In recent years, affected by the epidemic, some enterprises have chosen to provide concerts and other performance content through the Internet in live broadcast or recorded broadcast, meeting the spiritual and cultural needs of the people. In order to further implement the requirements of the "deregulation, supervision and service" reform, optimize the business environment, and guide the healthy and orderly development of new business formats, the relevant matters are hereby notified as follows.
1. If you hold commercial performances with live audiences in China and provide online live broadcasts, and provide online viewing services such as music, dance, drama, etc. in commercial performances, you will be managed in accordance with the relevant requirements of the Ministry of Culture and Tourism on Deepening the Reform of "Decentralization, Supervision and Service" and Promoting the Prosperity and Development of the Performance Market" (Cultural Tourism Market Fa [2020] No. 62).
2. The online performance drama (profile) in " Internet Culture Management Interim Provisions " refers to the Internet cultural products formed by real-time communication or uploading and disseminating concerts, concerts, music festivals, stage dramas (including operas, dramas, dance dramas , musicals, etc.), folk art, acrobatics, and foreign special stage art (hereinafter referred to as "stage performance activities") through the Internet, mobile communication network, mobile Internet and other information networks, and in real time or uploading and disseminating them in the form of audio and video. The following situations of
are provided as online performances (profiles): broadcast stage performances held overseas live broadcasts on the Internet; the recorded stage performances provided on the Internet in the form of audio and video; provide stage performances or virtual stage performances specially produced for the Internet; and provide stage performances through personal live broadcast rooms.
3. Involving in online performance drama (profile) business activities, you should apply to the provincial cultural and tourism administrative department of your location to obtain an online culture business license with a business scope including "online performance drama (profile)" .
4. If imported online performances (profiles) are provided, the Ministry of Culture and Tourism shall be submitted to the Ministry of Culture and Tourism for content review, and the content review can only be provided to the user after it is passed. When providing domestic online performances (profiles), it shall be submitted to the Ministry of Culture and Tourism for filing within 30 days from the date of providing them to the user.
Imported online performance dramas (profiles) refer to online performance dramas (profiles) in which participants include overseas actors, or the venue of the organizer or recording is overseas, or the copyright of virtual actors or virtual stage performances belongs to foreign institutions or overseas personnel.
5. Online performances (profiles) shall not contain content prohibited by Article 16 of the "Interim Provisions on Internet Culture Management".The online performance drama (profile) business units should establish and improve content management systems, set up independent content management departments, and equip professionals to meet the needs of content review work to be responsible for content management of online performance drama (profile), and strengthen real-time monitoring of user-generated content such as comments and barrage. When providing online performances (projects) through live broadcast, delayed live broadcast should be broadcast, and a dedicated person should be arranged to conduct real-time supervision of online performances (projects) and block content problems as soon as possible and deal with them in a timely manner.
6. All provincial cultural and tourism administrative departments should strengthen dynamic monitoring and law enforcement inspection of the online performance drama (profile) market, urge enterprises to fulfill their main responsibilities, and promptly investigate and punish illegal and irregular acts.
7. Encourage and support online performance drama (profile) business units to provide online performance drama (profile) with high-quality content and conform to socialist core values ; literary and artistic performance groups, performance brokerage agencies, and performance venue business units use the Internet to provide performance activities for the public, create and operate digital performance products; professional stage art institutions participate in the production of online performance drama (profile) and promote the development of new performance formats.
8. Relevant performance industry organizations should strengthen theoretical research on the online performance drama (profile) industry, establish industry norms, carry out industry self-discipline, build an industry exchange platform, provide talent training services, and promote the prosperity and development of the online performance drama (profile) industry.

In recent years, affected by the epidemic, some enterprises have chosen to provide concerts and other performance content through the Internet in live or recorded formats, meeting the spiritual and cultural needs of the people. However, there is a clear difference between new business formats and traditional commercial performances. Due to the lack of live audiences, enterprises cannot apply for performance licenses from local cultural and tourism administrative departments in accordance with the requirements of the " Commercial Performance Management Regulations " and its implementation rules. In order to optimize the business environment, solve the actual operating difficulties of enterprises, and promote the healthy and orderly development of new business formats of online performance dramas (profiles), the Ministry of Culture and Tourism drafted the "Notice of the Ministry of Culture and Tourism on Standardizing the Business Activities of Online Performance Dramas (Profiles) and Promoting the Healthy and Orderly Development of the Industry (Draft for Comments)" (hereinafter referred to as the "Notice"). The relevant situation is explained as follows:
1. Drafting process
In June 2022, our department started the drafting of the document. According to the research, the current new formats of the performance market mainly include the following forms: First, the content of concerts, concerts, dramas and other performances held overseas will be broadcast live on the Internet; Second, the content of recorded concerts, concerts, dramas and other performances will be distributed through the Internet; Third, the content of stage performances or virtual stage performances without live audiences will be specially used for the Internet to disseminate and provide them to the public; Fourth, the content of virtual actor performances will be produced using digital technology and spread through the Internet; Fifth, the content of stage performances will be provided through personal live broadcast rooms.
Based on the previous experience in pilot management of online performances (shows), industry development demands and market practical difficulties learned during the investigation, our department drafted the "Notice" in accordance with the "Interim Provisions on Internet Culture Management" (Ministry of Culture Order No. 51), and solicited opinions from some enterprises, industry associations and relevant departments, and revised and improved them.
2. Main content
The "Notice" includes six parts of content. First, the concept of online performance dramas (shows) is clarified and the conceptual boundaries with commercial performances online live broadcasts. Second, you are required to obtain an online cultural business license for online performances (profiles). The third is to put forward management requirements for imported and domestic online performances (shows). Fourth, specific requirements are put forward for the content management of online performances (profiles). Fifth, local cultural and tourism administrative departments are required to strengthen industry management and urge enterprises to fulfill their main responsibilities. Sixth, encourage innovative development of the industry and require industry organizations to carry out theoretical research and industry self-discipline.
