Article 5 The election and legal appointment and removal of party and government leadership positions within the scope listed in Article 4 of these Regulations, and the selection of candidates recommended and nominated by the party organization shall apply to the provisions of these Regulations, and their election and legal appointment and removal shall be in accordance with relevant laws, charters and regulations conduct.

Article 8 Those who are promoted to leadership positions in the party and government must possess the following basic qualifications:

Candidates for special promotion must be reported to the superior organization (personnel) department for approval before discussion and decision. Article 36 The candidates to be appointed and recommended for the leading positions of the municipal (prefecture, state, league), county (city, district, banner) party committees and government leadership groups shall generally be nominated by the standing committee of the party committee at the higher level and submitted to a secret vote at the plenary session. Article 37 If any of the following circumstances occurs, it shall not be submitted to the meeting for discussion:
(1) The democratic recommendation and inspection are not carried out in accordance with the regulations;
(2) The party committee (party group) of the unit where the proposed candidate is located has not made conclusive opinions on the integrity and self-discipline situation. If the decision of the party committee (party group) on the appointment and removal of cadres needs to be reviewed, it must be approved by more than half of the members of the party committee (party group).
Article 39 The party committee (party group) shall discuss and decide on the appointment and removal of cadres in accordance with the following procedures:
(1) The leading member of the party committee (party group) in charge of organizational (personnel) work or the person in charge of the organization (personnel) department shall introduce the proposed candidates for leadership positions one by one. Chapter 7 Appointments
Article 41 Party and government leadership positions shall be subject to the selection and appointment system, and some highly professional leadership positions may be subject to the appointment system.
Article 42: Implement a public announcement system for leading party and government cadres before taking office.
Those promoted to leadership positions below the department or bureau level, except for special positions and candidates who have been publicly announced during the election change inspection, should be publicized within a certain range after the party committee (party group) discusses and decides and before issuing the appointment notice. Those promoted to the following unelected leadership positions below the department or bureau level shall have a probationary period of one year:
(1) Deputy positions in party committees, National People's Congress Standing Committees, government, CPPCC work departments and leadership positions in internal agencies;
(2) Discipline Inspection Commission Leadership positions in the internal agencies and dispatched agencies of the Supervisory Committee;
(3) Leadership positions appointed by non-state power agencies in the internal agencies of courts and procuratorates in accordance with the law. After the trial period of

Article 45 The term of office for party and government leadership positions shall be calculated according to the following time:
(1) If the appointment is decided by the Party Committee (Party Group), it shall be calculated from the date of decision by the Party Committee (Party Group);

Article 52: Implement a system of recusal from serving for leading party and government cadres.

Chapter 11 Discipline and Supervision
