Chapter 1 General Provisions
Article 1 In order to standardize the management of police auxiliary personnel, ensure the reasonable use of police auxiliary forces in accordance with the law, protect the legitimate rights and interests of police auxiliary personnel, and give full play to the assisting role of police auxiliary personnel in public security work, this Measures are formulated in accordance with relevant laws and regulations and the "Opinions of the General Office of the State Council on Standardizing the Management of Police Auxiliary Personnel in Public Security Organs" and other provisions, in combination with the actual situation of this province, this Measures are formulated.
Article 2 The police auxiliary personnel referred to in these Measures refer to staff who perform the auxiliary police duties stipulated in these Measures in accordance with the law, include the employment amount of police auxiliary personnel, and include the financial guarantees in the financial budget at this level, are managed and used by the public security organs, and do not have the status of a people's police officer.
Social defense and group prevention forces such as joint security defense, public security volunteers, village protection teams, and school protection teams, as well as personnel engaged in logistics services such as diet, security, and cleaning in public security organs are not police auxiliary personnel.
Article 3 Police auxiliary personnel are collectively referred to as auxiliary police. According to the nature, characteristics and management needs of auxiliary police, classified management is implemented and divided into service auxiliary police and civil auxiliary police.
Article 4 These Measures shall apply to the recruitment, performance of duties, rights, management, and protection of auxiliary police officers within the administrative area of this province.
The recruitment, rights, management and protection of auxiliary police officers who sign the employment contract shall be implemented in accordance with relevant national regulations.Auxiliary police recruited through labor dispatch and other means shall be implemented in accordance with these Measures.
Article 5 Auxiliary police do not have the qualifications to enforce the law and shall carry out auxiliary work under the command and supervision of the public security organs and their people's police.
The act of auxiliary police in assisting the people's police in the public security organs to perform their duties in accordance with the law is protected by law. Relevant units and individuals shall cooperate. The consequences of the act of performing their duties shall be borne by the public security organs where they are located. If an auxiliary police hinders the performance of their duties in accordance with the law or commits illegal infringement on the auxiliary police, the legal liability for the obstructor or infringer shall be pursued in accordance with the law.
Article 6 The quota for auxiliary police personnel in various places shall be consistent with the local social security situation, economic development level, population size, regional area, police force allocation and actual needs of public security work. It shall generally not exceed the total number of people's police in the public security organs at the same level. The specific equipment standards shall be approved and approved by the people's government at the same level.
Article 7 Under the unified leadership of local people's governments at or above the county level, the public security organs are mainly responsible for the recruitment, management and use of auxiliary police officers. The veterans affairs department is mainly responsible for the assessment of auxiliary police officers who meet the conditions for martyrs after death in office (work). The financial department is mainly responsible for the funding guarantee of auxiliary police officers. The human resources and social security department is mainly responsible for the determination of auxiliary police officers' salaries and the implementation of social security work such as work injury insurance.
Article 8 The public security organs of the provincial people's government are in charge of the management of auxiliary police in the province, and the public security organs of the people's governments of each city, county (city) are responsible for the management of auxiliary police in their jurisdiction, and the superior public security organs guide and supervise the management of auxiliary police in lower-level public security organs.
Auxiliary police management follows the principle of "who uses, who manages, and who is responsible".
Article 9 The public security organs of local people's governments at or above the county level shall clarify the auxiliary police management agency of the public security organs at the same level and be responsible for the management of auxiliary police; the employers of the public security organs are responsible for the daily management of auxiliary police.
