In order to strengthen forest land protection management, further standardize the forest land review and approval procedures and the temporary occupation of forest land for construction projects, clarify the content and responsibilities, and strengthen the management of temporary occupation of forest land, the State Forestry Administration issued the "Regulations on the Review and Approval of Forest Land Use in Construction Projects", formulated the "Approval of Forest Land Use" and "On-site Inspection Form for Use of Forest Land", and issued the "Notice on Strengthening Supervision and Management of Temporary Occupation of Forest Land", which is now forwarded to you, and put forward the following implementation opinions in light of the actual situation in our province. Please follow them together.
1. Effectively protect high-quality forest land
The "Regulations on the Review and Approval of Forest Land Use in Construction Projects" clearly stipulates that construction projects restrict the use of forest land with high storage unit area. Based on the actual situation in our province, "forest land with high accumulation per unit area" refers to forest land with a storage capacity exceeding the average level of similar site conditions of forest stands.
2. Standardized use of forest land status map management
When submitting application materials for use of forest land, the construction unit should also provide the project's current map of forest land to be used (in duplicate). If the forestry administrative department with the authority to review and approve the use of forest land, the official seal of the forestry administrative department shall be stamped on the current situation chart of the forestry land use, and shall be returned to the forestry administrative department and land-use units at the next level step by step with the review and approval documents for inspection of the implementation of forest land use in construction projects.
3. Strengthen the quality supervision of forest land feasibility report and checklist
Establish a system for preparing bad reputation records for feasibility report using forest land. Forest survey units that undertake the preparation of the feasibility report on the use of forest land for construction projects must strictly control the investigation and preparation of the forest land status, and be responsible for the authenticity and accuracy of the feasibility report on the use of forest land or the survey form for the current status of forest land. The Provincial Forestry Department will establish a system for preparing a bad reputation record for the feasibility report on the use of forest land, and regularly publish design units that have problems such as fraud and low quality due to the feasibility report on the use of forest land or the current situation of forest land. If a false report or inspection form is issued, resulting in the review and approval department making incorrect permissions and causing losses to forest rights holders, public interests and public and private property, the person who prepares the report or inspects and their units shall be held accountable in accordance with the law.
4. Standardize the management of temporary forest land occupancy
All localities must earnestly follow the requirements of the "Notice of the State Forestry Administration on Strengthening Supervision and Management of Temporary Occupation of Forest Land", strictly control the scope and conditions of temporary forest land occupation. For prospecting, open-pit mine, sand mining, quarrying, soil extraction and other construction projects that do not meet the conditions for forestry production to restore the used forest land after the expiration of the land use period, temporary forest land occupation procedures shall not be handled, and forest land occupation procedures shall be applied for the procedures for forest land occupation in accordance with regulations. Units or individuals applying for temporary occupation of forest land must submit a plan for restoring forest production or an agreement signed with the forest land rights holder on temporary occupation of forest land to restore forest production, and shall not build permanent buildings, structures and other facilities. Forestry administrative departments at all levels should increase supervision of temporary forest land projects, establish an acceptance system for the conditions for restoring forest land for temporary forest land, strictly implement the responsibility of restoring forest production conditions after the expiration of temporary forest land, and deal with those who refuse to return after the expiration of temporary forest land, fail to restore forest land production conditions in accordance with the law or build permanent buildings (structures) must be dealt with in accordance with the law. For projects approved by local governments and projects directly serving forestry production, they must be entered into the national forestry land review and approval management system for the use of forestry projects in a timely manner in accordance with regulations, and the approval documents shall be copied to the Provincial Forestry Department at the same time.
