"Regulations on the Registration and Management of Non-commercial Internet Information Services" has been reviewed and approved at the 12th Ministry of Information Industry of the People's Republic of China on January 28, 2005. It is now released and will come into effect on March 20, 2005.

Non-commercial Internet Information Service Registration Management Measures

Article 1 In order to standardize the registration and filing management of non-commercial Internet information services and promote the healthy development of the Internet information service industry, this Measures are formulated in accordance with the provisions of the " Internet Information Service Management Measures ", " Telecommunications Regulations of the People's Republic of China " and other relevant laws and administrative regulations.

Article 2: Providing non-commercial Internet information services within the territory of the People's Republic of China, performing filing procedures, implementing filing management, and applying these Measures.

Article 3 The Ministry of Information Industry of the People's Republic of China (hereinafter referred to as the "Ministry of Information Industry") supervises and guides the filing and management of non-commercial Internet information services nationwide, and the Communications Administration Bureaus of the provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the "Provincial Communications Administration Bureau ") specifically implements the filing and management of non-commercial Internet information services.

If you intend to engage in non-commercial Internet information services, you shall complete the registration procedures with the Provincial Communications Administration where he or she is located.

Article 4 The Provincial Communications Administration shall follow the principles of openness, fairness and justice in filing management and provide convenient, high-quality and efficient services.

When non-commercial Internet information service providers engage in non-commercial Internet information services, they shall abide by relevant national regulations and accept supervision and management implemented by relevant departments in accordance with the law.

Article 5: Non-commercial Internet information services are provided within the territory of the People's Republic of China, and the filing procedures shall be carried out in accordance with the law.

The provision of non-commercial Internet information services within the territory of the People's Republic of China as referred to in these Measures refers to the provision of non-commercial Internet information services by organizations or individuals within the territory of the People's Republic of China using websites accessed through Internet domain names or websites accessed only through Internet IP addresses.

Article 6 The Provincial Communications Administration Bureau uses online filing management through the registration management system of the Ministry of Information Industry.

Article 7: If you intend to engage in non-commercial Internet information services, you shall truthfully fill out the "Non-commercial Internet Information Service Filing and Registration Form" (hereinafter referred to as "Registration Form"" through the filing management system of the Ministry of Information Industry, see the appendix to these Measures) and perform the filing procedures.

The Ministry of Information Industry has adjusted and announced the "Registration Form" based on actual conditions.

Article 8: Those who intend to engage in non-commercial Internet information services through access to the commercial Internet may entrust Internet access service operators, Internet data center business operators and telecommunications business operators who provide access services to their websites in other ways to perform the procedures such as filing, filing change, filing cancellation.

Article 9: If you intend to engage in non-commercial Internet information services through public welfare networks such as China Education and Research Computer Network, China Science and Technology Network, China International Economic and Trade Internet, China Great Wall Internet , the public welfare Internet network unit that provides Internet access services to its website may perform the procedures such as filing, filing change, filing and cancellation.

Article 10 Internet access service business operators, Internet data center business operators, telecommunications business operators and public welfare Internet network units (hereinafter referred to as "Internet access service providers") shall not perform the registration, registration change, registration cancellation and other procedures for organizations or individuals who are planning to engage in non-commercial Internet information services on their behalf if they are known or should know that the registration information of organizations or individuals who intend to engage in non-commercial Internet information services is not true.

Article 11 If you intend to engage in news, publishing, education, medical care, medicines and medical devices, culture, radio, films and TV programs, etc., and if you should be reviewed and approved by the relevant competent departments according to laws, administrative regulations and relevant national regulations, when completing the filing procedures, you should also submit documents reviewed and approved by the relevant competent departments to the Provincial Communications Administration where he or she is located.

If you intend to engage in electronic announcement service , when completing the registration procedures, you should also submit special registration materials for electronic announcement service to the Provincial Communications Administration Bureau where he or she is located.

Article 12 After receiving the registration materials submitted by the filing party, if the provincial communications administration bureau has complete materials, it shall file the registration within 20 working days, issue the registration electronic verification mark and filing number to it, and publish the relevant filing information to the public through the filing management system of the Ministry of Information Industry; if the materials are incomplete, the filing party will not be filed, and the filing party will be notified within 20 working days and explain the reasons.

Article 13 Non-commercial Internet information service providers shall indicate their filing number at the center at the bottom of the homepage when their website is opened, and link the website of the Ministry of Information Industry registration management system as required below the filing number for public inquiry and verification.

Non-commercial Internet information service providers shall place registration electronic verification logo in the designated directory of their website in accordance with the requirements of the registration management system of the Ministry of Information Industry when their website is opened.

