Yao Zhijun was sentenced to one year in prison and a fine of 5,000 yuan for illegally killing precious and endangered wild animals. Wu Xiaoqiang and Yao Zhijun compensated for ecological and environmental damages totaling 6,000 yuan.
In addition, Wu Xiaoqiang and Yao Zhijun must make a public welfare publicity warning sign for metallic wildlife protection worth 4,000 yuan, and install it on site at the scene of the crime. At the same time, the two publicly apologized to the public on , Zunyi, municipal media.
After the first instance verdict was announced, Wu Xiaoqiang and Yao Zhijun agreed to the verdict for the civil public interest litigation and entrusted their family and lawyers to handle it on their behalf. But they appealed the criminal verdict part.

After trial, the court held that Wu Xiaoqiang and Yao Zhijun illegally hunted and killed precious and endangered wild animals, which were protected by the state. Wu Xiaoqiang's behavior constituted the crime of illegal hunting, killing precious and endangered wild animals, and Yao Zhijun's behavior constituted the crime of illegal killing precious and endangered wild animals.
Regarding the appeal reason mentioned by Yao Zhijun that " subjectively does not know that the animals caught are precious and endangered wild animals, and those who do not know will not be guilty of ", after investigation, Yao Zhijun realized that his behavior was illegal after learning that Wu Xiaoqiang had captured the wild animal Little Spiegel cat, but he still colluded with Wu Xiaoqiang to kill the Little Spiegel cat. He was at least laissez-faire about killing national key protected wild animals and had criminal intentions, so the reason for appeal could not be established.
Regarding the appeal reasons for Yao Zhijun's appeal, "If the case is truthful confessed, it should be determined that he surrenders." After investigation, according to the "case-taking process" issued by the public security organ, Yao Zhijun took the initiative to surrender to the public security organs after being notified by Wu Xiaoqiang before being taken to compulsory measures. After being arrested, it constituted surrender, and the first instance was notified by Wu Xiaoqiang, and the appeal reason was established.
However, when the procuratorate made a sentencing recommendation, it had considered the surrender of Yao Zhijun's sentencing circumstances. The sentencing recommendations made were not obviously improper, and Yao Zhijun also pleaded guilty and accepted punishment and signed the agreement, so the second instance of this was not considered as lighter.
Regarding the appeal reasons mentioned by Wu Xiaoqiang for "the elderly parents at home rely on their own care", after investigation, his family situation was found to be special and does not belong to the statutory or discretionary sentencing circumstances and is not related to this case. During the second trial, the defense lawyer submitted relevant materials to prove that the two had fulfilled their alternative ecological restoration obligations, such as apology, making propaganda signs, and paying compensation for damages. Considering the circumstances of the two of them, their attitude of confessing guilt, their remorse, and their repair effects, the two were given a lighter punishment.
On September 15, 2021, the final criminal ruling of Zunyi Intermediate People's Court made partial resentment. Wu Xiaoqiang was sentenced to one year and one month in prison and a fine of 6,000 yuan for illegal hunting and killing precious and endangered wild animals. Yao Zhijun was sentenced to ten months in prison and a fine of 5,000 yuan for illegally killing precious and endangered wild animals.
