Litigation consists of three parts: procedure, facts, and law. The logic goes by analogy. The procedure is the means of transportation, and the facts and law are how to drive and where to drive.
After the first and second trials and other preliminary procedures, in the later stage, after you submit the materials, the judge responsible for the review will give more priority and focus on whether the application of the law is correct and whether the judgment result is fair.
Once these two are almost the same, it is almost certain that the application will be rejected. Some parties may say, shouldn’t the facts be determined first? But in fact, after the early trial, in terms of facts, it is easier for judges to form a habit of thinking and determine the facts later, just like setting a target.
Regarding the review of the application of law, if there is no fundamental error, it is not called a real error. A fundamental error is an incorrect application of the law that results in completely different, or mostly different, results.
Regarding the fairness of the referee results, this fair understanding is more like it is unfair to you, and it is not fair to you when it is not fair or unfair to the other party. For example, if the original judgment is unfair to you, but fair to the other party, it is not unfair to you; if the original judgment is unfair to you, it is also unfair to the other party, but this is not unfair to you.
