governance system that combines autonomy, rule of law and moral governance, and build a vibrant, harmonious and orderly good governance village.
Local people's governments at all levels should strengthen the construction of social management and service capabilities of township people's governments, and build townships into rural governance centers, rural service centers, and rural economic centers.
Article 42 The grassroots organizations of the Communist Party of China will play a comprehensive leadership role in accordance with Constitution of the Communist Party of China and relevant regulations. Villagers' committees, rural collective economic organizations, etc. should implement villagers' autonomy, develop collective ownership economy, safeguard the legitimate rights and interests of farmers, and should accept supervision from villagers.
Article 43 The state establishes and improves the training, equipment, use and management mechanism for the cadre team of agricultural and rural work, selects outstanding cadres to enrich the cadre team of agricultural and rural work, takes measures to improve the ability and level of the cadre team of agricultural and rural work, implements relevant benefits guarantees for rural grassroots cadres, and builds a cadre team of agricultural and rural work that understands agriculture, loves rural areas, and loves farmers.
Article 44 Local people's governments at all levels shall build a simple and efficient grassroots management system, scientifically set up township institutions, strengthen rural cadre training, improve rural grassroots service system, and consolidate the foundation of rural governance. Article 46 People's governments at all levels shall guide and support rural collective economic organizations to play their role in managing collective assets in accordance with the law, rationally developing collective resources, and serving collective members, and ensure the independent operation of rural collective economic organizations.
Local people's governments at or above the county level shall support the development of farmers' professional cooperatives, family farms, agricultural enterprises and other various business entities, and improve the social service system of agriculture and rural areas.
Article 47 Local people's governments at or above the county level shall take measures to strengthen the construction of grassroots mass organizations, support, regulate and guide the development of rural social organizations, and give full play to the role of grassroots mass organizations and rural social organizations in uniting, connecting with, and serving the masses.
Article 48 Local people's governments at all levels shall strengthen the construction of grassroots law enforcement teams, encourage township people's governments to set up legal counsel and public lawyers as needed, encourage localities with conditions to establish public legal service studios in villagers' committees, carry out in-depth legal publicity and education and people's mediation and work, improve the mechanism for mediating and resolving rural conflicts and disputes, and promote the construction of a rule of law village.
Article 49 Local people's governments at all levels shall improve the rural social security prevention and control system, strengthen rural policing work, and promote the construction of safe villages; improve the rural public safety system, and strengthen the safety management responsibilities of rural public health, production safety, disaster prevention, mitigation and relief, emergency rescue, emergency broadcast, food, medicine, transportation, fire protection, etc.
Chapter 7 Urban-Rural Integration
Article 50 People's governments at all levels shall jointly promote the implementation of the rural revitalization strategy and the new urbanization strategy of , plan the development of towns and rural areas as a whole, scientifically and orderly arrange the functional spaces of ecology, agriculture, urban and other areas, optimize the layout of urban and rural industrial development, infrastructure, public service facilities, etc., and gradually improve the basic public service system of covering the whole people, sharing in universally, and integrating urban and rural areas, accelerate the integrated development of urban and rural areas, and promote high-quality and efficient agriculture, livable and business-friendly rural areas, and rich and prosperous farmers.
Article 51 County-level people's governments and township people's governments shall optimize the rural development layout within their administrative regions, and arrange village layout according to local conditions in accordance with the principles of respecting the wishes of farmers, facilitating production and life of the people, and maintaining rural functions and characteristics, arrange village layout according to local conditions, prepare village plans in accordance with the law, promote village construction in a classified and orderly manner, strictly regulate village merging, and strictly prohibit village merging and mergers against farmers and statutory procedures.

Article 53 The state develops rural social undertakings, promotes the tilt of public education, medical and health care, social security and other resources to rural areas, improves the level of basic public services in rural areas, and promotes the equalization of basic public services in urban and rural areas.
The country improves the rural convenience service system, improves the digitalization and intelligence level of rural public services, supports the improvement of village-level comprehensive service facilities and comprehensive information platforms, cultivates service institutions and service-related social organizations, improves the service operation mechanism, promotes the effective connection between public services and self-service, and enhances the production and life service functions.
Article 54 The state improves the social security system that coordinates urban and rural areas, establishes and improves the security mechanism, and supports rural areas to improve the level of social security management services; establishes and improves the mechanism for determining the basic pension insurance benefits of urban and rural residents and the normal adjustment of basic pension standards to ensure that the basic pension insurance benefits of urban and rural residents gradually increase with economic and social development.