Chapter 2 Responsibilities, Rights and Obligations
Article 10 Auxiliary police officers are responsible for assisting police officers in law enforcement positions in public security organs to carry out law enforcement and duty and other police activities. Perform the following responsibilities:
(I) Assist in preventing and stopping illegal and criminal activities;
(II) Assist in public security patrols, public security inspections and safety inspections in places where people gather;
(III) Assist in investigating, blocking, monitoring, and guarding suspects of illegal and criminal activities;
(IV) Assist in maintaining the order of the case (event) on the scene, protecting the scene of the case (event), and rescuing injured people;
(VII) Assist in traffic guidance, dissuading and correcting traffic safety violations, and collecting traffic violation information;

(7) Assist in the management and service of public security supervision sites;

(11) Assist in the recording of interrogation and inquiry records;
(12) Assist in the reception of reports, registration of cases, acceptance of evidence, collection of information, mediation, delivery of documents, etc.;
(13) Assist in the driving of police cars, motorcycles, boats, police aircraft and other means of transportation; independently driving other police auxiliary means of transportation;
(14) Other work that can be assisted by auxiliary police officers.
Article 11 Civilian auxiliary police are responsible for assisting people's police in non-law enforcement positions in public security organs to engage in administrative management, technical support, police guarantee and other work.Perform the following responsibilities:
(I) Assist in administrative management work such as document assistant, file management, wiring inquiry, window services, certificate processing, information collection and entry;
(II) Assist in technical support work such as psychological counseling, medical care, translation, computer network maintenance, data analysis, software research and development, security monitoring, communication guarantee, fund analysis, non-confidential financial management, laboratory analysis, on-site investigation, inspection and identification;
(III) Assist in police equipment storage, maintenance, logistics services, etc.;
(IV) Other work that can be done by civilian auxiliary police.
Article 12 Auxiliary police shall not engage in the following work:
(I) Domestic security, technical reconnaissance, anti-cult, anti-terrorism, etc.;
(II) Handling matters involving state secrets;
(III) Case investigation and evidence collection, issue appraisal reports, and identification of traffic accident liability;
(IV) Implement criminal compulsory measures;
(VII) Make administrative handling decisions;

(Nine) Work that must be carried out by the people's police of the public security organs stipulated by laws and regulations.
Article 13 Auxiliary police enjoy the following rights in accordance with the law:
(1) Obtain the necessary work and labor protection conditions for performing their duties;
(2) Obtain wages and remuneration and enjoy statutory benefits and insurance benefits;
(3) Participate in political theory learning and business knowledge training;
(4) Put forward opinions and suggestions on the work of the unit;
(5) Appeal for acts that infringe on their legitimate rights and interests in accordance with the law;
(6) Other rights stipulated by laws, regulations, rules and regulations and labor contract .
Article 14 Auxiliary police shall perform the following obligations:
(I) Abide by the Constitution, laws and regulations, rules and the management system of the public security organs;
(II) Keep state secrets and police secrets, use the public security information system in accordance with the authorization to ensure the security of the public security information network;
(III) Obey the management of the public security organs, obey the command of the people's police of the public security organs, and shall not perform police activities beyond their scope of duty;
(IV) Perform civilized duty, perform duties conscientiously, model abide by social morality, and respect social customs and habits;
(V) Other obligations stipulated by laws, regulations, rules and labor contracts.
Chapter 3 Recruitment
Article 15 The employment plan of auxiliary police shall be proposed by the public security organs of local people's governments at or above the county level in accordance with the relevant provisions on local economic and social development, social security situation and employment quota. After review by the organizational structure, finance and other departments at the same level, it shall be submitted to the people's governments at the same level for approval.
Article 16 The recruitment of auxiliary police shall be organized and implemented by the public security organs of local people's governments at or above the county level within the approved employment plan.

Article 18 Auxiliary police shall meet the following conditions:
(I) Have the nationality of the People's Republic of China;
(II) Support the Constitution of the People's Republic of China, abide by national laws and regulations, and have good conduct;
(III) Being eighteen years old;
(IV) Have the education level of high school or above and the work ability required to perform job responsibilities;
(VII) Have the physical and mental conditions for normal performance of duties;
(VIII) Have other qualifications required for the proposed position.
Among them, civil servant auxiliary police should have a college degree or above.
Special and professional police auxiliary positions can be appropriately reduced or raised in the conditions stipulated in the first two paragraphs, but the reasons should be indicated in the recruitment announcement.
