Inner Mongolia Autonomous Region’s work plan to further optimize the business environment and reduce the institutional transaction costs of market entities
In order to thoroughly implement the spirit of the "Opinions of the General Office of the State Council on Further Optimizing the Business Environment and Reducing the Institutional Transaction Costs of Market Subjects" (Guobanfa [2022] No. 30), actively use reform and innovation methods to help market entities solve problems, overcome difficulties, recover, increase vitality, and strengthen efforts to consolidate the foundation for economic recovery and development. In combination with the actual situation of the autonomous region, this plan is formulated.
1. Further break the hidden threshold and promote the reduction of market entities' access costs
(I) Fully implement the negative list of market access management. Strictly implement the national negative list system for market access, comprehensively sort out and improve the relevant approval systems and supervision mechanisms of the autonomous region, and promote the online processing of all list matters. In cooperation with the country to carry out market access efficiency assessment, before the end of October 2022, all departments and leagues and cities will clean up explicit and implicit barriers with market access restrictions and establish a long-term investigation mechanism. (Led by the Autonomous Region Development and Reform Commission and the Department of Commerce, all relevant departments and units of the Autonomous Region and all leagues and cities are responsible according to their division of responsibilities)
(II) Focus on optimizing the industrial product management system. Strengthen the management of administrative licensing and mandatory certification of industrial products, and cancel or optimize unnecessary administrative licensing, inspection, testing and certification in accordance with national regulations. Before the end of October 2022, explore the pilot program of self-inspection and self-certification in some fields. Carry out standardization and standardization of the industrial production license approval management system, build a one-stop service platform for all industrial products processes, realize the interconnection of relevant approval systems and quality supervision and management platforms, and the common recognition of relevant quality technical service results, and promote the rapid production and listing of industrial products. Before the end of 2022, research and formulate standards for quality credit evaluation of production enterprises in the autonomous region. (III) Standardize the implementation of administrative licensing and administrative filing. Reduce administrative licensing transaction costs, strengthen full-chain management, and improve policies and measures to implement standardized management of administrative filing. Before the end of 2022, a list of administrative licensing matters and service guidelines for autonomous regions, leagues, cities, banners, counties (cities, districts) will be prepared. (IV) Effectively standardize government procurement and bidding. Standardize the behavior of bidding entities from a mechanism, strengthen the supervision of the entire bidding chain, and fundamentally break unreasonable restrictions on enterprise ownership discrimination and local protection in all links of bidding. Achieve online processing of bidding, bidding, bid opening and other businesses in the engineering construction field across the region and mutual recognition of digital certificate across leagues and cities and across platforms. Explore the practical application of electronic business license , and cancel the supplier pre-select database, qualification database, directory database, etc. that are illegally set up in various regions. Government procurement and bidding shall not restrict the form of deposit, nor shall it designate financial institutions or guarantee institutions that issue guarantee letter to promptly clear and refund deposited deposits. (V) Continuously facilitate the registration of market entities.Gradually realize integrated services for domestic and foreign investment registration, optimize and standardize online processing and market entities' closure systems, and simplify the procedures for handling tax-related and fee-related matters such as enterprise cross-regional migration. Further improve the level of enterprise cancellation of "one-stop service" and optimize the procedures for simple cancellation and ordinary cancellation. Implement the national unified enterprise establishment, change registration standards and review standards and the transfer rules for enterprise off-site migration files, and simplify the procedures for handling tax-related and fee-related matters such as enterprise migration across regions. 2. Further standardize enterprise-related charges and promote the reduction of the operating burden of market entities
(VI) Strictly regulate government charges and fines. Strictly implement the list of administrative and institutional charges and government fund catalogs, and strictly control newly established enterprise-related charges in accordance with laws and regulations. Severely investigate and punish acts such as compulsory levy, excessive taxes and fees, intercepting tax reduction and fee reduction dividends, illegally setting up fine items, and unauthorized raising of fine standards. Strictly regulate administrative penalties, and further clean up and adjust unreasonable fines such as violation of authority settings and improper penalty. Before the end of 2022, special rectification of illegal charges for enterprises in the autonomous region will be completed, focusing on investigating and punishing behaviors such as inadequate implementation of fee reduction and burden reduction policies and failure to implement fee-benefiting policies as required, and establishing a long-term governance mechanism. (VII) Promote the standardization of charges outside the price of municipal public service. List management will be implemented for services and charging items that implement government pricing and government guidance prices, strictly rectify