The state supports farmers to participate in urban and rural residents' basic pension insurance and basic medical insurance in accordance with regulations, and encourages qualified flexible employment personnel and agricultural industrialization practitioners to participate in basic pension insurance and , employee basic medical insurance and other social insurances.
The country promotes the coordinated development of the urban and rural minimum living security system, improves the level of social assistance such as the support of rural people with special poverty, strengthens caring services for left-behind children, women and the elderly, as well as disabled and children in need, and supports the development of rural universal elderly care services and mutual aid elderly care services.
Article 55 The state promotes the formation of a human resource market with equal competition, standardized and orderly, and unified urban and rural areas, and improves the public employment and entrepreneurship service system that is equal in urban and rural areas.
local people's governments at or above the county level shall take measures to promote farmers who have stable employment and living in cities to settle voluntarily and orderly. They shall not withdraw from land contract management rights, homestead use rights, and collective income distribution rights as conditions for farmers to settle in cities; promote farmers who obtain residence permits and their families who relocate to enjoy basic public services in towns.
The state encourages social capital to develop in rural areas and connects farmers' interests to projects, encourages urban residents to travel, leisure and vacation, health and elderly care, etc., but it shall not destroy the rural ecological environment and shall not damage the legitimate rights and interests of rural collective economic organizations and their members.
Article 56 People's governments at or above the county level shall take measures to promote the coordinated development of urban and rural industries, improve the incentive mechanism for connecting farmers and leading farmers on the basis of ensuring the dominant position of farmers, and realize the diversification of rural economy and the development of the entire agricultural industry chain.
Article 57 People's governments at all levels and their relevant departments shall take measures to encourage farmers to work in cities, fully implement equal employment for urban and rural workers, equal pay for equal work, and protect the wage payment of migrant workers and the rights and interests of social security in accordance with the law.
Chapter 8 Support measures
Article 58 The state establishes and improves an agricultural support and protection system and implements the rural revitalization strategy financial investment guarantee system. People's governments at or above the county level should give priority to ensuring financial investment for rural revitalization, ensuring that investment is continuously strengthened, the total amount continues to increase, and are in line with the goals and tasks of rural revitalization.
Provincial, autonomous regions, and municipalities directly under the Central Government may issue government bonds in accordance with the law for the construction of modern agricultural facilities and rural construction.
People's governments at all levels shall improve the long-term mechanism for the coordinated integration of agricultural funds, strengthen the supervision and management of fiscal funds, fully implement budget performance management, and improve the efficiency of fiscal funds use.
Article 59 People's governments at all levels shall take measures to enhance the endogenous development capacity of poverty-stricken areas, establish a long-term mechanism for assistance to low-income and underdeveloped areas, and continue to promote the development of poverty-stricken areas; establish and improve dynamic monitoring and early warning and assistance mechanisms for people prone to falling back into poverty, and achieve effective connection between consolidating and expanding the results of poverty alleviation and rural revitalization.
The country has increased its support for the implementation of the rural revitalization strategy in old revolutionary areas, ethnic areas and border areas.
Article 60 The state builds a new agricultural subsidy policy system oriented towards high-quality green development in accordance with the principles of increasing the total amount, optimizing the stock, and improving efficiency.
Article 61 People's governments at all levels shall adhere to the principle of taking it from agriculture and mainly using it for agriculture, adjust and improve the scope of income use of land use rights transfer in accordance with relevant national regulations, increase the proportion of investment in agriculture and rural areas, and focus on high-standard farmland construction, farmland water conservancy construction, modern seed industry improvement, rural water supply guarantee, rural living environment improvement, rural land comprehensive improvement, arable land and permanent basic farmland protection and protection, village public facilities construction and maintenance, rural education, rural culture and spiritual civilization construction, as well as ecological protection and restoration of mountains, rivers, forests, fields, lakes, grasslands, and sands, and construction of labor-for-relief projects.
Article 62 The relevant special funds and funds established by people's governments at or above the county level shall strengthen support for rural revitalization in accordance with regulations.
The country supports the establishment of rural revitalization funds in a market-oriented manner, focusing on supporting rural industrial development and public infrastructure construction.
Local people's governments at or above the county level should optimize the rural business environment, encourage innovation in investment and financing methods, and guide social capital to invest in rural areas.