Article 14 If a non-commercial Internet information service provider needs to change the information filled in in the "Registration Form" within the filing period, he shall log in to the Ministry of Information Industry registration system 30 days in advance to complete the filing change procedures with the original filing authority.

Article 15 If a non-commercial Internet information service provider needs to terminate the provision of services within the filing period, he shall log in to the filing system of the Ministry of Information Industry on the date of termination of the service to complete the filing and cancellation procedures with the original filing authority.

Article 16 Non-commercial Internet information service providers shall ensure that the information provided is legal.

The information content provided by non-commercial Internet information service providers referred to in these Measures refers to the information content included under the Internet domain name or IP address of the Internet information service provider's website.

Article 17 The Provincial Communications Administration shall establish management mechanisms such as reputation management, social supervision, and situation investigation to supervise and manage non-commercial Internet information service activities.

Article 18 Internet access service providers shall not provide Internet access services to non-commercial Internet information services for unregistered organizations or individuals.

For non-commercial Internet information service providers or organizations or individuals who illegally engage in non-commercial Internet information services who have been punished by the Provincial Communications Administration for temporarily closing the website or closing the website, the Internet access service provider shall immediately suspend or terminate the provision of Internet access services to them.

Article 19 Internet access service providers shall record the registration information of non-commercial Internet information service providers they access.

Internet access service providers shall do a good job in network information security management such as dynamic management of user information, record retention, harmful information reports in accordance with relevant national regulations, and supervise the accessed users in accordance with the requirements of the Ministry of Information Industry and the Provincial Communications Administration.

Article 20 The Provincial Communications Administration implements annual review of the filing of non-commercial Internet information services in accordance with the law.

The Provincial Communications Administration Bureau conducted annual review through the filing management system of the Ministry of Information Industry through the online method.

Article 21 Non-commercial Internet information service providers shall log in to the Ministry of Information Industry registration management system at the specified time per year, and shall perform the annual review procedures .

Article 22 If you violate the provisions of Article 5 of these Measures and fail to perform the filing procedures to provide non-commercial Internet information services, the Provincial Communications Administration Bureau of the place where you are located shall order you to correct the problem within a time limit and impose a fine of 10,000 yuan; if you refuse to correct the problem, the website shall be closed.

If a project that exceeds the registration is provided, the Provincial Communications Administration Bureau of the residence shall order it to correct the problem within a time limit and impose a fine of not less than RMB 5,000 and not more than RMB 10,000; if it refuses to correct the problem, the website shall be closed and the registration shall be cancelled.

Article 23 If you violate the provisions of Article 7, paragraph 1 of these Measures and fill in false registration information, the Provincial Communications Administration Bureau of the place where you are located shall close the website and cancel the registration.

Article 24: If the provisions of Articles 10, 18 and 19 of these Measures shall be ordered by the Provincial Communications Administration Bureau where the illegal act occurs and shall be fined 10,000 yuan.

Article 25 If you violate the provisions of Article 13 of these Measures and fail to link the website of the Ministry of Information Industry’s filing management system below its filing number, or fail to place the filing electronic verification logo in the designated directory of its website, the Provincial Communications Administration Bureau of the place where you are located shall order the correction and impose a fine of not less than RMB 5,000 and not more than RMB 10,000.

Article 26 If you violate the provisions of Articles 14 and 15 of these Measures, fail to perform the registration change procedures within the prescribed time, or fail to perform the registration cancellation procedures in accordance with the law, the Provincial Communications Administration Bureau of the place where you are located shall order you to correct the problem within a time limit and impose a fine of 10,000 yuan.

Article 27 If a non-commercial information service provider violates relevant national laws and regulations and should suspend or terminate services in accordance with the law, the Provincial Communications Administration may temporarily close the website, or close the website and cancel the registration according to the written recognition opinions of the agencies at the same level authorized by laws and administrative regulations.

Article 28: During the annual review, if a non-commercial Internet information service provider has any of the following circumstances, the Provincial Communications Administration of the place where he or she is located shall order him or her to correct the problem within a time limit through the registration system of the Ministry of Information Industry and other media notice; if he or she refuses to correct the problem, the website shall be closed and the registration shall be cancelled:

(1) If the registration website fails to log in to the registration website at the specified time to submit annual review information;

(2) If the state departments such as news, education, public security, security, culture, radio, film and television, publishing, and confidentiality put forward annual review veto opinions on the special content under their respective supervision in accordance with the law.

Article 29 This Measures shall come into effect on March 20, 2005.
