UND Issued an announcement today that the US Federal District Court of Northern California approved the settlement agreement between UND and the U.S. Department of Justice today.
In November 2018, the U.S. Department of Justice filed a criminal lawsuit against UMC and several employees on the grounds that UMC and several employees violated the Federal Business Secret Protection Act.
Under the settlement agreement, UMC admitted to infringing on a business secret, agreed to pay a fine of $60 million from the U.S. government, and cooperated with the Department of Justice during a three-year self-managed probation period. This amount has no significant impact on UMC's financial business.
UN Telecom said that in November 2018, the U.S. Department of Justice sued UN Telecom for violating the Federal Business Secret Protection Act. UN Telecom has reached a settlement with the Department of Justice. The content of the settlement agreement was determined by the Northern California Federal District Court today.
In the settlement agreement, the Ministry of Justice agreed to revoke the original allegations against UTC, including conspiracy to carry out economic espionage, conspiracy to steal multiple trade secrets of Micron (hereinafter referred to as Micron ), patent-related allegations, as well as possible damages and fines from 400 million to 8.75 billion US dollars. UMC admitted to infringing on a trade secret, agreed to pay a fine of $60 million from the U.S. government and cooperate with the Department of Justice during a three-year self-managed probation period.
In May 2016, UMC signed a cooperation agreement with Fujian Jinhua Integrated Circuit Co., Ltd. (hereinafter referred to as Jinhua) through the Ministry of Economic Investment Review Conference. According to this agreement, UMC and Jinhua jointly developed two generations of dynamic random c memory (DRAM) process. The DRAM process developed in the agreement is not the latest technology, but the old technology similar to the technology that has been used for mass production in 2012.
UMC publicly recruited engineers for the DRAM cooperation case, and no employees were allowed to bring the former company data to UMC. There have been a number of policies and measures to protect and prevent business secrets with others. However, two former Micron employees of Taiwan who participated in the DRAM cooperation case violated the employment contract and statement signed with UMC, and brought the former company information to UMC and referenced it in their work.
When UMC is aware of the above, it will immediately take necessary measures to confirm that the developed process technology does not contain any unauthorized information. The first generation of DRAM process technology mentioned in the cooperation agreement was transferred to Jinhua in September 2018 according to the agreement. UMC has no intention and no unauthorized information to Jinhua.
However, according to the US Trade Secret Protection Act, even if employees violate the company's policies without the knowledge of the company's senior management, the company still bears legal responsibility for the employee's behavior. Therefore, UMC acknowledges and accepts liability arising from employees' violations of the law in the settlement agreement. Hong Jiacong, chairman of

Several years ago, UMC obtained the government's pre-approval and participated in the DRAM cooperative development case with its own professional knowledge and experience, as well as rich R&D resources.
