China News Service Hong Kong, January 3rd: Regarding the oath-taking ceremony for members of the seventh Legislative Council of the Hong Kong Special Administrative Region of the People's Republic of China held on the 3rd, Chief Executive Carrie Lam Cheng Yuet-ngor, the Supervisor of Oaths, confirmed that the oaths taken by all 90 elected members of the Legislative Council were valid.

Article 104 of the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China stipulates that when taking office, members of the Legislative Council must legally swear to support the Basic Law of the Hong Kong Special Administrative Region and be loyal to the Hong Kong Special Administrative Region of the People's Republic of China.

According to the interpretation of Article 104 of the Hong Kong Basic Law (referred to as the "Interpretation") adopted by the Standing Committee of the National People's Congress on November 7, 2016, the person administering the oath has the responsibility to ensure that the oath is carried out legally. An oath that complies with the "Interpretation" and the laws of the Hong Kong Special Administrative Region shall be determined as a valid oath; an oath that does not comply with the "Interpretation" and the laws of the Hong Kong Special Administrative Region shall be determined as an invalid oath, and the oath shall not be rearranged.

According to the Public Offices (Standing for Election and Holding) (Miscellaneous Amendments) Ordinance 2021, which came into effect on May 21, 2021, the amended Oaths and Declarations Ordinance (Chapter 11) specifies that the Chief Executive or his authorized person is the administer of oaths for members of the Legislative Council.

According to the principles set forth in the "Interpretation" and relevant legal provisions, the Chief Executive determined that the oath taken by all 90 elected Legislative Council members was a valid oath. (End)