Article 19 Personnel who have any of the following circumstances shall not be recruited as auxiliary police officers:
(I) Those who themselves or family members or close relatives participate in illegal organizations, cult organizations or engage in other activities that endanger national security;

(III) Those who have been subject to criminal punishment or suspected of committing illegal crimes have not been found out;

(V) Those who have been punished for drug use, prostitution, and gambling;
(VI) Those who have been administratively detained, judicially detained or sheltered and educated;
(VI) Those who have been revoked from the professional certificate of lawyers and notary officers;
(VI) Those who have been expelled from public office, expelled from military service, or have been expelled, dismissed or dismissed for violations of discipline and regulations;
(9) Those who have resigned without authorization before the contract for police assistance;
(10) Those who have a serious personal bad credit record;
(11) Others who are not suitable for police assistance.
Article 20: Recruiting auxiliary police shall be implemented in accordance with the procedures such as issuing recruitment announcements, registration qualification reviews, examination inspections, physical fitness assessments, physical examinations, political assessments, and public announcements. The recruiting agency should take measures to facilitate citizens to apply for the exam.
According to the nature and characteristics of the job, the recruitment procedures specified in the preceding paragraph can be simplified or adjusted. For positions with high professional requirements, other evaluation methods can be used.
Article 21 When recruiting auxiliary police officers, a labor contract or employment contract shall be signed in accordance with the provisions of relevant national laws and regulations.
The conclusion, performance, change, termination or termination of a labor contract or employment contract shall be carried out in accordance with the provisions of relevant national laws and regulations.
Article 22 The newly recruited auxiliary police implements a probation period system, and the probation period is implemented in accordance with the provisions of relevant national laws and regulations. If the trial is qualified, the level shall be determined in accordance with relevant regulations; if the trial is unqualified, the labor (personnel) relationship shall be terminated or returned to labor dispatch unit .
Chapter 4 Level promotion
Article 23 Auxiliary police are divided into 7 levels, from high to low: first-level auxiliary police officer, second-level auxiliary police officer, third-level auxiliary police officer, first-level auxiliary police officer, second-level auxiliary police officer, third-level auxiliary police officer, and fourth-level auxiliary police officer.
Article 24 The promotion of auxiliary police level is carried out in accordance with management authority, promotion conditions and prescribed procedures. When the auxiliary police are promoted to the level, they should have the corresponding qualifications such as ideological and political qualities, professional abilities, work qualifications, work performance and annual assessment, and organize and implement them within the approved level quota.
Article 25 The auxiliary police management departments of public security organs at or above the county level shall regularly organize and carry out hierarchical promotion work every year, and the levels of auxiliary police should be promoted step by step in principle. Adhere to the principles of openness, fairness and justice, performance priority, and ability focus.
Article 26 The level of auxiliary police is the basis for determining the salary and other benefits of auxiliary police.
Chapter 5 Management
Article 27 Public security organs of local people's governments at or above the county level shall establish and improve the post responsibilities, education and training, assessment and attendance and confidentiality management of auxiliary police, and strengthen the management of auxiliary police. At the same time, it is necessary to establish and improve the exit mechanism of auxiliary police to ensure smooth exit channels.
Article 28 The public security organs of local people's governments at or above the county level shall include the education and training of auxiliary police in the team's education and training plan, carry out pre-job training, promotion training and business training for auxiliary police, and improve the quality of auxiliary police.
The auxiliary police management agency of the public security organs of local people's governments at or above the county level is responsible for the organization and implementation of auxiliary police education and training.
Article 29 Pre-job training is an induction training for newly recruited auxiliary police officers.The pre-job training time is no less than 15 days. The training content mainly includes professional ethics, basic business knowledge, basic job skills, basic legal knowledge, auxiliary police work authority, work process standards, etc., focusing on cultivating loyalty awareness, service awareness, confidentiality awareness and basic professional qualities. Only after passing the examination and assessment can he/she perform his/her corresponding job responsibilities.
