It is worth noting that due to the huge number of related application users, the number of downloads of the "LeTV Video" APP alone in the domestic application market is as high as 300 million times. The defendant's infringement diverted the traffic that should have belonged to Youku, seriously infringed on the legitimate rights and interests of Youku in the works involved, and caused huge losses to it.
For this reason, Youku asked the court to order the defendant to compensate him for his economic losses of 5.9 million yuan, attorney fees of 100,000 yuan, and notarization fees of 30,000 yuan. LeTV argued that the works involved in the case listed by Youku are not exclusively authorized to the outside world. In addition, the works involved are variety shows themselves and have strong timeliness. When the plaintiff collected evidence, it was more than one year since the first broadcast of the program involved. Therefore, LeTV believes that the amount of compensation requested by the plaintiff is obviously too high. Request the court to dismiss the plaintiff's lawsuit.
The court found that LeTV provided online playback services for works involved on its video platform without authorization, infringing on Youku's right to disseminate information network. Considering that after the agreement between the plaintiff and the defendant expired, the defendant continued to provide the playback and download services for the work involved for up to one year, with obvious subjective malice, and the defendant provided the work involved through multiple ports and had a wide range of dissemination, the defendant LeTV compensated the plaintiff Youku for economic losses of 1 million yuan and reasonable expenses of 25,000 yuan within ten days from the date of the effectiveness of this judgment.
