In a flash, I have been working in Longli County People's Court for nearly thirteen years, and I have been working in Wantanhe People's Court for more than half a year. From March to October in the golden autumn, the rice outside the window has matured and harvested, and I have also gained a lot in the past six months.
In the years since I independently tried cases, I have not tried many family cases, but when I came to court, family cases were the most common. Among all kinds of family conflicts, some fight because of trivial matters, some are like passers-by because of indifference in relationships, and some hate each other because of property entanglement. Among these cases, the children are the ones who have suffered the most.
Just came to court and received a divorce dispute between Li and Luo. This is the second time Li sued her husband Luo for divorce. Before the trial, I presided over the mediation between the parties. As soon as Li sat in the mediation room, he started crying, complaining about how his husband ignored the children at home and how difficult it was for her to work outside the country. She wanted to return to her hometown Guangxi and take one of the children away. Her husband Luo did not argue, but just said that because Li was leaving home and not coming back, his second daughter had committed an extreme behavior like jumping off a building. Li firmly demanded a divorce, but the mediation failed. Perhaps it was my mother's instinct that after mediation, I left Li alone, wanting to go to her house to see the child at night.
On March evening, the wind was still blowing, and I still shivered when I put on a cotton coat. When I came to Li's house, her house had two floors, but only the basic frame, the staircase and the corridor had no railings, and there was no window glass. Only transparent oil paper was used to hide the wind. There was no furniture. Li's eldest daughter was boarding in the middle school in the town, and her second daughter and her younger son were studying in the local elementary school. Luo often did farm work in his hometown, leaving only two children to live in the house.
Seeing that the two children are not much different from my own children, I started chatting with the children from the perspective of the mother of the same age, and learned about the children's daily life and the reasons for their excessive behavior. In fact, if the judgment is much simpler for me, but I don’t want the family to break up. I contacted Li many times through phone and WeChat, and also communicated with Luo to inform him about what he did wrong, pointing out the safety hazards in his home. In the end, Li agreed to withdraw the lawsuit and was willing to give Luo another chance. After a while, I passed by Li's house and heard the laughter of the child from the upstairs. Even though I was in financial difficulties, Luo installed stair handrails and and glass, and the children also had more safety guarantees.
There are many family cases like this. If the man is worried that impulsive, it may be detrimental to the woman and the child. He will send them back all the way after the court is held. If the woman is not obliged to the family after going out, she will explain the law to the woman and inform her to fulfill the corresponding obligations. Many parties go out to work and do not participate in the trial, so they need to understand the family situation of both parties many times through WeChat, telephone and other methods. Some parties who have a low level of education and who have a wrong understanding of the fact that they cannot divorce without signing or attending a court, they must promote legal knowledge and do their work over and over again. In fact, the handling of divorce cases and family matters is not simple. As the saying goes, "It is difficult for a clean official to make a decision." Because different people have different positions, it is obviously difficult to be satisfied with all parties, but I still hope to do my best to retain some opportunities and warmth for those families that are about to be damaged.
In addition to family disputes, neighborhood disputes are also a type of case in courts. On the surface, it is only a few dozen centimeters away, but in essence it is related to the future social interactions of the parties in the local area. For example, the neighborhood relationship between Luo and Wang's family was broken by a wall, and both parties went to court because of a wall.
