Prosecutor: Chen Shifeng deliberately murdered and asked for 20 years in prison
In his speech to ask for punishment, the prosecutor pointed out that the debate between the prosecution and defense mainly focused on three points: the incident, who did the knife used to commit the crime, and whether Chen Shifeng clearly had the intention to kill. The prosecutor summarized and sorted out these three points.
1. The incident
Prosecutors believe that they can get the following facts from the evidence:
At 18:10 on November 2, Chen Shifeng sent Liu Xin a WeChat message saying that if Liu Xin dates a boyfriend named Lin, he "can do anything." At 23:17 late, Chen also sent a WeChat message and said again that he wanted to get back with Liu Xin. Liu Xin said that the relationship between the two can no longer be returned.
23:37, Chen continued to ask Liu Xin and his new boyfriend had developed to what stage. Liu Xin said: This is my privacy. Liu Xin expressed a clear rejection of Chen Shifeng's repeated repeated requests for reconciliation. After that, Chen left his residence with the replaced clothes. It can be inferred that he had already had a clear purpose at this time.
21:44, Chen Shifeng bought whiskey at the 711 convenience store. He drank alone while waiting upstairs of Jiang Ge's house. This is to be brave. The prosecutor's reason is:
First, Chen Shifeng has no reason to suddenly change his usual route of activities and go to another station to find a laundry. He has a washing machine at home. After the incident, Chen Shifeng immediately washed his clothes when he went home. The washing machine was not broken and there was no need to go out.
Second, on the afternoon of November 2, Chen Shifeng went to Jiang Ge's house to find Liu Xin and was driven back by Jiang Ge. He should know that Jiang Ge cannot talk to him about his relationship with Liu Xin. Moreover, before the incident, he deliberately lie on the third floor to drink. If he really wants to talk to Jiang Ge, he should wait at the door of Jiang Ge's house on the second floor. Chen Shifeng appeared at Jiang Ge’s door at 23:40, and Liu Xin usually returned home in the early morning. This time is obviously not enough for Chen to talk to Jiang Ge.
2. Regarding the murder weapon fruit knife
The prosecutor believes that the knife was specially prepared by Chen Shifeng to kill Liu Xin. The prosecutor found a packaging box with the same kind of knife as the murder weapon in the laboratory of Dadong Cultural University. There is no knife in the packaging box. At around 18:00 on November 2, Chen Shifeng went to the laboratory.

Chen Shifeng said that the knife was handed to Jiang Ge from inside when he was at Jiang Ge's door. The prosecutor pointed out: Before the incident, Jiang Ge and Jiang Ge's mother were on the phone, and Jiang Ge did not show any concern at all. From then on, it can be judged that Jiang Ge should not have a knife to defend himself. If the knife was handed to Jiang Ge by Liu Xin, then Jiang Ge should have a scabbard at home. However, there are no scabbards in the home and in the remains on site.
Furthermore, Liu Xin clearly denied in his testimony that the knife belonged to him and Jiang Ge. Moreover, Liu Xin's alarm record recorded showed that Liu Xin was in a state of great nervousness at the time and did not bother to hand over the knife. Chen Shifeng's statement is unreasonable.
3. Regarding the murderous intent, the prosecutor pointed out that there are the following objective facts
Jiang Ge had concentrated cuts and stab wounds on his neck. Jiang Ge's clothes were also damaged in many places. It was obvious that Chen Shifeng targeted Jiang Ge's key part of his neck. From this, it is judged that the first knife of has a clear murderous intent. Intentional homicide should be established.
Chen Shifeng defended himself and Jiang Ge held a knife. The two accidentally stabbed Jiang Ge in a fight, and he just finished the knife. The prosecutor pointed out: If this statement is true, Chen Shifeng's first reaction after accidentally stabbing Jiang Ge should be to save Jiang Ge, and his reaction is to finish the attack. The prosecutor believes that this is unreasonable and Chen Shifeng is lying.
In addition, the prosecutor pointed out that there was a very obvious defensive injury on singer Jiang, but Chen Shifeng did not. According to Chen Shifeng himself, this fact cannot be explained. After the incident, there were no special scars on Chen's face. There was no particularly obvious damage on Chen's clothes. Jiang Ge's statement that he stabbed Chen Shifeng first with a knife was obviously unreasonable.
In court, the prosecutor pointed out that 7 points should be considered for Chen Shifeng's conviction and sentencing:
1. The method is very bad. The neck is an important part of the human body. Attacking the neck can easily cause fatal injuries, which is common sense. Chen Shifeng concentrated on attacking Jiang Ge's neck, causing three penetration injuries.
The fatal knife wound was stabbed from the right side and the trachea and artery were cut open. The wound was 6.5-8 cm deep. Jiang Ge has a total of 12 wounds on his neck. Chen Shifeng should have stabbed and cut 11-12 times on Brother Jiang’s neck. This is a very dangerous and bad behavior.
