At around 20:30 on January 12, 2018, the defendant Lan and the defendants Su Mourong and Huang Moucheng took the victim Zhong Mouxiang away and beat him in the Metropolitan Internet Cafe on Beining Street, Xingning District, Nanning City. The three defendants held the victim hostage and asked the victim to "repay money" by making the victim "repay money". Later, the defendant Lan threatened the victim's mother to give money by phone and obtained 7,850 yuan in property.
At around 0:00 on January 14, 2018, the defendants Lan, Liang, and Su Mourong took away the victim Chen Mouliang in the Metropolitan Internet Cafe and fabricated the victim "owed the company money" and threatened to "repay money". Later, the defendant directly used the victim's mobile phone to borrow 2,600 yuan online and transferred it to his account. At around 5 a.m., the defendants Lan and Liang took the victim Chen Liang to a hotel to check in and continue to guard the victim. The defendant Hu Mouqiang went to the hotel room at around 9 a.m. that day to assist in guarding the victim. At around 14:00 on the same day, the victim had to leave after he was unable to continue applying for a loan due to the victim's mobile phone.
From January 15 to 22, 2018, the defendant Lan took advantage of the victim Chen Mouliang's fear to ask the victim to transfer money to "repay money", borrow money from the victim, ask the victim to provide the account and password, and ask the victim to scan the QR code, etc., to ask the victim to ask the victim to ask the victim to make a total of RMB 8,000.
At around 1:00 on January 20, 2018, the defendants Lan, Liang, Hu, and Wei Mouning forcibly took the victim Zhang Moudi away and asked to "repay the money" in the Metropolitan Internet Cafe. Due to the revolt of the victim, the defendants Lan, Liang, Hu, and Wei Mouning beat the victim. During this period, the defendant Wei Mouning robbed the victim's mobile phone worth RMB 1,720.
The court held that the defendants Lan, Su Mourong and Huang Moucheng kidnapped others for the purpose of extorting property and obtained RMB 7,850 of property. Their behavior violated the provisions of Article 239, paragraph 1 of the Criminal Law of the People's Republic of China and constituted the crime of kidnapping; the defendants Lan, Liang Moufa, Su Mourong, Hu Mouqiang, and Wei Mouning robbed the victim's property by violence, coercion and forcibly restricting personal freedom. Their behavior violated the provisions of Article 263 of the Criminal Law of the People's Republic of China and constituted the crime of robbery; the defendant Lan Mou extorted the property of the victim Chen Mouliang, totaling RMB 8,000, with a large amount. Their behavior violated the provisions of Article 274 of the Criminal Law of the People's Republic of China and constituted the crime of extortion. The defendants in this case, Lan Mou, Su Mourong, Huang Moucheng, Liang Moufa, Hu Mouqiang and Wei Mouning, jointly committed crimes on many occasions that seriously endangered social order and disrupted social life order. They are crimes committed by evil forces and should be severely punished.
Finally, the court made the above judgment in accordance with the law based on the facts, nature, circumstances of the defendant's crime and the degree of harm to society.