illegal charges, and improve the construction of transparent charging services. Strengthen the price supervision of municipal public services such as water, electricity, gas, heat, communications, and cable TV. Fully publicize the price of non-grid direct power supply , severely rectify illegal charges in electricity bills, and accelerate the transformation of "one household, one table" for residential communities and commercial complexes that meet the conditions. Severely investigate and punish illegal and irregular acts such as forced bundling and bundling of municipal public services, restricting entry and charging without public notice. By the end of 2022, the district will implement "zero investment" for telecommunications installation for residents and small and micro enterprises with telecommunications installation capacity of 160 kilowatts or less. (8) Focus on standardizing financial service charges. Standardize bank service charges, set red lines for supervision of service price behavior, further reduce the overall service fee rate of financial institutions, and resolutely investigate and deal with problems such as illegal charges and false price information. Strictly implement the " Commercial Bank Service Price Management Measures ", resolutely investigate and punish the failure to implement preferential charging policies for small and micro enterprises, transfer costs, and forced bundling and selling insurance or financial products in financing services, encourage securities, funds, guarantees and other institutions to further reduce service charges, and promote financial infrastructure to reasonably reduce transaction, custody, registration, liquidation and other fees. Guide securities companies to carry out corporate bond issuance , IPOs, mergers and acquisitions and restructuring, reduce service charges, and reduce the burden on enterprises. (9) Clean up and regulate the fees charged by industry associations and chambers of commerce. Standardize the fee management of industry associations and chambers of commerce, prohibit industry associations and chambers of commerce from setting up rents and seeking rents in various third-party services, promote the protection of charging policies, and protect corporate rights and interests. Before the end of October 2022, a "look back" will be completed to clean up and rectify illegal fees in industry associations and chambers of commerce. Promote the public announcement of charging information of industry associations and chambers of commerce at all levels and types, and strictly prohibit compulsory enterprises from going to specific institutions for testing, certification, training and obtaining profit sharing, or charge enterprises in violation of regulations in the name of evaluation, commendation, etc., standardize policies and measures, and promote the healthy development of industry associations and chambers of commerce.(The Autonomous Region Civil Affairs Department, Development and Reform Commission, Market Supervision Bureau and other relevant departments and units, as well as all leagues and cities, are responsible according to their division of responsibilities)
(10) Promote the reduction of logistics service charges. Reduce charges in all links in the logistics field to ensure smooth and low cost of the "dual circulation". Improve the efficiency of various transportation modes, reduce charges for logistics sites, standardize charges for logistics intermediaries, accelerate multimodal transport reform, and enhance the transportation node advantages of the autonomous region. Before the end of November 2022, we will connect with the Ministry of Transport and strive to build multimodal transport demonstration projects in the autonomous region. Standardize the operating service charges for business in the import and export links of the autonomous region. For new charges that really need to be added during the COVID-19 epidemic, the local people's government will organize relevant departments to conduct cost surveys, and promptly include them in the management of the port fee list, and guide and urge charging enterprises to publicize the fee list in the "single window" and local government portal websites. Establish a cost sharing mechanism for epidemic prevention and control shared by government departments, epidemic prevention enterprises and freight parties. Standardize and disclose the logistics operation time limit and procedures such as cargo transfer, shift, loading and unloading at ports, airports, land ports, and railway stations. Establish a regular reporting system for standardized pallets in the league and city, and promote the circulation and sharing of standardized boxes and baskets. 3. Further optimize enterprise-related services and promote the reduction of service costs of market entities
(11) Comprehensively improve online and offline service capabilities. Accelerate the establishment of an efficient, convenient, high-quality and inclusive market entities’ full life cycle service system to facilitate reform and improve government service efficiency. Accelerate the construction of the Inner Mongolia Government Service Network version 3.0 and the "Mengsui Office" mobile terminal second phase project, and promote "one-window comprehensive office", "one-stop office", "one-time office" and "cross-provincial office". Accelerate the construction of a unified electronic certificate library. By the end of 2022, unified and standardized local standards or unified standardized formats of electronic certificates and licenses, support the gathered electronic certificates and licenses to achieve "free certificate processing" in the handling of government service matters, formulate interim measures for the management of electronic seals for enterprises, non-enterprise legal persons and personal electronic seals, and promote the application of electronic seals in the field of government services. Complete the "Mengsuban" mobile terminal improvement project construction , and continuously improve the support capabilities and service level of the mobile government service platform. Do a good job in promoting and mutual recognition of electronic certificates and certificates for foreign investment, and