Hello, everyone is responsible for epidemic prevention and control. The legal liability for refusing to accept the prevention and control measures of the novel coronavirus pneumonia epidemic is hereby notified as follows:
1. In accordance with Article 12 of the " Law on the Prevention and Control of Infectious Diseases of the People's Republic of China", all units and individuals in the field of in the of the People's Republic of China must accept prevention and control measures such as investigation, inspection, sample collection, isolation and treatment of infectious diseases by disease prevention and control institutions and medical institutions, and provide relevant information truthfully.
2. In accordance with Article 44 of the " Emergency Regulations on Public Health Emergencies ", patients, suspected patients and infectious patients who need to undergo isolation treatment and medical observation measures in emergencies shall cooperate when taking medical measures by the health administrative department or relevant institutions. If you refuse to cooperate, the public security organs will assist in compulsory enforcement in accordance with the law.
3. In accordance with Article 39, Paragraph 2 of the "Law of the People's Republic of China on Prevention and Control of Infectious Diseases", if the public security organs may assist the medical institution in taking compulsory isolation and treatment measures.
4. Confirmed patients or asymptomatic infected persons refuse to isolate treatment or leave the isolation treatment without authorization before the quarantine period, and enter public places or public transportation; suspected patients refuse to be isolated and treated without authorization before the quarantine period, and enter public places or public transportation, causing the spread of the new coronavirus and endangering public safety, shall be convicted and punished for endangering public safety by dangerous means in accordance with Article 114 and Article 115, paragraph 1 of the Criminal Law of the People's Republic of China.
5. If the people's governments at or above the county level and disease prevention and control agencies refuse to implement the prevention and control measures such as investigation, inspection, sample collection, isolation and treatment proposed by the People's Governments at or above the county level in accordance with the Infectious Disease Prevention and Control Law, and cause the spread of the epidemic or there is a serious risk of transmission, they shall be convicted and punished for the crime of hindering the prevention and control of infectious diseases in accordance with Article 330 of the Criminal Law of the People's Republic of China.
6. If violence and threats are used to hinder state organ staff from performing epidemic prevention, quarantine, compulsory isolation, isolation treatment and other measures taken by law to prevent and control the epidemic, they shall be convicted and punished for obstructing public service in accordance with the provisions of Article 277, paragraph 1 and paragraph 3 of the Criminal Law of the People's Republic of China. Those who violently attack people's police who are performing their duties in accordance with the law shall be convicted and punished for the crime of attacking police officers in in accordance with Article 277, paragraph 5 of the Criminal Law of the People's Republic of China. If a crime has not yet been committed, administrative penalties shall be imposed in accordance with Article 50 of the " Public Security Administration Punishment Law of the People's Republic of China" in accordance with Article 50.
7. The staff of state organs referred to in this notice include those who engage in official duties in organizations that exercise state administrative powers related to epidemic prevention and control in accordance with the law, and those who engage in official duties in organizations that exercise epidemic prevention and control on behalf of state organs entrusted by state organs to exercise epidemic prevention and control powers on behalf of state organs.
