Queenland 491 Immigration-Small Business Owner Channel (SBO) has now been opened in the 2022-23 project annually. This access is for immigrants currently living and operating small businesses in Queensland.
Applicants for "491 - Small Business Owner Channel" must:
Channel 1 - Purchase existing business, have a career related to 491 on LIN 19/051. Spend at least AUD 100,000 to buy an existing business at the existing location.
Channel 2 - Start a business, start and operate a profitable business in Queensland for at least 2 years, with a minimum turnover of 200,000 Australian dollars in the past 12 months before submitting the letter of intent.
2022-23 Related further standard details:
1. No seller financing.
2. The applicant cannot purchase the 491-SBO applicant's previous business.
3. Applicants must operate business in a region for at least 3 years (possibly regulated).
4. The company's shares shall not be transferred (there must be a sales contract).
5. Applicants cannot purchase a business from family members.
6. Commission agents or franchise rental agents (such as gas stations) and home businesses (including businesses with virtual offices) will not be considered.
Please note: Queensland Immigration Department 491 Small Business Owner (SBO) Applicants will sign a statement: “From the visa grant, run a business in Queensland and live for at least three years”. If the applicant chooses to sell their SBO business before this, Queensland Immigration has the option to withdraw the 491 visa nomination and allow the applicant to explore other visa options. Applicants need to understand this condition before applying for this visa access.

1. Age under 45 years old;
2. The total score of EOI is 65 points or above (including state nomination points);
3. It is a nominated profession and passes skill assessment;
4. Meet the minimum English language requirements specified;

Step 1: Assess whether you have 491-SBO qualifications, understand the visa conditions and document list. Ensure that the Ministry of Home Affairs’ immigration qualification standards and Queensland immigration standards are met at the same time, and the documents are sorted out before submitting the letter of intent.
Step 2: Submit a letter of intent (EOI) to SkillSelect. Ensure that all information, such as work experience, is included in the letter of intent. Applicants who choose “Queensland” as the nomination state will receive priority.
Step 3: Submit 491 - Small Business Owner Evaluation Form.
Step 4: If the application is successful, an email invitation will be received to submit the application and will be asked to provide the required documents.
Step 5: If you receive an invitation from Queensland Immigration: Upload the required documents and then pay a non-refundable application fee to complete the application. Don't pay until you are invited to apply and upload all documents.
Note: From the date of receipt of the invitation, you will have 14 days to complete the application. If relevant information cannot be provided during this period, you need to apply for an extension from the Queensland Immigration Agency. Applications that are not completed within the specified time will be closed and a new letter of intent will be required if the applicant wishes to seek a Queensland nomination again.
Step 6: If passed, you will receive an invitation to apply for a visa from the Ministry of Home Affairs. It takes 60 days to submit an application to them.
Step 7: Once the visa is approved, the applicant needs to reach Australia within the specified time.
When the applicant successfully obtains a small business visa in Queensland, he or she only needs to work in a remote area for three years and settle down with an annual tax income of more than AUD 53,900, he or she can apply for a 191PR visa and obtain Australian permanent resident status.