promote the facilitation, standardization and digitalization of foreign investment. (12) Continuously optimize investment and construction project approval services. Optimize the evaluation processes of covering minerals, climate feasibility, water resource demonstration, , flood control, archaeology, etc. Explore the use of market mechanisms to promote the redevelopment of low-efficiency urban land and better revitalize existing land resources. Integrate all kinds of surveying and mapping matters in stages, promote unified surveying and mapping standards and results forms, and realize "one-time commission and results sharing" at the same stage. Optimize the approval process for major investment projects in accordance with the law, and pilot the commitment system for matters related to land use, environmental impact assessment and other investment approval matters, all levels and departments shall implement the commitment system based on their responsibilities and authority. Before the end of October 2022, a mechanism for connecting investment and financing information between the autonomous region's investment authorities and financial institutions will be established; before the end of November, standardized and standardized management measures for the approval of engineering construction projects; before the end of December, further improve the interconnection and information sharing level of the engineering construction project approval management system and the municipal public service enterprise system, and improve the quality of water, electricity, gas and heat access services. (13) Focus on optimizing cross-border trade services. Use various open platforms to improve the level of foreign trade facilitation and improve the capacity and efficiency of cross-border trade supporting services.Promote the application of the "customs clearance + logistics" and "foreign trade + finance" functions of the "single window" to provide enterprises with services such as customs clearance logistics information inquiry, export credit insurance processing, cross-border settlement and financing. Improve the efficiency of cross-border e-commerce services and promote convenient and rapid customs clearance. Before the end of 2022, online processing of import and export customs clearance business will be achieved at major ports in the autonomous region. Help enterprises make good use of Regional Comprehensive Economic Partnership Agreement and provide convenient and efficient application services for certificates of origin. Improve and perfect the functions of the "Mongolian Trade Connect" platform to provide foreign trade enterprises with all-round one-stop convenient services such as policy interpretation, logistics docking, trade financing, and export credit insurance. Carry out cross-border e-commerce public overseas warehouse cultivation and support public overseas warehouses to provide return and exchange services. (14) Effectively improve the level of tax payment services. Vigorously optimize the tax processing process, simplify the review procedures, combine online and offline and cross-provincial processing to facilitate market entities to pay tax services. Before the end of November 2022, 95% of tax and fee service matters will be "online handled"; before the end of December, paperless reimbursement, accounting, archive, storage, etc. for electronic invoices will be realized. Optimize the tax refund process for to ensure safe and fast direct access to taxpayers, and implement cross-provincial and off-site electronic tax payment and line postal and tax electronic warehouse payment services. Promote the paperless process of export tax rebates. (15) Continuously standardize intermediary services. Strictly regulate all types of intermediary services, establish a list of administrative licensed intermediary services in the autonomous region, rectify intermediary service behaviors that interfere with market entities, and clean up illegal charges for various intermediary services. Organize all departments of the autonomous region to sort out and publish a list of administrative licensing intermediary service matters at the autonomous region level, and on this basis, organize all regions and departments to sort out and publish a list of administrative power intermediary service matters in the entire region. Operate a unified online intermediary supermarket in the entire district, resolutely rectify the monopoly services of designated intermediary agencies by administrative agencies, and eliminate the charges for compulsory service of intermediary agencies. (16) Improve the precise directed mechanism for policies that benefit enterprises. Promote a comprehensive feedback mechanism for online and offline policies, promote the precise and direct delivery of policies that benefit enterprises, and ensure that policies that benefit enterprises are implemented in place. Before the end of 2022, the people's governments at or above the county level of the autonomous region and their relevant departments should set up special areas for benefiting enterprises on government portals, departmental websites, and government service platforms to gather policies for benefiting enterprises applicable to market entities in their regions and fields. Strengthen the sharing of information related to enterprises, achieve intelligent matching and rapid implementation of policies that benefit enterprises, set up a centralized processing window for policies that benefit enterprises in government service halls at all levels, and use the mobile service system to provide online management to ensure that all policies that benefit enterprises are implemented in place. 4. Further strengthen fair supervision and effectively protect the legitimate rights and interests of market entities
(17) Innovatively implement precise and effective supervision. Comprehensively promote "one-stop management" and form a new regulatory pattern of unified supervision platforms, mutual recognition and sharing of data, and joint logistics and orderly linkage. Implement cross-departmental joint "double random, one public" supervision, accelerate the establishment and improvement of credit grading and classification supervision systems in the fields of market supervision, tax management, import and export, and explore the use of modern information technology to implement off-site supervision in the fields of production safety, food safety, transportation, ecological environment, etc. (The relevant administrative law enforcement departments of the autonomous region and all leagues and cities are responsible according to their division of responsibilities)
