On February 8th, the Supreme People’s Procuratorate held a press conference on “Strengthening Intellectual Property Judicial Protection Services to Ensure the Construction of an Innovative Country” to inform the procuratorial organs to give full play to their procuratorial functions and promote the development of an intellectual property power. And released the 26th batch of guiding cases for the Supreme Inspection.
There are 5 guiding cases in this batch, namely: Deng Qiucheng, Shuangshan Food (Xiamen) Co., Ltd. and other sales of counterfeit registered trademarks, Guangzhou Carmen Industrial Co., Ltd. suspected of selling counterfeit registered trademarks, and Chen The case of eight persons including Li Li infringing copyright, the case of five persons including Yao Changlong who counterfeiting registered trademarks, and the case of Jin Yiying infringing on trade secrets.
Sun Qian, a member of the Supreme Procuratorate Party Group and Deputy Chief Prosecutor, introduced that from 2016 to 2020, prosecutors across the country reviewed and prosecuted more than 30,000 cases of intellectual property infringement and more than 65,000 people, and prosecuted more than 23,000 cases of more than 45,000 people. While procuratorial organs are performing their functions of criminal prosecution of intellectual property rights, they have also continuously increased their supervision over intellectual property civil and administrative litigation. From 2016 to 2020, procuratorial organs across the country accepted a total of 495 civil supervision cases involving intellectual property rights and 205 administrative supervision cases.
Sun Qian said that from 2016 to 2020, the Supreme People’s Procuratorate individually or jointly with relevant departments listed and supervised 177 various intellectual property cases, including direct participation in the “Quick Broadcast” case, the “2.15” series of infringement and piracy of Spring Festival films, Research, consultation and handling of key cases such as the series of counterfeit famous calligraphy and painting cases, and issued a total of 82 typical cases of intellectual property protection. The five cases released today are in the form of guiding cases, focusing on the difficult and complex issues that are prominent in the intellectual property inspection work, strengthening the guidance, responding to social concerns, and creating a legal atmosphere for intellectual property protection.
