1979 Thailand's Import and Export Law for Import and Export of Goods in 1979, which is the current effective import and export law of goods in Thailand. It will come into effect the day after the publication of the Government Gazette. The 1939 Specific Goods Import and Export Control Law, 1944 Specific Goods Import and Export Control Law (Second Amendment) and the 1947 Specific Goods Import and Export Control Law (Third Amendment) will be abolished. The Thai Goods Import and Export Law promulgated in 2015 only supplements and amends some of the provisions of the law, and the rest remain in effect.
This law authorizes the Minister of Commerce and Finance to be responsible for and manage the implementation of the law, the appointment of competent officials, the issuance of the Ministry’s Regulations and other matters. Among them, with the approval of the Ministerial Council, the Minister of Commerce has the right to make provisions on matters such as prohibited and licensed goods, imported and exported goods, import and export surcharges, and accompanying certificates.
This law requires the establishment of the Foreign Trade Commission (hereinafter referred to as the "FTC") to carry out research, analysis and investigation on international trade, to propose projects, plans or measures to improve international trade to the Minister of Commerce, and to make suggestions or opinions to the Minister on the implementation of this law. The chairman of the FTC is the executive secretary of the Ministry of Commerce, and the director of the Domestic Trade Department, the director of the Commercial Relations Department, the director of the Audit Office, the director of the Commercial Economics Department, etc., and the daily work is under the responsibility of the Foreign Trade Department. The FTC may appoint a Subcommittee to conduct activities or consider matters within the scope of the Commission's authority. In addition, the Ministry of Commerce should establish an international trade promotion fund to cover the funds involved in the promotion of international trade.
According to this law, the Minister of Finance may stipulate the ports and locations of import and export goods. The relevant provisions of Customs Law and the relevant powers granted to customs officials also apply to the import and export provisions of this law. The Law also provides for the specific powers and responsibilities and procedural content of the competent officials in the execution of this Law.
In addition, this law specifically stipulates the punishment for violations of this law. Among them, those who import and export prohibited goods and unlicensed goods shall be imprisoned for no more than ten years, or fined equal to five times the value of export or imported goods, or both, and confiscated goods and means of transportation. The law also specifically stipulates that a certain amount of reward should be given to whistleblowers and officials who commit the arrest. In addition, the law has formulated corresponding penalties for acts that arrears of surcharges, violate relevant notices issued by the Minister of Commerce, and obstructs the competent officials from performing their duties in this Law.
