The report shows that the current status of intellectual property protection in my country continues to be optimized, and patent infringements have been effectively curbed.

Ge Shu said that the proportion of patent holders who have experienced patent infringement is at a historically low level. "The proportion of patentees in my country who have experienced patent infringement in 2022 is 7.7%, which has been lower than 8% for two consecutive years. This proportion is lower than the proportion of more than 10% during the 'Thirteenth Five-Year Plan' period, and it is significantly lower than the highest proportion of 28.4% during the 'Twelfth Five-Year Plan' period."
Enterprises have become more diversified in their rights protection methods after encountering patent infringement. This year, the proportion of Chinese enterprise patentees who have taken rights protection measures after suffering patent infringement is 72.7%, which has remained above 70% for four consecutive years. The proportion of corporate patent holders who took two or more measures to protect their rights after encountering infringement was 50.2%, an increase of 1.9 percentage points from the previous year.
In addition, the proportion of high-amount compensation for patent infringement is generally on an upward trend, and the concept of "strict protection" of intellectual property rights is deeply rooted in the hearts of the people. This year, the proportion of patent infringement litigation courts in my country that judged compensation, court mediation or out-of-court settlement to exceed 5 million yuan was 7.0%, which has been above 7% for two consecutive years. At the same time, 45.3% of patent holders understand the punitive damages system for patent infringement. The
report also pointed out that Chinese enterprises continue to increase their efforts in overseas intellectual property deployment. In recent years, Chinese applicants have continued to expand overseas patent layout , and it is expected to maintain growth. Among the companies surveyed, 8.3% expected to continue to increase overseas patent applications, while only 2.1% expected to reduce overseas applications. However, among the surveyed companies, the proportion that has used overseas patents is 2.1 times the proportion that has licensed or transferred patents overseas. The situation of Chinese enterprises importing more patents and exporting less is still obvious.
Ge Shu said that in the future, we will further focus on the theme of high-quality development of intellectual property, focus on the effectiveness of intellectual property transfer, transformation and protection, continue to conduct annual patent surveys, and provide data support for intellectual property macro management and scientific decision-making.
