The Hong Kong SAR government issued a statement on the 21st stating that among the fourth batch of district councilors who took the oath on October 8, the oaths of 16 people were invalid.

In accordance with the requirements of the Public Offices (Standing for Election and Holding) (Miscellaneous Amendments) Ordinance 2021, the SAR government held an oath-taking ceremony for district councilors of Tsuen Wan District Council, Tuen Mun District Council, Yuen Long District Council, Kwai Tsing District Council and Islands District Council at the North Point Community Hall on October 8.

The SAR government stated that the Commissioner of Oaths has determined on October 8 that among the 68 district councilors who took the oath that day, the oaths of 51 district councilors were valid. In view of the fact that the Commissioner of Oaths has doubts about the validity of the oaths taken by the remaining 17 district councilors, the Commissioner of Oaths has sent a letter to the relevant district councilors on the same day, requesting them to provide additional information. Among them, one district councilor resigned on the 11th.

After considering the written replies from the relevant district councilors and all relevant information, the Oath Administrator determined that the oaths taken by the 16 district councilors were invalid in accordance with the principles and relevant legal provisions set forth by the Standing Committee of the National People's Congress on the interpretation of Article 104 of the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China.
