Silicosis is a type of pneumoconiosis. It is an occupational disease that coal miners who have been operating underground for a long time are prone to occurrence, and it is also a type of work-related injury. Not long ago, the state-owned coal mine Yangershan Coal Mine, a subsidiary of , Changde City, Hunan Province, was closed. The Changde Municipal Finance Department distributed more than 8 million yuan to issue a one-time disability subsidy to patients with work-related injuries and occupational diseases that had previously retired in coal mine enterprises. . However, some workers who have been working underground for a long time and suffer from silicosis and found that their names are not on the subsidy list. On the contrary, some workers who rarely go to the mine have received subsidy, which is full of doubts.

Yangershan Coal Mine is a state-owned coal mine under Changde City, Hunan Province. In 2017, due to resource depletion and ecological environment protection, the Changde Municipal Government decided to shut down the company. After the shutdown was over, at the end of 2018, the municipal finance decided to pay a sum of money to issue a one-time subsidy to employees who retired from the enterprise.

According to Article 35 of the "Work Injury Insurance Regulations" in my country, if an employee is identified as a first-level to fourth-level disability due to work, a one-time disability allowance must be paid from the work-related injury insurance fund according to the disability level, and the amount of the subsidy shall be based on the injury amount. Different levels of disability are paid, 21 to 27 months of salary. According to this standard, the workers in this coal mine can receive a subsidy of more than 8,000 yuan to more than 10,000 yuan.

Most of the workers in coal mine enterprises are identified as work-related injuries due to silicosis occupational disease. Most of them work on the front line of the mine for a long time. Being silicosis means pneumoconiosis, which blocks the alveolar difficulty in breathing. Once the disease develops into the second stage of silicosis, it will be He basically lost his ability to work and could only rest at home. The workers were very happy to hear that the government was going to issue them this work-related injury allowance, but the subsequent public announcement list published on the coal mine bulletin board made it difficult for them to understand.
Li Kuanyue is 65 years old and has worked in the front line of Yangershan Coal Mine for nearly 30 years. She retired in 2001 due to phase 2 of silicosis. Silicosis has damaged his body. For more than 20 years, he has had to recuperate at home and live on his pension. He originally had great hope for this subsidy, but he was not listed. Why is this?

Tan Yunlong, the old work injury management section of Changde Municipal Human Resources and Social Security Bureau in Hunan, told reporters: "If you are injured by work injury before September 30, 1996, and if you are injured by work injury, it is in accordance with the provisions of the 1951 Work Injury and Labor Insurance Regulations of the State Council. The work-related injury benefits project is enjoyed, but the labor insurance regulations of 1951 did not clearly establish the one-time disability allowance benefit project. "
It turns out that in 1996, the former Ministry of Labor issued Document No. 266, the document was the first. It was mentioned that a one-time work-related injury subsidy would be issued to people with disabilities in work-related injuries. Therefore, September 30, 1996 became an important node, and the work-related injuries that occurred before this were not within the scope of this compensation. It should be said that this is a time node formulated based on relevant national laws and regulations, and it is also reasonable. So how is the occurrence time of occupational diseases calculated? There are also clear provisions on this regulation.

Tan Yunlong said: "When the diagnosis report of occupational disease comes out, that day is equivalent to the time of the work-related injury."
Li Kuanyue's occupational disease certificate shows that in November 1997, Changde City Occupational Disease Appraisal Committee diagnosed him with stage 2 silicosis of occupational disease in November 1997. . It is said that he meets the standard for issuing one-time work-related injury subsidy this time, but why did he say that his work-related injury time occurred before September 30, 1996 when the subsidy was issued?
After repeated inquiries, he learned that the reason lies in his file. There is a key document in his personal file called the "Hunan Province Enterprise Employee Labor Capacity Assessment Form", which reads: In 1997, it was identified as a second phase of silicosis by the Municipal Pneumoconiosis Appraisal Institute. Here is a sentence below. In October 1998, the local medical technology appraisal team issued an opinion: The comrade was diagnosed with stage 2 silicosis and it is recommended to withdraw the treatment according to occupational disease. This proves that Li Kuanyue's work-related injury occurred after September 30, 1996, and it met the requirements for receiving subsidies. However, two rows of small words were added to the top and bottom of the form: the 1980 Census was the first issue. Silicosis. The 1994 census was phase 2 silicosis. Based on this, staff from the Municipal Human Resources and Social Security Bureau believe that this shows that Li Kuanyue may have been diagnosed with an occupational disease before 1996.Now no one can explain who added these two rows of small characters and why they were added. In this way, despite the lack of information and the files are full of suspicions, although these old workers are holding the occupational disease certificate issued in 1997, they are still excluded this time the subsidy issuance.

