Do you know the relevant regulations on book royalties? ?
Youth Youth Rights Protection Online Legal Expert and Beijing Zhicheng Public Welfare Lawyer Yao Yanjiao
China National Knowledge Infrastructure issued a notice to claim royalties, which in a certain sense takes a step forward in regulating the copyright of papers. What are the standards and payment methods for remuneration for electronic text works, my country's " Copyright Law " and related regulations. What provisions does my country's "Copyright Law" have for the standards for remuneration for text works? Experts from the Youth League Central Committee 12355 said this:
Article 27 of the Copyright Law stipulates that the remuneration standards for the use of works may be agreed upon by the parties, or may be paid in accordance with the remuneration standards formulated by the copyright administrative department of the State Council in conjunction with relevant departments. If the agreement between the parties is unclear, remuneration shall be paid in accordance with the remuneration standards formulated by the copyright administrative department of the State Council in conjunction with relevant departments.
According to the provisions of this article, the remuneration standard is chosen by the parties, either by the parties to the contract to determine it themselves in the contract, or the remuneration is paid in accordance with the remuneration standards formulated by the copyright administrative department of the State Council in conjunction with relevant departments.
There are two situations in which the parties agree on the remuneration standards for the use of works in the contract: First, because the remuneration standards formulated by the national copyright administration department in conjunction with relevant departments often have a certain range, then the parties concerned will set the remuneration standards in the relevant national departments. Agree on specific payment standards within the standard range. For example, Article 3 of the National Copyright Administration "Interim Provisions on Remuneration for Books" (implemented on July 1, 1990 and still valid) stipulates that manuscripts: 10 yuan to 30 yuan per 1,000 words. For scientific works that do have important academic value, including monographs on natural sciences, social sciences, and literary theory, those who must be paid more favorably can increase the standard appropriately, but it shall not exceed 40 yuan per 1,000 words. The parties may refer to these provisions when agreeing on the remuneration standards for the use of works.
Second, the parties can also agree on a remuneration standard based on factors such as the quality of the work, the reflection effect, the number of uses, the length of time the work has been made public, and the economic and social benefits generated during the use of the work. This payment standard is both It can be higher than the remuneration standard set by the national copyright administrative department in conjunction with relevant departments, or it can be lower than this standard.

What should we do if the parties do not agree on the payment standard for using other people’s works in the contract, or if the parties have an agreement, but the agreement is unclear and cannot be fulfilled in practice? In this regard, the Copyright Law stipulates in this article that remuneration shall be paid in accordance with the remuneration standards formulated by the copyright administrative department of the State Council in conjunction with relevant national departments.
On November 1, 2014, the National Copyright Administration and the National Development and Reform Commission issued the latest remuneration payment standards "Provisions on Remuneration for Published Literary Works": The basic remuneration standard and calculation method for original works in Article 5 is: 80-300 yuan per 1,000 words , the annotation part shall be implemented with reference to this standard. In addition, the regulations on remuneration payment methods are as follows:
Article 3 Remuneration for using written works published in paper media can be paid in the form of royalties, basic royalties plus royalties for the number of prints, or one-time payment.
Royalty refers to the remuneration paid by users to the copyright holder in the form of book price × actual sales or number of prints × royalty rate.
basic royalties refer to the remuneration paid by users to the copyright holder based on the number of words in the work, in units of thousands of words.
Printing fee refers to the remuneration paid by the user to the copyright holder based on the number of prints of the book, based on a certain proportion of the basic royalties in units of one thousand copies.
One-time payment refers to a one-time remuneration paid by the user to the copyright holder based on factors such as the quality and length of the work, the author's popularity, influence, usage method, usage scope, and authorization period.
Article 14 If a written work is used in a manner other than paper publication, unless otherwise agreed in the contract, the user shall be remunerated with reference to the remuneration standards and remuneration methods stipulated in these Measures. When
uses written works in a digital or online environment, unless otherwise agreed in the contract, users may pay according to the payment standards and payment methods stipulated in these Measures.
Specific to the case of China National Knowledge Infrastructure, it is not illegal to pay royalties according to the "Interim Provisions on Remuneration for Books", but according to the latest "Provisions on Remuneration for Published Literary Works", the royalties may be low (but many literary works in the early years This latest regulation does not apply).
From the perspective of contract law, such a notice issued by CNKI is deemed to have issued a contract offer. If the author accepts, a contract regarding the agreement on royalties is established. If you do not accept it, the contract regarding the remuneration agreement will not be established. The author can form a new agreement with CNKI or protect his rights through other means.
