Recently, after a public prosecution was launched by the Procuratorate of Deqing County, Zhejiang Province, the court sentenced Li to three years and four months in prison at first instance for selling goods with counterfeit registered trademarks, and was fined 260,000 yuan.
"I seem to have bought a counterfeit goose down quilt of a certain brand. It's not just me. Our medical staff involved in epidemic prevention here bought nearly 500 beds!" In February this year, the Deqing County Procuratorate's 12309 Procuratorate Service Center received a report from a participant Complaint hotline for epidemic prevention medical staff.
After receiving the clue, the Deqing County Procuratorate immediately set up a task force to verify the complaint with the market supervision department through the information sharing execution connection channel, and visited and questioned medical staff on the spot, successfully obtaining evidence such as the purchase of counterfeit products. materials, and guided relevant departments to promptly seize the products involved. At the same time, the public security organs arrested the suspect Li and others. After the
case was transferred to the procuratorate, the Deqing County Procuratorate immediately launched its own supplementary investigation and hired professionals from the market supervision department as special prosecutor assistants to identify counterfeit products from a professional perspective.
In response to issues such as the identification of counterfeit registered trademarks and the subjective intention of the perpetrators in selling counterfeit products, the task force visited the regular warehouse of the brand store and investigated the temporary warehouse where the counterfeit products were stored in this case. Prosecutors found that the products in the temporary warehouse were piled randomly without any labels or packaging. Li privately entrusted others to package and process the outgoing products... This shows that Li had the subjective intention to sell counterfeit products.
"The current hard-won epidemic prevention environment is the result of medical staff sacrificing their lives to protect us on the front line. If you use fakes to hurt them, neither emotion, reason nor law will allow you to do so!" the prosecutor in charge of the interrogation said. Li et al. pointed out.
Facing the interrogation of the prosecutor, Li and others voluntarily compensated the medical staff for all losses. Subsequently, the Deqing County Procuratorate prosecuted Li and others on suspicion of selling goods with counterfeit registered trademarks.
The court found after trial that during October 2020, in order to obtain financial benefits, Li and others pretended to be staff of a certain brand company, and sold counterfeit goose down quilts to medical staff at a price of 760 yuan per bed, with a sales amount of More than 360,000 yuan, the above judgment was made against Li in accordance with the law. Because Li refused to accept the appeal, the case is still under further review.
It is reported that Li Mouyi, the same case, was sentenced to nine months in prison and fined 60,000 yuan for selling goods with counterfeit registered trademarks; Wang Mou was sentenced to seven months in prison, suspended for one year, and fined 10,000 yuan in gold. Currently, the sentences against both of them have taken effect.
