USITCh said it will conduct patent infringement investigations on TSMC, Samsung Electronics and Qualcomm in certain semi-certain semiconductor devices, integrated circuits and mobile devices.
Reuters and TelecomLead website, which specializes in communication device and semiconductor information, reported that the US International Trade Commission said in a statement that it received complaints from Daedalus Prime, a company in , New York State, last month. After a vote, it decided to investigate certain semiconductor chips made by Samsung Electronics (Samsung Electronics) and TSMC (TSMC), as well as certain integrated circuits of Samsung Electronics and Qualcomm.
Daedalus Prime complained on September 13 that it alleged that the integrated circuits imported into the United States and sold by relevant companies, mobile devices and components containing these integrated circuits infringe upon patents and violated Article 337 of the Tariff Act of 1930. therefore required the US International Trade Commission to issue a "limited exclusion order" and a "cease and desist order".
The US International Trade Commission has not yet made any decision on the substantive issues of the case. The Chief Administrative Judge of the Committee will assign an administrative judge to arrange time for the hearing, and the administrative judge will make a preliminary judgment on whether a violation of Article 337 is required, and the results of the preliminary judgment shall be reviewed by the Committee.
US financial media reported that if the committee ruled that these devices infringe on Daedalus Prime patent, imports from the United States may be prohibited in accordance with the law. The devices targeted include smartphones, tablets and smartwatch , such as Samsung 's Galaxy S20 FE and Galaxy A71 5G phones, and Daedalus Prime's chips that TSMC has made for American companies such as Qualcomm.
Daedalus Prime complained to the committee about the scope of the patent claimed. It was originally developed by Intel Corp. and was later acquired by Daedalus Prime.
The committee launched an investigation into automotive semiconductors a week ago, which was also due to Daedalus Prime's patent infringement complaints. Companies importing these semiconductors include Mercedes-Benz USA LLC, NXP USA Inc and Avnet Inc.
Attorneys from Samsung, TSMC and Daedalus Prime have not responded to requests for comment.