Article 63 The state comprehensively applies fiscal, financial and other policies and measures to improve the government-based financing guarantee mechanism, improve the security power of rural asset mortgage in accordance with the law, and improve and strengthen financial support and services for rural revitalization.
The agricultural credit guarantee institutions established by financial investment shall mainly serve business entities engaged in agricultural production and directly related to agricultural production.
Article 64 The state improves the multi-level capital market, promotes equity financing of agricultural enterprises through multiple channels, develops and standardizes the bond market, and promotes agricultural enterprises to use various methods to raise funds; enriches agricultural product futures varieties, and gives full play to the price discovery and risk dispersion functions of futures market.
Article 65 The state establishes and improves a multi-level, wide-coverage and sustainable rural financial service system, improves the assessment and evaluation mechanism for financial support for rural revitalization, promotes the development of rural inclusive finance, and encourages financial institutions to allocate more resources to key areas and weak links in rural development in accordance with the law.
Policy financial institutions should provide credit support and other financial services for rural revitalization within their business scope and increase support for rural revitalization.
Commercial banks should innovate financial products and service models based on their own functional positioning and business advantages, expand the coverage of basic financial services, increase the credit scale for farmers and agricultural operators, and provide financial services for rural revitalization.
Rural Commercial Banks , rural cooperative banks, rural credit cooperatives and other rural small and medium-sized financial institutions should mainly serve local agricultural and rural farmers, and the new loanable funds in that year are mainly used for local agricultural and rural development.
Article 66 The state establishes and improves a multi-level agricultural insurance system, improves the policy-based agricultural insurance system, encourages commercial insurance companies to carry out agricultural insurance business, and supports farmers and agricultural operators to carry out mutual assistance and cooperative insurance in accordance with the law.
People's governments at or above the county level shall take measures such as premium subsidies to support insurance institutions to appropriately increase insurance varieties, expand the coverage of agricultural insurance, and promote the development of agricultural insurance.
Article 67 Local people's governments at or above the county level shall promote the conservation and intensive use of land, improve land use efficiency, and take measures to revitalize the existing construction land in rural areas in accordance with the law, activate rural land resources, improve the guarantee mechanism for new construction land in rural areas, and meet the reasonable needs of rural industries, public service facilities and farmers' residential land.
Local people's governments at or above the county level shall guarantee rural industrial land, construction land indicators shall be tilted towards rural development, and new cultivated land indicators in counties shall be given priority to offset the construction land indicators required for rural industrial development, and explore new flexible and diverse land supply methods.
Collective commercial construction land that has been determined by the land space planning for industrial, commercial and other commercial purposes and registered in accordance with the law. The land owner may hand over it to the unit or individual for use through transfer, leasing, etc. in accordance with the law, and will be given priority to the development of collective ownership economy and rural industries.
Chapter 9 Supervision and Inspection
Article 68 The state implements the target responsibility system and assessment and evaluation system for the implementation of the rural revitalization strategy. The superior people's government shall assess the completion status of the goals of the lower people's governments in implementing the rural revitalization strategy, etc., and the assessment results are an important part of the comprehensive assessment and evaluation of local people's governments and their persons in charge.
Article 69 The State Council and relevant departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government have established indicators and statistical systems that objectively reflect the progress of rural revitalization.Local people's governments at or above the county level shall evaluate the implementation of the rural revitalization strategy within their administrative regions.
Article 70 People's governments at or above the county level shall report to the People's Congress at the same level or their Standing Committee to the People's Congress at the same level to promote rural revitalization. Township people's governments shall report to the people's congress at the same level to promote rural revitalization.
Article 71 Local people's governments at all levels shall report to the people's governments at the next level every year to promote rural revitalization.
People's governments at or above the county level regularly conduct supervision and inspection on the work of promoting rural revitalization at the next level.
Article 72 The development and reform, finance, agriculture and rural areas, audit and other departments of people's governments at or above the county level shall supervise the implementation of the priority guarantee mechanism for agricultural and rural investment, the use of rural revitalization funds and performance in accordance with their respective responsibilities.
Article 73 If people's governments at all levels fail to perform or perform their duties in the promotion of rural revitalization, they shall be held accountable in accordance with laws and regulations and relevant national regulations, and the directly responsible supervisors and other directly responsible persons shall be punished in accordance with the law.
If a violation of laws and regulations on agricultural product quality and safety, ecological environment protection, land management and other laws and regulations, the relevant competent departments shall punish them in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
Chapter 10 Attachment The
Article 74 This Law shall come into force on June 1, 2021.