Article 30 Promotion training is training for auxiliary police officers at the promotion level. The promotion training time is no less than 7 days. The training content is set according to the target promotion target and work needs, focusing on improving comprehensive abilities, and can be organized in conjunction with business training. Auxiliary police who have participated in promotion training will no longer participate in the business training of that year.
Business training is a training conducted by police types and departments according to the job responsibilities of auxiliary police officers. The total time for auxiliary police to participate in business training is no less than 7 days per year. The training content is set according to the job responsibilities of the auxiliary police, mainly including relevant policies and regulations, basic business knowledge, professional skills and physical fitness, psychological behavior training, etc., focusing on cultivating professional qualities, strengthening knowledge and skills updates, and improving work ability.
Article 31 The public security organs of local people's governments at or above the county level shall regularly assess the work performance, compliance with rules and regulations, education and training of auxiliary police officers.
Article 32 The results of regular assessment are divided into four levels: excellent, qualified, basic qualified and unqualified.
Assessment results are used as the main basis for level upgrades, rewards and punishments, renewal, termination of labor (personnel) relations or return to labor dispatch units.
Article 33 When assisting in the process of police, auxiliary police shall avoid any of the following circumstances:
(1) involves his or her own interests;
(2) involves his or her own interests;
(3) Others that may affect the fair execution of police auxiliary activities.
The avoidance stipulated in the preceding paragraph shall be decided by the auxiliary police management agency of the public security organ to which it belongs.
Article 34 Any unit or individual has the right to complain to the public security organs to report suspected violations of laws and disciplines by the auxiliary police.
Public security organs of local people's governments at or above the county level shall establish and improve complaint and reporting acceptance and feedback systems, open up complaint and reporting channels, and handle complaints and reports against auxiliary police in accordance with the law.
Chapter 6 Treatment Guarantee
Article 35 People's governments at all levels shall include the recruitment, salary and welfare of auxiliary police, daily operation public funds, education and training, equipment purchase, clothing, rewards, insurance, pensions, and work operation required by the financial budget at the same level to ensure the financial budget.
Article 36 The salary structure and benefits of auxiliary police shall be stipulated by the public security organs of the provincial people's government in conjunction with the provincial finance, human resources and social security departments. The specific standards shall be determined by each region in reference to the average salary of local on-the-job workers in the previous year, combined with the local economic and social development level and financial situation, and a dynamic adjustment mechanism shall be established.
The salary standards for auxiliary police officers in special and professional positions should be consistent with the work they are engaged in.
Article 37 Employers shall handle basic pension, basic medical care, work-related injuries, unemployment, maternity and other social insurance for auxiliary police in accordance with the law, and pay housing provident fund. It is encouraged to handle personal accident insurance for auxiliary police officers in front-line who assist in law enforcement and duty and high-risk positions, and establish a green channel for emergency treatment for office (work) injuries in accordance with the situation.
Article 38: Employers shall regularly organize auxiliary police officers to participate in health examinations and establish health records.
Article 39 The holidays and related treatments enjoyed by auxiliary police shall be implemented in accordance with relevant national and provincial regulations.
Article 40 The public security organs of local people's governments at or above the county level and other relevant departments shall commend auxiliary police officers who have performed outstandingly, made significant achievements and made outstanding contributions in protecting public property and the safety of people's lives and property, preventing and stopping illegal and criminal activities, etc., in accordance with relevant national regulations. A particularly outstanding auxiliary police officer who is applying for the position of the people's police in the public security organs should be given appropriate care.
Article 41 If an auxiliary police officer is injured, disabled or died due to work, he shall enjoy relevant benefits in accordance with the "Work Injury Insurance Regulations" and other relevant provisions; if he is rated as a martyr, his family shall enjoy the benefits stipulated in the "Martyrs Commendation Regulations".
Article 42 Auxiliary police shall issue unified work documents, dress uniformly in accordance with regulations, and take up a job with a certificate. Their work documents, clothing styles and logos shall comply with relevant regulations of the Ministry of Public Security.
When the auxiliary police resigns, they shall return the issued work documents, clothing, logos and equipment.