2. Regarding whether the murderous intent is strong. Chen Shifeng had a clear murderous intent. This is a fact.
3. About motivation. Chen Shifeng's motivation is very selfish. Within two to three months after Liu Xin proposed to break up, Chen kept following and entangling Liu Xin.On November 2, after he went to Jiang Ge's house, he threatened Liu Xin and followed Liu Xin to a restaurant where he worked. This is a stalker behavior. Jiang Ge has been protecting Liu Xin. Chen Shifeng felt that Jiang Ge was a very hindering existence, so he killed Jiang Ge after Liu Xin entered the room. Chen Shifeng's follow-up behavior and his killing of Jiang Ge are all very selfish.
4. Regarding the results are significant. Jiang Ge lost her extremely precious life. Jiang Ge's dream of taking office in Japan was shattered. This caused indelible harm to Jiang Ge's mother. Considering these results, the prosecutor believes that Chen should be severely punished.
5. About planning. Chen had a clear murderous intent towards Liu Xin and prepared a knife to use as a weapon and replaced clothes. On the day of the incident, Chen had been eliminating the evidence: he bought a paper ticket, changed his clothes, wore a mask, and contact lenses. This proves that the killing is very clear and planned.
6, Chen Shifeng also wanted to continue attacking Liu Xin at that time. Chen's original purpose was to kill Liu Xin. If Liu Xin had opened the door at that time or the knife was not broken, Chen Shifeng would have killed Liu Xin.
7. Chen Shifeng obviously did not reflect from beginning to end. He kept making unreasonable defenses in court. His attitude obviously hurt Jiang Ge's mother's heart. His apology is just superficial and is not worth mentioning at all.
Based on the above reasons, the prosecutor made a claim for criminal punishment: Chen Shifeng has the crime of intimidation and intentional homicide, and can be sentenced to death or life imprisonment, or imprisonment of not more than 5 years and not more than 12 years. The prosecution believes that the verdict should be severe and the sentence should be 20 years. When

Defense party: Liu Xin’s testimony misleads the court
This morning, Chen Shifeng’s defense lawyer also summarized the reasons for the defense in court:
1. About carrying replacement clothes: Chen Shifeng’s search on his mobile phone can prove that he has indeed found a laundry. According to the community surveillance on November 1, the clothes he carried on the evening of November 2 were worn on the 1st, so he had a need to wash clothes.
2. Jiang Ge deleted Chen Shifeng's WeChat, and Jiang Ge's mobile phone record showed blackmail. Therefore, objectively speaking, Chen Shifeng cannot directly contact Jiang Ge. From 23:09 to 23:37 on the evening of the incident, Chen Shifeng had been communicating with Liu Xin on WeChat. In the end, Liu Xin no longer replied to Chen Shifeng. Therefore, Chen Shifeng came to find Jiang Ge at the door.
3. Regarding the purpose of buying wine. The 711 convenience store surveillance of Chen Shifeng's wine buying shows that Chen Shifeng spent 3 minutes to choose wine. If buying wine is just to boost courage, it will not be used for that long. Chen Shifeng did not use the watermelon card, and used a paper ticket because he did not bring his wallet that day.
4. Chen Shifeng spent 2 minutes and 8 seconds studying the road map at the station, not because he was brewing things. Because he didn't wear glasses, he searched on his mobile phone. The reason I use cash is because I don’t bring my wallet and the card is also in the wallet.
5. The third floor of the apartment building where Jiang Ge lives has a good view, and you can clearly see the situation at the intersection and the first floor. There are only 8 steps from the 3rd floor to the 2nd floor. It's very easy to get from the 3rd floor to the 2nd floor. There is only one passage from the corridor on the second floor to Jiangge's house. If Chen Shifeng wants to kill Liu Xin, he can rush down from the third floor when Liu Xin goes up the second floor.
Defense lawyer pointed out that Chen Shifeng was at the wrong stop at Jiang Ge's house at that time. He was going to get off at the Waterway Bridge, but he overslept and went to Kamibo Town. If it is a clear purpose to kill someone, it is impossible to oversleep. He took a taxi while running away home, telling the driver that he only brought 4,000 yen, and the driver took him to a convenience store to withdraw money. This shows that Chen Shifeng had no plan to kill people. He went out that day to wash clothes and bought wine to meet Jiang Ge.

Liu Xin's confession had a great impact on the searches of the police and prosecutors at that time.Chen Shifeng's lawyer said that Liu Xin initially told the police that it was Jiang Ge's door locked, but in fact it should be Liu Xin's one. Jiang Ge's key and transportation card are in his bag, so Jiang Ge cannot have time to take out the key and lock the door and then stuff it back. There are many unreasonable things about Liu Xin’s statement about locking the door. Liu Xin testified at that time that the door was pushed over for the first time, and he heard the sound of the door closing, but he didn’t hear whether it was locked. Liu Xin provided this testimony in a short time after the incident. It is abnormal to face such a great impact.
