In a letter to Caroline Maloney, chairman of the House Oversight and Reform Commission on September 30, the U.S. National Archives and Records Administration said that some Trump administration's White House staff used unofficial electronic accounts for official affairs and did not forward them to their official electronic accounts afterwards, resulting in the loss of some government electronic records. The letter also said that the National Archives and Records Administration will negotiate with the U.S. Department of Justice to decide whether to take action to recover records lost due to violations of the U.S. Presidential Records Act. But the National Archives and Records Administration declined to say whether former President Trump handed over all presidential records.
According to the U.S. Presidential Records Act, each administration must properly preserve all presidential records so that a complete set of presidential documents can be handed over to the U.S. National Archives and Records Administration at the end of its term. If records are improperly deleted or not properly handed over to the U.S. National Archives and Records Administration, the agency will require relevant personnel to return the relevant documents.
