"In the past five years ( procuratorate) handled more than 710,000 public interest litigation cases, an average of more than 140,000 per year, forming a unique public interest judicial protection ' China Solution ', which has also attracted widespread attention from the international community."
On the morning of October 19, at the third press conference held by the Twenty News Center, a reporter asked about the question of "public interest litigation". Tong Jianming, deputy secretary of the Party Group of the Supreme People's Procuratorate, deputy prosecutor in charge of daily work, and first-level prosecutor, said in response to reporters' questions.
He said that we always insist on serving the overall situation and serving the people's justice. The Supreme People's Procuratorate has successively deployed special public interest litigation prosecution work such as "guaranteeing the safety of thousands of households" and "public interest litigation protects a better life" to promote the resolution of concerns among the people in the fields of ecological environment, food and drug safety, and production safety.
We insist on collaborative performance of duties and jointly protect public welfare. The Supreme People's Procuratorate has clearly put forward the concept of "win-win and win-win, win-win" and takes the purpose of safeguarding public welfare before trial as the best judicial state, and uses consultation and pre-trial prosecutorial recommendations to promote the administrative departments to take the initiative to perform their duties. Over the past five years, 98% of administrative public interest litigation prosecutorial recommendations have been effectively rectified before the lawsuit; if the prosecutorial recommendations cannot be implemented, 35,000 lawsuits were filed, and 99.7% received support from the people's court's judgment, striving to make these cases "rule of law samples."
We conscientiously implement the legislative decisions of the National People's Congress and continuously expand public interest litigation work in new areas. In line with the people's new demand for public welfare protection, the legislation of public interest litigation has been continuously improved over the years: when the Civil Procedure Law and Administrative Litigation Law of 2017 was revised, there were four areas where the procuratorate could file public interest litigation, including ecological environment and resource protection, food and drug safety, state-owned property protection, and state-owned land use rights transfer; since 2018, when the Standing Committee of the National People's Congress revises and formulates relevant laws, it has further added 8 new areas, including the protection of the rights and interests of heroes and martyrs, the protection of minors, the protection of military honors and reputations, production safety, personal information protection, anti-monopoly, anti-telecommunications network fraud, agricultural product quality and safety, etc. Procuratorates at all levels conscientiously implement the responsibilities entrusted by law and strengthen public welfare judicial protection in these new areas. The proportion of cases handled in new areas has reached 20.7%.
The report of the 20th National Congress of the Communist Party of China specifically emphasizes "improving the public interest litigation system." We will resolutely implement the decisions and arrangements of the Party Central Committee, constantly explore in new practices, and better perform the public interest litigation procuratorial functions, and help modernize the national governance system and governance capabilities.