When the second alarm of 110 was called, the operator repeatedly confirmed whether the door was locked. Liu Xin said there were. The defense lawyer believed that the fact should be the door that Liu locked himself, so Liu was afraid so he didn't say it. The first sentence recorded by Liu was called to the police should be: "The door is locked, don't scold me." If, as Liu Xin said, what she said was "Don't make a fuss" and "Don't make a joke", then it cannot explain why Liu Xin called the police.
Before Liu Xin called the police, Jiang Ge said something Shandong to Liu Xin across the door. Chen Shifeng's lawyer said that Jiang Ge was scolding Liu Xin in Shandong dialect at the time, so Liu Xin said, "Don't scold." Liu Xin added the words "how (locked the door)" just to cover up his behavior, and said "swearing" as "swearing" and interpreting "speaking" as jokes.

Chen Shifeng's lawyer believes that after the incident, Chen Shifeng had a full chance to eliminate the evidence at that time, but he did not do so. The prosecutor's report mentioned that bloody clothes, fingerprints, and DNA reports were found at Chen Shifeng's home, but the prosecutor did not provide a test report for the packaging box of the knife. Chen Shifeng's lawyer believes that the prosecutor actually made a test report on the packaging of the knife, but nothing was found, so it cannot be judged that the knife of the university is a weapon.
Chen Shifeng's lawyer pointed out that as a murder weapon, the fruit knife has very low lethality. This knife is just a bargain sold in a hundred yuan store. It is not enough to penetrate very thick clothes, so the knife must not be prepared in advance. Moreover, Chen Shifeng had five hours and thirty minutes to prepare the knife before the incident, so there was no need to use a fruit knife.
Regarding the possibility of Liu Xin owning a knife, Chen Shifeng's lawyer said that according to the 110 alarm record, it can be seen that Liu Xin was very scared at the time. The hilt of the knife at the crime scene was marked by someone's movement - from the door of Jiang Ge's house, it was moved to the steps 863 cm away from the door. Chen Shifeng threw the knife away, and the handle of the knife should have been moved by someone else. There were signs of washing the hilt of the knife, and I thought it was raining at first (there was no roof on the steps, it was raining that day). But the hilt is not only on the surface, but also has no blood inside. There is only a little blood stain at the connection between the hilt and the blade. This proves that someone must have washed the handle and pretended to be on the scene. When Liu Xin called the police for the second time, he said that the situation outside the house was very bad and asked the police to call an ambulance. Chen Shifeng's lawyer "reasonable suspicion based on all circumstances" is: at 00:19 on November 3, after Chen Shifeng escaped, Liu Xin picked up the handle of the knife in the entrance hall to wash it, passed by Room 203 and threw it on the first step.
9. Regarding whether the attempted murder was established
Chen Shifeng's lawyer said that according to the forensic testimony, Jiang Ge could not shout out after being fatally injured, and according to the recording of the alarm record, Jiang Ge only shouted once from beginning to end. At about 1:37 seconds after the first alarm recording, Jiang Ge's tragic sound was recorded.If the first knife was not a fatal injury, Chen Shifeng would definitely scream more than once after stabbing a conscious person with a few slashes. Therefore, from this, the first knife was a fatal wound. Fatal wound No. 6 is an accidental injury.
Chen Shifeng's lawyer said that in summary, based on the doorbell, clothes, wounds, testimony of neighbors in Room 203, Liu Xin handed the knife, Jiang Ge stabbed Chen Shifeng, and Chen Shifeng fought back, all these statements should be reasonable. Chen Shifeng said the truth, so he advocated that Chen Shifeng had attempted to kill. Chen Shifeng's motivation for finishing off the job is to avoid huge medical expenses. Although his subsequent finishing behavior was very cruel, the fatal injury was caused by accident before his finishing, so he should be sentenced to the heaviest punishment in the attempted murder.
Chen Shifeng's lawyer also emphasized that Chen Shifeng's self-defense behavior should also be considered. He said that Chen Shifeng usually has a good attitude, good character, has no criminal record, and is a good person; he has apologized, but the apology has not been conveyed to the hearts of the victim's family; Chen Shifeng was condemned for the wrong reports in China during his year of detention, and in this sense, he has been subjected to certain social sanctions.
Chen Shifeng's lawyer said that the people who did not know the truth participated in the signature activity requesting the death penalty for Chen Shifeng after listening to the wrong report. It is inappropriate to use domestic public opinion in China to influence Japan's judicial judgment.