Article 43 The public security organs of local people's governments at or above the county level may equip auxiliary police with necessary duty and safety protection equipment according to the work needs of their posts, but shall not equip or use weapons.
Chapter 7 Legal liability
Article 44 If the public security organs and their people's police violate the provisions of these Measures, they shall be dealt with in accordance with relevant regulations; if suspected of committing a crime, they shall be transferred to the judicial organs for handling in accordance with the law.
Article 45 If an auxiliary police violates relevant laws and regulations and the provisions of these Measures, they shall be dealt with accordingly in accordance with the relevant provisions of the "Discipline Regulations of the People's Police of Public Security Organs"; if the circumstances are serious, the labor (personnel) relationship shall be terminated in accordance with the law or returned to the labor dispatch unit; if suspected of committing a crime, they shall be transferred to the judicial organ for handling in accordance with the law.
Article 46 The public security organs shall handle auxiliary police officers with clear facts, conclusive evidence, legal procedures, and complete procedures. The auxiliary police officers in question have the right to make statements and defenses.
Article 47 If an auxiliary police officer has a labor dispute with the employer, it shall be handled in accordance with relevant national and provincial regulations.
Chapter 8 Supplementary Provisions
Article 48 The public security organs of the provincial people's government may formulate specific implementation rules in accordance with these Measures and in combination with the actual situation of public security work.
Article 49 This Measures shall come into force on the date of publication. After the implementation of this Measures, if other provisions are made by the superior authorities, they shall be implemented in accordance with such provisions.

Article 1 In order to standardize the recruitment of auxiliary police officers in our province, this implementation rule is formulated in accordance with the "Opinions of the General Office of the State Council on Standardizing the Management of Police Auxiliary Personnel in Public Security Organs".
Article 2 This implementation rules apply to the recruitment of auxiliary police officers for the public security organs of local people's governments at or above the county level in our province to sign labor contracts. The recruitment of auxiliary police officers for signing employment contracts is carried out in accordance with relevant national regulations. Auxiliary police recruited through labor dispatch and other means shall be implemented in accordance with these Measures.
Article 3 Public security organs should adhere to the principles of openness, equality, competition and selection of the best, conduct the examination and inspection in accordance with the standards that meet the needs of the job, and sign labor contracts or employment contracts in accordance with relevant national laws and regulations.
Article 4 The recruitment of auxiliary police shall be organized and implemented by the public security organs of local people's governments at or above the county level in accordance with the approved employment plan within the auxiliary police employment quota.
Article 5 The auxiliary police management agency of the provincial people's government is responsible for the comprehensive management of the recruitment of auxiliary police in the public security organs in the province; guides and supervises the recruitment of auxiliary police in the lower-level public security organs; and is responsible for the recruitment of auxiliary police in the public security organs at the same level.
The auxiliary police management agency of the public security organ of the prefecture-level municipal people's government is responsible for guiding and supervising the recruitment of auxiliary police officers of the county-level people's government; responsible for the recruitment of auxiliary police officers of the public security organs at the same level.
The auxiliary police management agency of the county-level people's government is responsible for the organization and implementation of the recruitment of auxiliary police officers in the public security organs at the same level.

(VI) Those who have been administratively detained, judicially detained, or sheltered and educated;

(8) Those who have been expelled from public office, expelled from military service, or have been expelled, dismissed or dismissed for violations of discipline and regulations;
(9) Those who have resigned without authorization before the contract for police assistance;
(10) Those who have a serious personal bad credit record;
(11) Others who are not suitable for police assistance.
Article 11 The applicant shall submit application materials to the auxiliary police management agency, and the application materials submitted by the applicant shall be true and accurate.
The auxiliary police management agency reviews the application application based on the application qualification conditions, confirms whether the applicant is qualified to apply within the specified time, and can join the psychological evaluation process as appropriate.
Article 12 The auxiliary police recruitment examination can be conducted in a written test or interview manner. For positions with higher professional requirements, professional skills tests can be tested or other evaluation methods can be used.