Like Li Kuanyue, there are about dozens of front-line workers who retired at the same time as him. There are confusing situations in the files and they are excluded. From this point of view, the conditions for issuing work-related injury subsidies this time are particularly strict and will not be considered if there are any doubts. However, some old workers have reported that some people have doubts about their experiences on the list of subsidies.
According to the workers, many of the more than 500 people on the subsidy list have not gone down the well at all, and it is even less likely that they are silicosis patients. Judging from the experience of treating these old workers, the process of identifying subsidies this time is very strict. If these people are not patients with occupational diseases, how could they pass the review?
reporter then launched a further investigation. Taking an employee named Liu in the table as an example, according to the materials, he is an occupational patient with stage 2 of silicosis. Generally speaking, if you suffer from silicosis, you must have many years of history of direct mining of coal underground and direct contact with dust. The reporter and staff from the Human Resources and Social Security Bureau checked the employee's personal information together. In the file of an employee named Liu, there is an occupational disease diagnosis report, which says that he has a history of 14 years of underground mining. However, if you look closely at the archives, he graduated from accounting school in 1987 and has been an accountant in the supply and marketing department of the coal mine. In another salary list, his job type was changed to digging.

is not only this person, but the reporter then reviewed the information of many people on the list, and the situation is similar. An employee named Li has an occupational disease diagnosis document for Phase 2 of silicosis in the file, which states that he has a history of 20 years of underground mining. However, according to the information in the mine, he came to the mine to work in 1981 and has been engaged in logistics administration for a long time. He has worked as a projectionist, store manager, etc., where did the history of underground mining in the past 20 years come from? It can be clearly seen in his salary list that there are obvious traces of modification in the job type column, which was changed to a digging worker, and the work of the projectionist was changed to a gunfireman.
In response to this, Tan Yunlong said: "I can only evaluate that his file management is very irregular. Why is his situation different from the information in the occupational disease diagnosis report form? This is explained by the company, but I can't explain it."
Human Resources and Social Security Bureau The cadres said they could not explain the contradiction. The reporter contacted the employee surnamed Li and the employee surnamed Liu by phone, hoping to find out whether they had been working underground for a long time, but received no response. The other party hung up the phone.
After verification by reporters, many of these silicosis retirees who received subsidies are indeed inconsistent with the real situation. In fact, the staff did not pursue these contradictions and investigated them to the end. So how did the occupational disease diagnosis report as key evidence be released? The reporter then went to Changde City Occupational Disease Control Institute to learn about the situation.

It is understood that before 2009, the authenticity of some occupational disease diagnosis could not be ensured due to the lack of strict verification of ID cards and strict investigation of occupational history. Fan Guohua, director of the Occupational Disease Control Institute in Changde, Hunan, recalled that there were indeed some cases of artificially creating silicosis by using early retirement policy: "He was driven to society at once, and he had no source of income. He might have taken some other cases at that time. ”
Some employees who handled the ill-retirement in advance at that time were also included in the scope of subsidy. Despite receiving the grant, some of them are not clear about their silicosis.
reporter asked: "At that time, did you say you were in stage 2?" A retired employee of a certain disease said: "I really don't understand this." The reporter asked: "Do you know whether you are a stage 1 or a stage 2?" The retired employee of the disease answered: “I really don’t understand this."
There are so many obvious contradictions. What exactly does the competent department responsible for the closure of coal mines require the subsidy verification process?

Fu Fengyi, executive deputy director of the special working group office of the State-owned Enterprise Reform in Changde City, Hunan, said: "In fact, we Based on some legally effective occupational disease diagnosis documents, it also pays attention to whether they are occupational diseases and whether they become a chain of evidence. Therefore, we have a complete set of things, even wage lists, and even related things from the Safety Supervision Bureau for work-related accidents. What role is he a safety accident, etc., and do his best to ensure its authenticity. "
If it really does what the director said, how could such people who falsified files receive subsidies this time? It is understood that in order to completely solve the problem of closure of Yangershan Coal Mine, Changde City also set up a special task force, but the task force did not carefully check these obviously fake files.

Changde City Yangershan shutdown task force captain Wu Zhongfu said: "My job is to find out the situation and contact the city. The department reports are not required to identify them. They are all things in my archives. What basis do I have to question the authenticity of his archives? "How many employees who should receive
but cannot receive the subsidy are still subject to investigation by local relevant departments. However, according to the results of the reporter's investigation, the local area is determining who should receive who should not receive it. On the issue, the work should be meticulous, meticulous, and more meticulous, people-oriented, and justified. There should be a standard for disability subsidies. Since the standards are drawn, doubts should not be left out, and the standards should be stained. ;Not only can people take advantage of loopholes, nor can they let employees who are really suffering from silicosis for the development of coal mines be disappointed. After the reporter's interview, the Changde Municipal Party Committee and Municipal Government stated that they should check the problems, increase the intensity of screening, and pass various Measures to help old workers injured. I hope there will be a satisfactory result for all parties.