(18) Strictly regulate supervision and law enforcement behavior.Comprehensively improve supervision transparency, timely disclose administrative penalties made in accordance with the law to the public, strive to improve the level of administration according to law, implement the "three systems" of administrative law enforcement (administrative law enforcement publicity, full process recording of administrative law enforcement and legal review system for major administrative law enforcement decisions), standardize law enforcement methods, improve law enforcement guidelines and standardized inspection forms, and prevent excessive law enforcement. Before the end of 2022, a list of three-level regulatory matters will be prepared and formed in the district will be urged to urge all regions and departments with regulatory responsibilities to promptly claim supervision matters and prepare supervision matters. Establish and improve the benchmark system for administrative discretion, resolutely eliminate "one-size-fits-all" and "movement-style" law enforcement, and strictly prohibit market entities from generally suspending production and business without legal procedures. Use the rule of law to ensure the fair competition status of market entities, fully implement the fair competition review system , strengthen anti-monopoly and anti-unfair competition law enforcement, investigate and punish malicious subsidies, low-price dumping, setting unreasonable transaction conditions and other behaviors in accordance with the law, crack down on counterfeiting and confusing behaviors such as "free ride" and "traffic" and "snap traffic", and strictly regulate the sluggish occupancy of operator deposits and transaction funds. Before the end of October 2022, a special action will be organized to stop the abuse of administrative power and eliminate and restrict competition law enforcement. Supervise false litigation of intellectual property rights, improve the management system of collective trademarks and certification trademarks, standardize the registration and use of collective trademarks of geographical indications, and resolutely curb malicious litigation or disguised collection of "membership fees" and "franchise fees". 5. Further standardize administrative power and effectively stabilize market entities policy expectations
(21) Continuously improve the policy formulation and implementation mechanism. Standardize the formulation process of various enterprise-related policies, establish a public policy formulation mechanism, strictly implement the requirements of soliciting public opinions and legality review; establish and improve a major policy evaluation and evaluation system, and strictly prohibit distorting national policies through disguised additions. All relevant departments shall formulate and implement administrative normative documents and policies on urban management, environmental protection, energy conservation and emission reduction, production safety, etc. They shall strengthen assessment and legality review to ensure the rationalization and scientific process of document and policy issuance, and shall not increase the burden on market entities at all levels. Do a good job in the disclosure of normative administrative documents related to enterprises and accept social supervision. Strengthen the filing, review and supervision of the enterprise-related administrative normative documents, urge relevant departments to strictly implement the document formulation procedures, and protect the legitimate rights and interests of market entities in accordance with the law. (22) Focus on strengthening the construction of government integrity. Improve the mechanism for keeping trustworthy government affairs, eliminate government affairs breach of trust, encourage all regions to explore the establishment of a coordination mechanism for the execution of government affairs integrity litigation, and promote the construction of an honest government. Before the end of 2022, the mandatory disclosure system for accounts not paid by small and medium-sized enterprises will be implemented, and the arrears will be included in the scope of government information proactive disclosure. Carry out centralized governance of the arrears of small and medium-sized enterprises, and the newly reported problems of the arrears of small and medium-sized enterprises in private enterprises and small and medium-sized enterprises found through new complaints, audits, supervisions, inspections and other channels will be carried out seriously in accordance with the " Regulations on the Protection of Payment of Small and Medium-sized Enterprises" and hold accountable for false reporting, false repayment and malicious arrears.(The Autonomous Region Department of Industry and Information Technology, Department of Finance, Higher People's Court, Development and Reform Commission, Department of Justice, Market Supervision Bureau and other relevant departments and units, as well as all leagues and cities, are responsible according to their division of responsibilities)

Strictly define the boundaries of administrative power, prohibit government departments from crossing boundaries and failing to perform their duties, build a government service platform, and strengthen social supervision. Give full play to the role of channels such as the 12345 government service convenience hotline, government service platform, and timely investigate and deal with the problems of inaction and random actions reported by market entities and the masses, and effectively strengthen social supervision. The Autonomous Region Development and Reform Commission should increase coordination and supervision efforts, and regard the implementation of this plan as an important part of the business environment assessment.
