
Hunan Court Network News On July 18, a pilot work on-site promotion meeting for the "Online Data Integrated Processing" for road traffic accident damage compensation disputes in some areas of Hunan was held in the Wangcheng District Court of Changsha. As the first batch of pilot courts for this reform, Wangcheng Court has mediated 79 cases through the mediation center on March 21, 2019, and the total amount of successful mediation has reached more than 2.77 million yuan. The appeal rate of the Traffic Circuit Court dropped from 12.42% in 2018 to 3.78% in the first half of 2019; the average trial period was shortened from 51.6 days in 2018 to 41.7 days in 2019.
Starting from the end of 2016, Wangcheng Court organized four insurance companies, including Ping An Insurance and PICC Property and Casualty Insurance, China United Property and Casualty Insurance, and held a symposium on litigation and mediation work for insurance disputes in road traffic accidents. It discussed hot issues such as low insurance claims standards, complicated procedures, and long judicial appraisal time, and established a litigation and mediation docking mechanism to give full play to the advantages of professionalism, convenience and low-cost, and reached a partial consensus on issues such as compensation standards and evidence identification guidelines.
At the end of July 2018, Wangcheng Court, based on the "three-in-one" model of resolving road traffic disputes by forming the Traffic Circuit Court, the Traffic Police 122 Accident Squadron, and the Judicial Bureau's People's Mediation Office, jointly participated by the Municipal People's Insurance Property Insurance Company to introduce the "Online Data Integrated Processing" platform software for road traffic disputes. Successfully shared data and mediated several insurance claims disputes for road traffic accident damage compensation, and obtained quick claims .
In March 2019, Wangcheng Court, Wangcheng Branch of Changsha Public Security Bureau, Wangcheng District Justice Bureau and Hunan Insurance Industry Association jointly issued a document to implement the joint meeting system for the pilot work of the "Online Data Integration" Mediation Center for Road Traffic Accident Disputes in Wangcheng District, Changsha. The main responsibilities of each main unit were clarified, and the "six-in-one platform" data for traffic police to improve the traffic accident damage compensation disputes, the joint mediation work process of the insurance industry mediation pre-order and the people's mediator of the Judicial Bureau, and the unified scope of case acceptance and localization standards applicable to various compensation projects in mediation.
Mediation Center adheres to the work concept of "mediation in accordance with the law, fairness and credibility, efficient service, and mutual understanding and mutual concession". It has now achieved the online collection of information about the parties involved in road traffic accidents in the "National Court Road Traffic Accident Damage Compensation Dispute Pre-trial Mediation Platform" for some traffic accident cases, and supports all parties to carry out claims trial calculations, online mediation, judicial confirmation mediation agreements, one-click claims settlement, etc. At the same time, it also expands the provision of consulting services such as inquiry of accident vehicle insurance information, insured company entity information, insurance types and insurance amounts, insurance periods, etc.; inquire about insurance company claims, litigation handlers and contact information; and other consultation services related to disputes.
Hunan is the 10 regions in the country that have carried out online integrated processing in accordance with the spirit of the notice determined by the Supreme People's Court. On October 22, 2018, the Hunan High Court formulated and issued the "Plan for Promoting the Pilot Work of "Integrated Online Data Processing" for Compensation Disputes on Damage Compensation for Road Traffic Accidents", and identified four courts, namely, the People's Court of Wangcheng District, Changsha City, Hengyang County, Hengyang County, Xiangxiang City, and Huayuan County People's Court as pilot courts. On June 24 this year, the Hunan High Court formulated and issued the "Notice on the Pilot Court for the "Integrated Online Data Processing" for Compensation Disputes on Road Traffic Accidents", increasing the number of pilot courts to 24.
Hunan High Court requires that it is necessary to strengthen organizational leadership, make careful arrangements and deployments; pay attention to standardized guidance, adhere to problem-oriented approach; strengthen publicity and guidance, form a joint force for dispute resolution, and steadily advance this work, so as to achieve "more data to run, less errands for the masses", promote the socialization, legalization, intelligence and professionalization of road and traffic dispute governance, so that the people can truly feel fairness, justice, efficiency and convenience in specific dispute handling, and create a social governance pattern of co-construction, co-governance and sharing.