Article 13 The content and standards of the auxiliary police recruitment examination should meet the job needs and meet actual needs.
Article 14 The examination results and results are announced to applicants through websites, written notices, etc.
Article 15 The items and standards for physical examinations and physical fitness assessment are determined according to the position needs. Physical examination items and standards, physical fitness assessment items and standards shall be formulated by the public security organs of the provincial people's government in conjunction with relevant departments.
Article 16 The inspection content mainly includes the applicant's political thoughts, moral qualities, ability and quality, study and work performance, compliance with laws and regulations, integrity and self-discipline.
Article 17 The political assessment is conducted in accordance with the relevant requirements of the political assessment of the people's police of the public security organs, and the focus is on whether there are cases where the auxiliary police are not allowed to be recruited.
Article 18 The auxiliary police management agency of the public security organs of local people's governments at or above the county level shall propose a list of personnel to be hired based on the examination results, physical examination, inspection and political assessment of the applicants and make public to the public.
The public announcement period is no less than 5 working days.
Article 19 If the public announcement result does not affect the employment, the employer shall sign a labor contract or employment contract with the hired auxiliary police within one month of the expiration of the announcement period, and conduct employment filing in accordance with relevant regulations.
After the labor contract or employment contract is signed, the public security organs of the municipal people's government of prefecture-level municipal people's government shall submit the list of auxiliary police to the auxiliary police management agency of the provincial people's government for filing within 10 days; the public security organs of the county-level people's government shall submit the list of auxiliary police to the auxiliary police management agency of the provincial people's government for filing within 20 days.
Article 20 The newly recruited auxiliary police implements a probation period system, and the probation period is implemented in accordance with relevant national laws and regulations.
If the trial is qualified, the level shall be determined in accordance with relevant regulations. If the probation fails, the labor (personnel) relationship shall be terminated or returned to the labor dispatch unit. The list of personnel who terminate labor (personnel) relations or return to labor dispatch units shall be submitted to the auxiliary police management agency of the public security organ of the provincial people's government for filing step by step.
Article 21 The employment of auxiliary police must actively accept social supervision. The auxiliary police management agencies of public security organs at all levels shall promptly accept relevant reports and handle them according to management authority.
Article 22 If any of the following circumstances occurs, the auxiliary police management agency of the public security organ of the people's government at or above the prefecture shall be ordered to correct or declare invalid according to the circumstances, depending on the circumstances; those who are responsible for leadership and are directly responsible shall be criticized and educated, transferred from the auxiliary police management position or punished according to the severity of the circumstances; if a crime is constituted, criminal liability shall be pursued in accordance with the law:
(1) If the employment is not carried out according to the prescribed employment limit, employment plan and position requirements;
(2) If the employment is not carried out according to the prescribed qualification conditions and procedures;
(3) After the approved recruitment announcement is issued, the recruitment policy is issued and changed without authorization, causing adverse effects;
(4) If favoritism and fraud in the recruitment work, the circumstances are serious.
Article 23 If a person engaged in recruitment has one of the following circumstances, he shall be transferred from the recruitment position or given corresponding administrative sanctions depending on the severity of the circumstances; if a crime is constituted, criminal liability shall be pursued in accordance with the law:
(I) Leaking test questions or other confidential recruitment information;
(II) Using work convenience to forge examination scores or other materials related to recruitment work;
(III) Using work convenience to assist applicants in cheating;
(IV) Responsible for recruitment work re-run due to work dereliction of duty;
(V) Other acts that violate recruitment work discipline.
Article 24 Applicants who violate recruitment discipline will be given criticism and education depending on the severity of the circumstances, and the qualifications for examinations, physical examinations, inspections, and political assessments will be cancelled, and the employment (personnel) relationships or returned to the labor dispatch unit will not be employed. Among them, those who commit serious violations of recruitment discipline such as fraud shall not apply for auxiliary police officers of the public security organs. If a crime is constituted, criminal liability shall be pursued in accordance with the law.
Article 25 These implementation rules shall come into effect on the date of publication.
